Enron Employee Committee to Recover over $2.1M from Convicted Former Energy Trader
The Enron Employee Committee has obtained a judgment for more than $2.1 million from former Enron trader Timothy Belden, who had previously been convicted for manipulating California energy prices.

Pursuant to a forfeiture agreement with the federal government, Mr. Belden, the former head of trading in Enron's Portland, Oregon office, has agreed to forfeit his wrongfully accelerated deferred compensation and bonus payments earmarked by the United States Attorney's Office for victims of Mr. Belden's wrongdoing. He had previously pleaded guilty to federal charges of conspiracy to commit wire fraud.

“Justice will be served through the recovery of funds wrongfully taken in the months preceding Enron’s collapse by one of its top executives,” said Ronald R. Sussman, partner in the Bankruptcy & Restructuring Practice at Cooley Godward Kronish LLP. Mr. Sussman led the Employee Committee litigation against Mr. Belden in connection with the wrongful acceleration of the deferred compensation payments.

Mr. Belden has yet to be sentenced on his conspiracy conviction, and prosecutors have said that he has agreed to cooperate with the government.

In addition to Mr. Sussman, the Cooley Bankruptcy & Restructuring team representing the Employee Committee in the case against Mr. Belden includes partner James A. Beldner, together with associates Gregory Plotko and Seth Van Aalten.

Case Joins Gust Rosenfeld
Kimberly A. Case joins Gust Rosenfeld P.L.C. as an Associate in our real estate practice group. She has assisted in multimillion-dollar real estate deals associated with corporate acquisitions, including drafting key legal documents. Case has performed real estate due diligence and has provided support for maintaining corporate governance and adherence to the Sarbanes-Oxley Act of 2002, including document retention and analyzing financial records.

Case received her B.A. from Arizona State University in 2002 and her J.D. from the Indiana University School of Law in 2005. While in law school, she was Managing Editor from 2004-2005 for the Federal Communications Law Journal, listed in Who’s Who: American Law Students from 2003-2005 and an Academic Merit Scholar from 2002-2005. In the Spring of 2005, she was recognized with the CALI Award in Banking Law. Admitted to practice in California and Arizona, she is a member of the State Bar of Arizona and the State Bar of California.

Founded in 1921, Gust Rosenfeld provides legal counsel to individuals, private and public corporations and governments. While known for its public law and finance practice, the firm also maintains significant practices in the areas of real estate, corporate, litigation, labor and employment, creditors’ rights and franchise law. The firm maintains offices in Phoenix and Tucson.

FETF Welcomes a New Partner
FETF is pleased to announce that Jon A. Birmingham has become a partner of the firm. Jon is a resident in FETF's Chicago office. He joined the firm in 2000, and had worked previously at the firm as a summer associate in 1998 and 1999. Jon's practice focuses on intellectual property litigation and prosecution, and includes a broad range of different technologies such as food packaging, irrigation equipment, household storage products, water dispensers, electronic medical devices, fluid systems, printing presses, optical recognition software, network management software, and injection-molded automotive components.

Winstead Announces New Shareholders; Elects Michelle Rieger and Peyton Smith to Executive Committee
Winstead Sechrest & Minick P.C. congratulated seven new shareholders for 2007. Two of the new shareholders are from the southern Texas Region. Paul Aubert works in Winstead's The Woodlands Office serving clients in the Corporate/Securities and Biotechnology practice groups. Bud Ehrlich is a registered patent attorney in Winstead's Houston Office serving clients in the Intellectual Property and Technology practice groups.

The remaining five new shareholders work in Winstead's Dallas Office serving clients in various practice areas including: Laurie Jardine, Litigation/Dispute Resolution; Richard Leucht, Banking & Credit Transactions; Frasher Murphy, Bankruptcy and Business Restructuring; Chris Nixon, Real Estate Structured Finance; and Bill Weinberg, Real Estate Financing with an emphasis on commercial real estate secured financing.

Winstead also announced the election of Michelle Rieger and Peyton Smith to Winstead's Executive Committee. Rieger is the section head of Litigation in the Dallas Office and focuses on representing owners, developers and general contractors in a variety of construction transactional and litigation matters. Smith is a shareholder in Winstead's Labor & Employment and Litigation Sections and works in the Austin Office. He advises and represents numerous companies on employment matters, drafts employment-related documentation, and guides and defends clients on employment, litigation and business issues.

The 2007 Winstead shareholders and executive committee members were selected in early December during the annual shareholders' meeting. Their new status will commence on January 1, 2007, and bring the total number of Winstead shareholders to 166.

