Kelley Drye Represents Independent Inventor in Lawsuit Against USPTO Over the New Continuation Rules
Within a day of the United States Patent and Trademark Office ("USPTO") publishing its final rule changes in respect to continuation practices, the USPTO and its Director, Jon Dudas, have been sued in the U.S. District Court for the Eastern District of Virginia by Tafas, an independent inventor. Tafas, represented by the law firm of Kelley Drye & Warren LLP, is seeking a declaratory judgment that the new continuation rules are null and void, and is seeking a preliminary and permanent injunction prohibiting the USPTO from putting the new rules changes into effect.

The complaint, and memorandum of law in support for the motion for preliminary injunction assert that the USPTO exceeded its Congressionally-delegated rulemaking authority and that the new rule changes specifically violate Section 120, 132, and 365 of the Patent Act. It is further asserted that USPTO failed to comply with the Administrative Procedure Act in promulgating the new rule changes. The suit also alleges that the USPTO has engaged in retroactive rulemaking and has failed to consider USPTO-induced reasons for multiple continuation filings.

Furthermore, Constitutional impediments to the new rule changes are raised. It is asserted that the USPTO did not comply with Article I, Section 8, of the United States Constitution by failing to adequately determine the effect of its rulemaking on the promotion of the "progress of science and the useful arts." It is also asserted that the USPTO's rule changes violate the taking clause of the Fifth Amendment.

Grant Killoran Appointed Co-Chair of ABA Health Law Litigation Committee

Grant Killoran is a partner in Michael Best's Litigation and Health Care Practice Groups, is the immediate past Chair of its Health Care Practice Group, and is the Co-Chair of its Pro Bono Committee.

Mr. Killoran has significant and diverse trial experience in the Wisconsin State and Federal Courts and courts around the country, focusing on complex health care and business disputes. Mr. Killoran also serves as one of the State Bar of Wisconsin’s five Delegates to the American Bar Association’s House of Delegates and is the immediate past Editor of the American Bar Association's Health Law Litigation Newsletter. Mr. Killoran has been named one of Wisconsin’s “Super Lawyers” by Law & Politics Magazine and also has been named an “Outstanding Health Care Litigator” by Nightingale’s Health Care News, a national health law publication. Gide Loyrette Nouel A.A.R.P.I. advises Air Liquide on its first acquisition in homecare in China:
Gide Loyrette Nouel recently advised Air Liquide, a world leader in industrial and medical gases and related services, on its acquisition of Celki International, a company established in Hong Kong and in the south of China.

With 130 employees, Celki supplies respiratory products and services to the Chinese market. The acquisition will serve as a base for expansion for Air Liquide which plans to identify and seize opportunities in the new homecare market in China.

Lead lawyer Fabrice Turries was assisted by Elsie Tam and Renaud Rossa on the deal.

Lloyd D. Levenson gives back to the community as Boys & Girls Club Gala Steering Committee Chairman
Lloyd D. Levenson, CEO of Cooper Levenson, an Atlantic City-based law firm known for community service throughout its 50-year history, will serve as Steering Committee Chairman of an inaugural gala to benefit the Boys & Girls Club.

Celebration of Champions is scheduled for September 8, 2007 at the Trump Taj Mahal. This black tie event will honor people who embody the core values adopted by the Boys & Girls Clubs. Scheduled to appear as champions, among others, are: New Jersey Governor Jon Corzine; Motown music legend Smokey Robinson; music producer Rodney Jerkins; Olympic medalist and author, Jackie Joyner-Kersee; boxer, attorney and children’s advocate, Jacquelyn Frazier Lyde; and Mario Lopez, television star.

“Without the Boys & Girls Clubs, many children would be without an encouraging, supportive, and safe environment to learn, play, grow, and realize their full potential,” said Lloyd D. Levenson, Esq. “I am proud to serve this wonderful organization that has been committed for so many years to each child it serves – and to all of us in the community as a whole.”

Founded in 1970 in an old warehouse donated by the Press of Atlantic City, the Boys & Girls Club reports a 1,000 percent growth over the last five years. More than 600 children attend one of eight Boys & Girls Club facilities in Atlantic County each day, and many more children remain on a waiting list. The proceeds from this event are slated to increase the number of children served and to enhance program offerings.
