LeClair Ryan Represents Message Level, LLC in Series A Financing
LeClair Ryan represented Message Level, LLC in a Series A financing that closed in April, 2007. The amount raised was no less than $1 million, with options to purchase up to $10 million in the aggregate. Message Level, based in Bethesda, Maryland, is developing an email security solution that brings trust and reliability to senders and recipients of email without requiring any action by end users. Through its patent-pending process, Message Level enables senders to block illegitimate email, provides senders with an audit trail, and lets end users know whether an email is authentic.

Two Lathrop & Gage Attorneys Selected by Peers as “Best of the Bar”
Lathrop & Gage L.C. attorneys Richard N. Bien and Don F. Dagenais were named by their peers to the Kansas City Business Journal’s “Best of the Bar,” a list of the most admired and respected lawyers in the Kansas City area.

Recipients were nominated by other lawyers throughout the metropolitan area. Once the votes were tallied, a panel of accomplished attorneys reviewed the list and made a final check of each honoree’s reputation and professional standing. The list was published in the Aug. 24 edition of the Kansas City Business Journal, along with a quote from each attorney.

Bien is the chair of the firm’s litigation division, where his practice involves the defense of class action claims; life, health and disability insurance defense; ERISA; general business and financial litigation; insurance professional liability litigation; insurance coverage litigation and real estate litigation. He is a past recipient of the “Best of the Bar” award and was named to The Best Lawyers in America® in 2007. He also was listed in Missouri/Kansas Super Lawyers in 2005 and 2006.

Dagenais is a member in the firm’s real estate practice area. He focuses his practice on commercial real estate purchases, sales, mortgages, leases, management and land use projects for all aspects of commercial development. He is a past recipient of the “Best of the Bar” award, in addition to being named to The Best Lawyers in America in 2007 and a Chambers USA “Leading Lawyer” for three consecutive years.

Gary D. Barnes: Mr. Barnes chairs the Insolvency Practice Group and is a member of the firm's Management Committee. His primary practice is the representation of creditors and committees in reorganizations and liquidations. Mr. Barnes is a Fellow of the American Bar Foundation. He is listed in Best Lawyers in America® in the 1997-98, 1998-99, 2001-2002, 2003-2004, and 2005-2006 editions in the area of Bankruptcy Law, and in the 2006 and 2007 editions in the area of Bankruptcy and Creditor-Debtor Rights Law. Mr. Barnes was also selected as one of the Best of the Best Lawyers in the inaugural edition of the Best of the Bar edition of the Kansas City Business Journal. He was also selected among the 2006 Missouri & Kansas "Super Lawyers®" and was voted one of the Top 100 "Super Lawyers®" in Missouri and Kansas and Top 50 "Super Lawyers®" in Kansas City in 2005. Mr. Barnes earned his law degree from the University of Missouri - Kansas City School of Law in 1978. He graduated with a B.A. in Political Science, summa cum laude, from William Jewell College where he is now a Trustee of the College.

Lisa A. Brunner: Ms. Brunner is a Member of the Firm in Husch & Eppenberger's Business Litigation Practice Group. Her practice includes advising health care professionals, business owners and human resource professionals on the prevention, management and resolution of disputes involving their organizations. Ms. Brunner has managed numerous matters to successful resolutions and defense verdicts for her clients. She achieved one of Missouri's top ten defense verdicts of 2006. Ms. Brunner is also honored with the 2007 Advocate of the Year award from the American Civil Liberties Union of Kansas & Western Missouri. She earned her law degree from the University of Missouri - Kansas City School of Law in 1999 and graduated with a B.A. in American Studies from the University of Kansas in 1993.

Scottie S. Kleypas: Ms. Kleypas is an Associate Attorney in Husch's Insolvency Practice Group. She represents creditors, committees, and trustees in bankruptcy proceedings. Ms. Kleypas earned her law degree from the University of Missouri - Kansas City School of Law. She earned a B.S. in Criminal Justice, with a Minor in Computer Information Systems, from Central Missouri State University in 1998. In 2006, Ms. Kleypas was honored with the Kansas City Metropolitan Bar Association's Outstanding CLE Contributor Award.