According to Winstead CEO Denis Braham, "These are exceptional attorneys who represent a new generation of excellence at Winstead, strengthening our commitment to clients. They will continue to excel and contribute to our team in their new roles at the Firm. The new members of our executive committee represent a significant milestone for Winstead in terms of diversity. Michelle is the first of Winstead's female shareholders serving on the executive committee and Peyton will bring a fresh perspective in terms of geographic diversity as an Austin attorney with strong ties and business relationships that enrich the economic development of Central Texas.

Winstead Adds Senior Federal Transportation and Energy Official
Brigham McCown, an attorney and former senior-level Bush Administration official, has rejoined Winstead Sechrest & Minick P.C. as a shareholder. Since 2003, McCown has served in two top-level posts at the U.S. Department of Transportation (U.S. DOT).

McCown most recently served as the government's top regulator of energy and hazardous materials at U.S. DOT. In this capacity, he directed the agency's regulatory and enforcement oversight of all liquid and natural gas pipelines, and was responsible for oversight of all hazardous materials shipped by rail, sea, air, and truck. He presided over the Department's response to the largest oil spill in history on Alaska's North Slope; led the federal government's immediate efforts to restore vital energy and transportation infrastructure following Hurricanes Katrina and Rita; and played a central role in major policy and legislative initiatives affecting the national transportation industry, including the reauthorization of the federal highway, trucking, hazardous materials, and pipeline programs. Mr. McCown also served as U.S. DOT's point person in coordinating all energy and hazardous materials transportation security issues with the Department of Homeland Security and the Transportation Security Administration.

McCown previously served as the government's chief motor carrier lawyer, responsible for the nation's trucking, motor coach, and moving industries. In this capacity, he fashioned federal solutions to major challenges facing the U.S. DOT, including the high volume of cross-border trade pursuant to The NAFTA, public-private partnerships created for the purpose of investing private equity capital in transportation projects, and a wide range of regulations affecting motor carriers.

Rejoining the firm's Litigation and Government Relations practice groups, Mr. McCown will bring considerable experience to clients in the energy, transportation, and environmental industries.

WilmerHale Partner Stephen M. Cutler Named Executive Vice President, General Counsel of JPMorgan Chase
WilmerHale Partner Stephen M. Cutler was named Executive Vice President, General Counsel of JPMorgan Chase, effective February 2007. In his new role, Mr. Cutler will serve as head of the company’s legal and compliance activities worldwide.

“This is a once in a lifetime opportunity for Steve,” said William J. Perlstein, co-managing partner, WilmerHale. “Steve’s departure reminds us of the truly remarkable record that our firm has compiled in staffing leadership positions in major financial institutions and in important governmental positions in this country. Mr. Cutler joins JPMorgan Chase from the Washington, DC office of WilmerHale where he is a partner and co-chair of the firm’s Securities Department. Prior to re-joining the firm in 2005, he was Director of the US Securities and Exchange Commission’s Division of Enforcement. During his six-year tenure at the SEC, Mr. Cutler oversaw 1,100 employees and led the agency’s investigations of numerous financial reporting matters, as well as its actions involving exchange specialists, research analysts and mutual funds.

Prior to joining the SEC in 1999, Mr. Cutler was a partner at Wilmer, Cutler and Pickering where he worked for 11 years. Before joining the firm, he served as a Visiting Fellow at the Center for Law in the Public Interest in Los Angeles and a law clerk to Judge Dorothy Nelson of the U.S. Court of Appeals for the Ninth Circuit.

Aaron A. Gilman Listed Among Massachusetts’ Super Lawyers
Attorney Aaron A. Gilman, a shareholder in the law firm of Devine Millimet, has been listed among Massachusetts’s Super Lawyers 2006. Only five percent of the total lawyers in Massachusetts are selected for Super Lawyers distinction following an extensive balloting, research and screening process which includes asking lawyers to nominate the best attorneys they’ve personally observed in action. The 2006 list appeared in Boston Magazine’s November issue.

With over twenty years of experience representing businesses across the industry spectrum, Attorney Gilman currently focuses his law practice in the areas of general corporate law, mergers and acquisitions and employment law. He brings firsthand knowledge of the issues facing businesses and in-house counsel since, prior to joining Devine Millimet, he was Executive Vice President and General Counsel of NSC Corporation, a publicly-held company with twenty offices nationwide.

Attorney Gilman received his B.A. in 1977 from Vanderbilt University, and his J.D. from Boston University, University of Leeds, England in 1980. He is admitted to practice in Massachusetts and the U.S. District Court of Massachusetts.

He is a member of the Board of Directors of the Edgewater-Wakefield Memorial Foundation, Inc. and the Lawrence Boys & Girls Club, Inc., where he also served as the sponsorship chairman for its 2006 annual auction.
