Moch secures favorable defense verdict for State Farm
Johnson & Bell attorney, Eric W. Moch, successfully defended State Farm in an arson and bad faith jury trial. Plaintiff, V.W., sued State Farm upwards of $300,000 in breach of contract and extra-contractual damages under Section 155 of the Insurance Code after State Farm denied his claim for fire loss to his home in 2003. State Farm’s claim investigation revealed a considerable amount of evidence that the policy holder set his house on fire in order to recover an insurance settlement and that he committed numerous material misrepresentations during the course of that claim investigation.

With just over seven days of trial the jury reached a unanimous verdict in only one hour’s time.

Mr. Moch’s practice at Johnson & Bell includes the representation of national and international insurers in first and third party disputes involving suspicious and fraudulent claims, claims of bad faith and declaratory judgment actions based upon policy construction and interpretation. He also represents a variety of insureds in general negligence actions, municipalities in the defense of a variety of negligence and civil rights actions, and attorneys in legal malpractice claims.

Attorney Trip Mackintosh Contributes To White Collar Defense Strategies
Holland & Hart LLP attorney J. Triplett Mackintosh recently authored a chapter of White Collar Law Defense Strategies: Leading Lawyers on Preparing for Trial, Offering Evidence, and Overcoming the Challenges of a White Collar Crime Case.

In the chapter "Defense of Investigations and Prosecutions under U.S. Export Control Laws" Mackintosh discusses many of the laws affecting international commerce. Mackintosh explains laws governing what can be bought and sold, when these laws apply, penalties, U.S. sentencing guidelines, potential errors in export control investigations and prosecutions, and practice pointers for defense counsel.

Mackintosh is a partner in Holland & Hart's Denver office. His practice focuses on white collar crime and export issues. He defends corporations, directors, and other personnel facing investigation under a variety of federal laws, including those governing export controls, embargoes, and corruption in the United States, Europe, Asia, and Latin America.

Aven Rennie does time for Muscular Dystrophy Association
A "warrant" was issued for Aven "Four Eyes" Rennie, a partner at Magavern Magavern Grimm LLP, by the Muscular Dystrophy Association. Ms. Rennie was whisked away by Kelsey of Hamburg High School's DECA Club to a jail cell at Pettibone's Grille at Dunn Tire Park where she spent her lunch hour soliciting donations from family, friends and business associates. Fortunately, Ms. Rennie was able to secure bail and was returned to the office, sans handcuffs, in time for her 1:30 appointment.

The Muscular Dystrophy Association is a national voluntary health agency dedicated to conquering more than 40 neuromuscular diseases that affect a million Americans of all ages. During the MDA Lockup, local business and community leaders agree to be "arrested" (for having a "big heart").

HILL WALLACK LLP PARTNER FEATURED AS SEMINAR PANELIST "When Can You Rely On An NFA Letter?"
Nielsen V. Lewis, a partner at the Princeton law firm of Hill Wallack LLP, has authored two articles concerning No Further Action ("NFA") letters of the New Jersey DEP and "innocent purchaser" defenses under the N.J. Spill Act designed to promote the acquisition and redevelopment of previously-contaminated properties by innocent developers. The first article, "Municipalities and Brownfield-Contaminated Properties," appeared in New Jersey Lawyer Magazine, the magazine of the New Jersey State Bar Association. The second, "Proceed With Caution: Pitfalls of Relying On A No Further Action Letter," was published in the New Jersey Law Journal. Mr. Lewis was a featured panelist at the recent New Jersey Builder’s Association Atlantic Builders Conference Seminar Panel, “When Can You Rely on an NFA Letter?”. His informative presentation explained the cleanup liability protection afforded by NFA letters, limitations on reliance on NFA letters for such protection, and the critical importance of exercising environmental due diligence before closing.

Partner-in-charge of Hill Wallack LLP’s Environmental Law Practice Group, Mr. Lewis counsels and represents corporations, public entities and individuals on a wide range of environmental and land use matters, including local development applications; environmental permitting; regulatory compliance; and environmental litigation, including complex CERCLA (Superfund), RCRA and New Jersey Spill Act disputes. A frequent lecturer and writer on environmental and insurance topics, he is a past Chair of the NJSBA’s Insurance Law Section, a member of its Environmental Law and Dispute Resolution Sections, and a Master of the Justice Stewart G. Pollock Environmental American Inn of Court. Mr. Lewis is admitted to the Superior Court Roster of Court-Approved Mediators.

Mr. Lewis received his undergraduate degree from Princeton University and his law degree from the University of Michigan Law School. He is admitted to practice in New Jersey, the United States District Court for the District of New Jersey and the United States Court of Appeals for the Third Circuit.

New USPTO Rules Limiting Continuations and Number of Claims
The United States Patent and Trademark Office (USPTO) issued a final rules package limiting the ability to file continuing applications as well as the number of claims. While the effective date of the new rules is not until November 1, 2007, many aspects will impact applications that are already pending.

The new rules are extensive and complex. The USPTO held a Web seminar on August 23, 2007 to explain and answer questions regarding their implementation, but still left many questions unanswered. Also, a lawsuit has already been filed seeking an injunction and declaratory relief preventing the USPTO from implementing the rules.

This letter is intended to highlight some of the key changes to the rules, as well as identify steps that you may wish to take before November 1st.

Attorney Yagelski Re-Certified in Creditors' Rights
Paul R. Yagelski, an attorney at Rothman Gordon, P.C., has been re-certified as a Creditors' Rights Specialist by the American Board of Certification. Mr. Yagelski has been certified since 2002 and has represented a large number of clients in varying creditor actions. He has had extensive involvement in bankruptcy proceedings, including proceedings involving motions for relief from stay; motions for dismissal of bankruptcy proceedings; and objections to the discharge of claims.

In order to become re-certified, Mr. Yagelski satisfied the requirements of: full-time practice of law for at least five years; maintained good standing in the bars of all states in which a license to practice is held; devoted at least 30% of his practice and at least 400 hours to creditors' rights related matters in the last three years; completed a peer review process by nine lawyers; and demonstrated commitment to continuing legal education by earning 60 hours of creditors' rights related education in the past three years.

The American Board of Certification (ABC) is a non-profit organization dedicated to serving the public and improving the quality of bankruptcy and creditors' rights bars. The rigorous ABC certification standards are designed to encourage bankruptcy and creditors' rights practitioners to strive toward excellence and to recognize those attorneys who are experts in their field. The ABC is co-sponsored by The American Bankruptcy Institute and the Commercial law League of America.

Mr. Yagelski earned his B.S., magna cum laude, from the University of Scranton and his J.D. at Duquesne University School of Law. He is a member of the Allegheny County and Pennsylvania Bar Associations, the Association of Trial Lawyers of America, the Pennsylvania Trial Lawyers Association, the Western Pennsylvania Trial Lawyers Association and the Commercial Law League.

Mr. Yagelski resides in Mount Lebanon with his wife, Lynne. They have three children.