William A. Lynch: Mr. Lynch is a Member of the Firm in Husch & Eppenberger's Business Litigation and Franchise Law Practice Groups. He represents companies in product liability, general business, and health law cases and has given numerous talks to various groups including lawyers, physicians, and manufacturers dealing with litigation issues and strategies. Mr. Lynch graduated from the University of Kansas School of Law in 1973 and earned a B.A. from the University of Kansas in 1970.

Susan L. McGreevy: Ms. McGreevy is the Chair of Husch & Eppenberger's Construction Law Practice Group. Her practice consists primarily of advising construction companies, sureties, design professionals, and owners in their day-to-day business ventures, including the drafting and negotiation of all types of agreements, resolution of disputes, strategic and succession planning, and representing sureties in bond claims and litigation. Ms. McGreevy has written and spoken extensively on virtually all areas of construction law. In 2005, her article, "The Myth of the One-Year Warranty and Other Construction Warranty Issues" was selected by the editors of the American Bar Association's Property and Probate Magazine as the "Best Practical Use" real property article of the year. Ms. McGreevy is listed in the 2003-2004, 2005-2006, 2006, and 2007 editions of Best Lawyers in America® in the area of Construction Law.

Bruce A. Moothart: Mr. Moothart is a Member of the Firm in the Business Litigation Practice Group. His primary areas of practice are commercial, insurance coverage, products liability and personal injury litigation. Mr. Moothart's trial experience includes products liability, professional malpractice, personal injury, negligence, breach of contract, and trademark infringement cases. He graduated from the University of Iowa College of Law with Distinction in 1992 and earned an M.B.A. (1992) and a B.B.A. in Finance (1988) from the University of Iowa.

Jeffrey J. Simon: Mr. Simon is a Member of the Firm in Husch & Eppenberger's Business Litigation, Intellectual Property, and Franchise Law Practice Groups. He concentrates his practice in the area of commercial and business litigation, with a particular focus on antitrust and intellectual property issues, including prosecution and defense of trademark, trade dress, copyright, anti-dilution, and trade secret cases, and representation of clients in trademark registration and opposition proceedings before the U.S. Patent & Trademark Office. Mr. Simon earned a J.D. from the University of Missouri - Columbia, cum laude, in 1998 and from the same institution with a B.A. in English in 1985.

New York State Senator Neil Breslin Joins Hiscock & Barclay Law Firm
Neil D. Breslin has joined the Albany Office of Hiscock & Barclay, LLP. Breslin brings over 30 years of experience in real estate, torts litigation, and trusts and estates law to the firm. He presently serves as New York State Senator representing the 46th District, which consists entirely of Albany County. As a State Senator he participates on numerous committees, including the Insurance, Agriculture, Banks, Codes, Judiciary and Labor committees. Breslin also participates on many professional organizations including the Character and Fitness Committee for the Appellate Division, 3rd Dept., the National Council of Insurance Legislators, and the New York State Bar Association, holding many leadership positions throughout his years of service.

Breslin’s civic activities include 15 years as a board member of Arbor House, seven of which were served as President. Arbor House is an Albany area residence facility that assists women in need. He also served four years as Vice President of the Interfaith Partnership for the Homeless. In 1997, Breslin received the Distinguished Public Service Award from the Nelson A. Rockefeller College of Public Affairs and Policy. Breslin is a graduate of Fordham University and received his law degree from the University of Toledo Law School.

Hiscock & Barclay Expands Intellectual Property & Technology Practice
Hiscock & Barclay, LLP announces the continued expansion of its intellectual property practice with the addition of Peter J. Bilinski as Partner in the Firm’s Syracuse office. Bilinski has extensive experience in the preparation and prosecution of U.S. and international patent and trademark applications representing individuals, corporations, and higher education institutions.

