Cooley’s Bankruptcy & Restructuring Team Wins Two Trials on Behalf of Unsecured Creditors in Troutman’s Emporium Bankruptcy
Cooley Godward Kronish’s Bankruptcy & Restructuring practice group has secured two winning verdicts in recent trials in the Troutman's Emporium bankruptcy case.

Representing the interests of the Official Committee of Unsecured Creditors in Troutman's, Cooley lawyers went to trial in two separate cases. The first involved the Alamo Group, which ultimately purchased some of the company’s assets in bankruptcy. The second was brought against Ron Troutman, one of the company's former officers.

The Cooley team was successful in obtaining a verdict valued at over $2M in the action against Alamo and approximately $250,000 in the matter against Mr. Troutman. The case against the Alamo Group was founded upon a breach of the Designation Rights Agreement through which Alamo acquired the assets of Troutman’s Emporium. The case against Mr. Troutman was based upon non-payment of various receivables due and owing to the company in bankruptcy.

“We are very pleased with the outcome of both trials in the Troutman bankruptcy case,” said Jay R. Indyke, the Bankruptcy & Restructuring partner who led the Committee in the Troutman’s Emporium bankruptcy. “These verdicts enhance the prospect of an even larger return for the unsecured creditors, who have already received cash distributions totaling 65 percent of allowed claims in the case.”

The Cooley trial team for the Alamo matter included partner Ronald R. Sussman and associate Jeff Cohen. The trial team for the Ron Troutman case included both Mr. Sussman and associate Gregory Plotko.

Enron Employee Committee to Recover over $2.1M from Convicted Former Energy Trader
The Enron Employee Committee has obtained a judgment for more than $2.1 million from former Enron trader Timothy Belden, who had previously been convicted for manipulating California energy prices.

Pursuant to a forfeiture agreement with the federal government, Mr. Belden, the former head of trading in Enron's Portland, Oregon office, has agreed to forfeit his wrongfully accelerated deferred compensation and bonus payments earmarked by the United States Attorney's Office for victims of Mr. Belden's wrongdoing. He had previously pleaded guilty to federal charges of conspiracy to commit wire fraud.

“Justice will be served through the recovery of funds wrongfully taken in the months preceding Enron’s collapse by one of its top executives,” said Ronald R. Sussman, partner in the Bankruptcy & Restructuring Practice at Cooley Godward Kronish LLP. Mr. Sussman led the Employee Committee litigation against Mr. Belden in connection with the wrongful acceleration of the deferred compensation payments.

Mr. Belden has yet to be sentenced on his conspiracy conviction, and prosecutors have said that he has agreed to cooperate with the government.

In addition to Mr. Sussman, the Cooley Bankruptcy & Restructuring team representing the Employee Committee in the case against Mr. Belden includes partner James A. Beldner, together with associates Gregory Plotko and Seth Van Aalten.

Retired Court of Appeals Judge George Bundy Smith Joins Chadbourne & Parke LLP
George Bundy Smith, a renowned judge who served for 14 years on New York’s highest court, joined Chadbourne & Parke LLP today as a partner in the firm’s litigation practice.

"George Bundy Smith has had a storied career, and we are honored to have such a distinguished jurist join Chadbourne," said Managing Partner Charles K. O’Neill. "He brings to the Firm a rich and varied career, and we are fortunate to welcome an individual so well-known for his commitment, courage, and tremendous work ethic."

"Judge Smith’s life history is the stuff of legend," added Thomas E. Riley, head of Chadbourne’s litigation department. "We’re thrilled to have him join the Firm."

Judge Smith served as a judge for over 30 years. His judicial service began in May 1975 when he was named to the Civil Court of New York City. He was a Justice of the Supreme Court of the State of New York from 1980 to 1986, and an Associate Justice of the Supreme Court, Appellate Division, First Department, from 1987 to 1992. He was appointed to the Court of Appeals, New York’s highest court, in 1992 by Governor Mario Cuomo, and served as an Associate Judge until his retirement in September 2006.

First as a student and then a young lawyer, Judge Smith labored to advance the cause of civil rights. In 1961, he joined other students in the Freedom Rides to Montgomery, Alabama, where the National Guard was needed to protect them from hostile mobs. After graduating from Yale Law School, Judge Smith served as an attorney for the NAACP Legal Defense and Education Fund. He later became a judicial law secretary in the New York state courts, and from 1974 to 1975 was the administrator of New York City’s Model Cities Program.

Judge Smith will be based in Chadbourne’s New York office. "I plan to develop a practice serving as a mediator and arbitrator, and will also focus on appellate and other litigation matters," Judge Smith said. "I eagerly look forward to joining Chadbourne and beginning this new chapter, but will also continue to pursue my other long-time interests such as teaching and writing."

Judge Smith has served as an Adjunct Professor of Law at the Fordham University Law School since 1981. He has also been involved in a variety of community and professional activities, including as Chairman of the Board of Trustees of Grace Congregational Church and a member of the Board of Directors of the Harlem-Dowling Westside Center for Children and Family Services. He is the co-chair of one of the transition committees working on behalf of New York Attorney General-Elect Andrew Cuomo.

Judge Smith holds a B.A. from Yale University, an LL.B. from Yale Law School, an M.A. and Ph.D. from New York University, and an LL.M. in the Judicial Process from the University of Virginia School of Law. His publications include a textbook for high school students about the Bill of Rights, as well as scholarly articles on subjects ranging from the Voting Rights Act to the admission of DNA evidence to New York appellate practice.

HARVARD LAW PROFESSOR LAURENCE TRIBE TO ADVISE AKIN GUMP
Constitutional law scholar Laurence H. Tribe will serve as a consultant to Akin Gump Strauss Hauer & Feld LLP, the firm announced today. He will consult with the firm and its clients, principally on constitutional and Supreme Court matters.

“Larry Tribe is not only the country’s preeminent law professor and constitutional scholar, but an extraordinarily accomplished litigator. His talents and experience are unsurpassed and he will be invaluable to our clients and our lawyers in every way, from shaping a case to arguing before the Supreme Court,” said R. Bruce McLean, Akin Gump’s chairman.

Professor Tribe’s recognitions and accomplishments are very well-known. He is a University Professor at Harvard, a designation afforded to only roughly 50 scholars in the entire history of the University. He is the author of 13 books, including American Constitutional Law, the most widely cited legal work of the last century, as well as more than 200 other publications. He has argued more than 35 cases before the Supreme Court, including numerous landmark cases. The National Law Journal has included Professor Tribe on its list of the 100 most influential lawyers in the nation every time it has published the list since its inception in 1985.

In addition to his academic work at Harvard University, which will remain his principal focus, Professor Tribe has advised and represented innumerable nations, states and individuals (such as Vice President Al Gore in the 2000 election litigation) and leading companies around the world. Many are existing clients of Akin Gump.

“I am very pleased to form this relationship with Akin Gump, which is one of the world’s great law firms,” said Professor Tribe. “Representing private clients in important disputes of the day allows me to put into practice the principles that are the focus of my teaching and writing.”

Professor Tribe will consult regularly with the firm’s extensive appellate practice, which is led by Rex Heinke. Other members of that practice include Hon. William A. Norris, who served for 17 years on the U.S. Court of Appeals for the 9th Circuit; Thomas C. Goldstein, who heads the firm’s Supreme Court practice, teaches at Harvard and Stanford Law Schools, and has argued 17 Supreme Court cases; former Supreme Court clerk Edward P. Lazarus, who has litigated in many federal and state appellate courts; and Hon. Murry B. Cohen, who served for 20 years on the Texas Court of Appeals.
