Alan Rutkin of Rivkin Radler Moderates at the American Bar Association Meeting
Attorney Alan Rutkin, of Great Neck, a partner in the Insurance & Coverage Litigation Practice Group at Rivkin Radler LLP and a Vice Chair of the American Bar Association's Insurance Coverage Litigation Committee's Tort Trial & Insurance Practice Section (TIPS), was a co-moderator at the August 11 ABA meeting entitled, "Examining the Tripartite Relationship Connecting the Policyholder, Carrier, and Defense Counsel." Held at the Moscone Business Center in San Francisco, the panel of experts explored and examined the rights, privileges and ethics surrounding the tripartite relationship connecting the policyholder, carrier and defense counsel. The session delved into the policyholder's "right" to Cumis counsel and with the assistance of the law professors and judges on the panels tackled the thorny evidentiary issues that Cumis counsel spawns.

Alan Rutkin has been counseling insurers on new and unique issues for more than twenty years, and has special expertise in insurance coverage disputes involving environmental matters and other complex claims. A frequent speaker on litigation and insurance topics, Mr. Rutkin has also written extensively on insurance coverage litigation. For more than a decade, Rutkin has authored a defense litigation column for Best's Review for which he has been recognized by the American Society of Business Press Editors, with their Editorial Excellence award.

Mr. Rutkin has served on Rivkin Radler's Executive Committee, the firm's governing body. He currently heads the firm's pro bono program, which assists the indigent in coordination with Nassau/Suffolk Law Services. Mr. Rutkin also serves as General Counsel to Action Long Island, a business-related trade association.

Mr. Rutkin was admitted to practice in the State of New York in 1984, the United States District Court for the Eastern Districts of New York in 1985, and the Southern District of New York in 1986. He is a member of the American Bar Association (Litigation and Insurance Practice sections) and the New York State Bar Association. Mr. Rutkin received his Juris Doctorate degree from Boston University School of Law in 1983 and his Bachelor of Arts degree, cum laude, with honors in political science and a Becker Scholarship, from Union College (Schenectady, New York) in 1980.

Lowenstein Sandler to Receive Volunteer Lawyers for Justice Pro Bono Award
The Pro Bono Committee at Lowenstein Sandler has announced that David G. Tomeo and Jennifer J. McGruther have been selected by Volunteer Lawyers for Justice as recipients of the 2007 Pro Bono Attorney of the Year award. Mr. Tomeo and Ms. McGruther will be honored by the Volunteer Lawyers for Justice on October 2, 2007 during the Legal Services Foundation of Essex County Gala at the Manor in West Orange, New Jersey.

Highlights of David Tomeo and Jennifer McGruther's recent pro bono work have included their representation of an Essex County special education student at a "due process hearing" before the Office of Administrative Law, as well as in a related federal court proceeding. In a separate case, the attorneys successfully convinced the Essex County Chancery Court to cease execution of proceedings that would have evicted an Essex County woman from her home.

Melody Eagan Elected to Board of Directors for the Alabama Defense Lawyers Association
Melody Eagan, partner at Lightfoot, Franklin & White, was recently elected to the Board of Directors for the Alabama Defense Lawyers Association (ADLA). Before her selection as an Officer and Board Member, Melody has been an active participant in various Association activities, including serving as the Chairperson and later an instructor for many years for the Alabama Defense Lawyers Association Trial Academy, as well as a member of the Board of Directors for the Young Lawyers Section of ADLA. Melody has been elected to serve a three-year term on the Board of Directors.

Sen. Mark Amodei accepts top post at Nevada Mining Association
State Sen. Mark Amodei, a partner with the statewide law firm of Kummer Kaempfer Bonner Renshaw & Ferrario, announced today that he has accepted the position of president of the Nevada Mining Association (NMA) effective Oct. 1, 2007. He replaces Russ Fields, who will retire at the end of the year following 10 years of service with the leading trade association for mining in the state of Nevada

Sen. Amodei will remain in his current position at the firm until the end of August. “We are extremely fortunate to have had the opportunity to work alongside Mark for the past several years,” said Michael J. Klarquist Sparkman, LLP Invalidates Two Patents Asserted Against IGT
Klarquist Sparkman, LLP helped its clients International Game Technology and IGT win summary judgment of patent invalidity in a lawsuit filed by Aristocrat Technologies, et. al. (“Aristocrat”).

On June 13, 2007, the Honorable Martin J. Jenkins of the Northern District of California found U.S. Patent Nos. 7,056,215 and 7,108,603 invalid under 35 U.S.C. § 371, § 133 and § 102(b). The District Court ruled that IGT proved by “clear and convincing evidence” that the two patents in suit are invalid, because the ‘215 patent improperly issued from an abandoned patent application that was not lawfully revived, and the ‘603 patent was barred by the prior published ‘215 patent application. Aristocrat’s two asserted patents related to electronic gaming machine technology.

Federal Circuit Affirms Summary Judgment of Non-Infringement in Microsoft Case
Klarquist Sparkman, LLP attorneys helped our client Microsoft Corporation successfully prevail on summary judgment of non-infringement two years ago in the District of Oregon. The Court of Appeals for the Federal Circuit affirmed the District Court’s ruling in a decision published May 29, 2007. A copy of the Federal Circuit's decision can be found here.

The original case was filed in the District of Oregon in February 2004 by Motionless Keyboard Corporation, Inc. ("MKC"). MKC alleged that two of Microsoft’s Sidewinder joysticks infringed one patent and that Microsoft's Strategic Commander game controller infringed a second patent. Microsoft, along with co-defendants Saitek Industries, Ltd. and Nokia, Inc., moved for Summary Judgment of Non-Infringement, which the District Court granted in May 2005. MKC subsequently appealed the case to the Federal Circuit, where it was argued and affirmed.
