Ten Named "Leading Lawyers" by Inside Business
Ten Cleveland attorneys were named "Leading Lawyers" by Inside Business magazine in its annual survey, published in the December issue. This honor places the lawyers among the top one percent of attorneys in Northeast Ohio, according to Morgan Lewis, Editor, "Leading Lawyers."

Dettelbach Addresses Ohio State Bar Association
partner Steve Dettelbach was invited to be a speaker for an Ohio State Bar Association sponsored training, "Real Evidence for the Trial Lawyer."

Dettelbach spoke on "Practical Considerations of Presumptions, Inferences, Relevance and Judicial Notice." The speech covered not only the black letter law regarding these evidentiary rules, but the real life implications for their application at trial in both the state and federal system.

KKBR&F Names Kathleen Drakulich, Jennifer Lazovich, James Puzey and Russell Rowe to its Board of Directors
The statewide law firm Kummer Kaempfer Bonner Renshaw & Ferrario (Kummer Kaempfer) has elected four of its attorneys to become members of the firm’s Board of irectors, commonly referred to in the profession as “partners,” effective January 1, 2007. At a Board of Directors and Stockholders meeting held in November, Michael J. Bonner, the firm’s managing partner, announced Kathleen Drakulich, Jennifer Lazovich, James Puzey and Russell Rowe as new directors. Puzey is based in Northern Nevada and Drakulich’s practice is split evenly between Northern and Southern Nevada, while Lazovich and Rowe work primarily out of the firm’s Southern Nevada offices. The firm currently has 17 other directors.

“We’re fortunate to add these hard-working and talented attorneys as directors of the firm,” said Bonner. “They all have strong legal backgrounds with varied experiences that are beneficial to our clients. From a background in utilities to a career in sports, these attorneys provide Kummer Kaempfer with different perspectives to serve our clients in our growing legal practice. We look forward to their contributions to directing the firm’s future.”

Kathleen Drakulich joined Kummer Kaempfer in August 2004. Prior to coming to the firm, she served as associate general counsel for nearly 12 years for Nevada’s two largest electric utility companies – Sierra Pacific Power Company and Nevada Power Company. At Kummer Kaempfer, Drakulich brings her expertise to the utilities and energy practice area counseling clients on a broad scope of issues including electric, water, and gas issues; renewable energy and fossil fuel projects; and negotiating agreements related to the construction, permitting, purchase and sale of energy and water projects and their related facilities.

Jennifer Lazovich has been an associate with Kummer Kaempfer since November 2001. A native Nevadan, she is member of the firm’s government affairs department and practices in the areas of zoning, land use planning, and legislative affairs. At the local level, she represents industrial, commercial and residential clients on a variety of entitlement and development related matters. She has also negotiated and drafted development agreements for master-planned communities in Southern Nevada on behalf of public and private corporations. Previously, Lazovich worked in Washington D.C. in the finance division of the National Republican Senatorial Committee and for Sen. Harry Reid as a legislative intern.

James Puzey joined the firm in 2004. He practices in the areas of business and commercial litigation, contract litigation, construction litigation and gaming law. Before entering law, Puzey was a professional baseball player with the St. Louis Cardinals and represented the United States in the Pan American Games as a member of the U.S. National Baseball Team. Prior to Kummer Kaempfer, he was a partner at Allison MacKenzie, a law firm in Carson City.

Russell Rowe joined Kummer Kaempfer in May of 2000 as a member of the firm’s government affairs department. He is director of the firm’s legislative affairs team, where he represents clients on issues ranging from gaming and taxes to telecommunications and economic development. At the local government level, he practices in zoning and land use planning on behalf of residential, commercial and industrial developers, and provides specific guidance on the creation of gaming enterprise districts. Rowe previously worked in Washington, D.C. for two years under Congressman James Bilbray. Rowe is president of the board of Aid for AIDS of Nevada and also serves on the board of the UNLV Alumni Association.

Kummer Kaempfer is a prominent force in Nevada, serving local, regional, national and international clients in the real estate development, hospitality, gaming, manufacturing, service, high-technology, and energy and utilities industries. Founded in 1994, Kummer Kaempfer is one of Nevada’s largest law firms, specializing in complex corporate transactions, federal and state securities matters, commercial litigation, zoning and land use and regulatory law.

U.S. Government to Refund Call Centers Tax
The U.S. Treasury Department has abolished a tax law that will likely result in multimillion-dollar refunds for business users. The abolished tax is the federal excise tax of 3% on all long-distance calls. The tax was originally implemented in 1898 as a luxury tax on wealthy Americans who owned telephones.

According to the Treasury Department, the IRS will issue refunds to consumers and business customers for taxes paid over the past three years in their 2006 filings. In a press release issued earlier this year, Treasury Secretary John Snow stated, "Today is a good day for American taxpayers; it marks the beginning of the end of an outdated, antiquated tax that has survived a century beyond its original purpose, and by now should have been ancient history."

Key facts regarding the tax refund:
* No immediate action is required by taxpayers.
* Refunds will be a part of 2006 tax returns filed in 2007.
* Refund claims will cover all excise tax paid on long-distance service over the last three years (time allowed given statute of limitations). Interest will be paid on refunds.
* The IRS is working on a simplified method for individuals to use to claim a refund on their 2006 tax returns.
* Refunds will not include tax paid on local telephone service, which was not involved in the litigation.

Businesses are not required to dig through all of their old phone records to calculate their telephone tax refund. The IRS has developed a formula that most businesses can use to determine their refund. To use the formula, eligible taxpayers will need to review their phone bills for 2 months, instead of all bills included in the refund period. Additionally, businesses will need to know their total telephone expenses for the period and the number of employees reported on their federal withholding tax return (Form 941) for the second quarter of 2006 in order to use the formula.

SMU Bankruptcy Law Professor David Epstein Joins Haynes and Boone, LLP
David Epstein, a bankruptcy law professor at Southern Methodist University’s Dedman School of Law, has joined Haynes and Boone, LLP as Of Counsel and will be working out of the Dallas office one day a week.
Mr. Epstein is a recognized authority on bankruptcy who has written or co-written student texts on bankruptcy, commercial law, contracts, and corporations, as well as a widely used multi-volume treatise on bankruptcy for practitioners.

"Haynes and Boone has great lawyers and a great, national bankruptcy practice,” Mr. Epstein said. “I am proud to be a part of Haynes and Boone."

Mr. Epstein is an elected member of the American College of Bankruptcy, the American Law Institute, and the National Bankruptcy Conference. Before coming to Dallas, he served as law school dean for the University of Arkansas and Emory University. He has taught at other law schools, including the University of Texas, Harvard and the University of Chicago, and he has practiced bankruptcy law with the Atlanta firm of King & Spalding.

Mr. Epstein’s business bankruptcy practice has included representing committees, debtors, secured creditors and third parties acquiring assets. In addition, he has served as an examiner, representative of future claimants, and trustee.

He graduated with his LL.M degree from Harvard University in 1969, his LL.B from the University of Texas in 1966, and his B.A. from the University of Texas in 1964.