Bilinski joins Hiscock & Barclay’s Intellectual Property and Technology practice from the firm originally known as Wall Marjama and Bilinski, LLP, and more recently re-named Marjama and Bilinski after founding partner Tom Wall joined Hiscock & Barclay earlier this year. Bilinski was a founding shareholder of the original firm. In addition to expertise in patent preparation and prosecution, he has successfully assisted businesses with due diligence investigations, patent and trademark validity and infringement opinions as well as transactional support relating to the sale and licensing of intellectual property assets. Prior to private practice, Bilinski was an attorney in the Patent Department of the Eastman Kodak Company, where he specialized in patent prosecution and preparation matters as well as the preparation of validity and infringement opinions. Before that he was a design engineer for over 10 years with the Eastman Kodak Company in their Government Systems Division.

Bilinski graduated from the Franklin Pierce Law Center, magna cum laude, and received his B.S. in mechanical and industrial engineering from Clarkson University.

Bingham California Team Scores Victory for Seoul Semiconductor; Federal Judge Nixes Nichia’s Induced Patent-Infringement Claim
Bingham McCutchen LLP, led by San Francisco partners Beth Parker and Monty Agarwal, and Silicon Valley partner Bill Abrams, won a significant victory yesterday for Seoul Semiconductor when a U.S. District Court judge dismissed Nichia Corp.’s induced patent-infringement claim against the largest light-emitting diode (LED) lighting solutions manufacturer in Korea. The court also ordered that Seoul’s invalid-patent claims against Nichia involving ornamental designs for LED products may proceed to trial, scheduled for Sept. 10.

Judge Maxine M. Chesney of the U.S. District Court for the Northern District of California rejected Nichia’s allegations that Seoul had induced the infringement of four Nichia patents and entered judgment in favor of Seoul. The court found that Nichia failed to present any evidence that Seoul induced the infringement of Nichia design patents in the United States through sales of its 902 series LEDs to customers in Asia.

“This is a vindication of Seoul Semiconductor’s business practices,” said Parker. “The ruling reduces Nichia’s initial claims for millions of dollars to thousands of dollars.”

Assisting Parker, Agarwal and Abrams were Bingham associates Kevin Bovard, Tom Clifford, Andrew Ellsworth, George Fox, Judith Hom, Chi Soo Kim, Amy Melaugh, Hoddy Potter, Samantha Stonework, Adrienne Taclas and Tiega Noel Varlack.

Japan-based Nichia sued Seoul Semiconductor in January 2006, alleging that Seoul infringed on its patents for ornamental designs for LEDs. In May 2006, Seoul filed counterclaims against Nichia, alleging noninfringement and invalidity.

Seoul Semiconductor is one of the 10 largest LED lighting-solutions manufacturers in the world. Seoul Semiconductor has been named to Forbes and BusinessWeek’s lists as one of the most promising Asian companies. Its product Acriche was recently named "Product of the Year 2006" by Elektronik, one of the most prestigious electronics magazines in Europe. Seoul Semiconductor’s primary business areas are LED packaging and custom-module manufacturing. It provides a full range of LED products, including AC-driven semiconductor light source, Acriche, high-brightness power, side-view, top, chip, lamp, and high-flux LEDs, and custom-type modules. Applications for the company’s LED products include general lighting; signage; back lighting for mobile phones, televisions and notebook computers; automotive lighting; home appliances; and signals. Seoul Semiconductor has 1,251 patents and 100 licenses. The company reported $200 million in sales in 2006 and has more than 1,000 employees, of which more than 145 are dedicated to research and development. It runs three overseas corporate offices and 11 branches, and approximately 90 distributors in the world.

Wall Street Journal Reports on Willkie’s Role in High-Profile Dell Investigation
The August 17 edition of The Wall Street Journal (page A3) reports that based on the findings of a comprehensive internal investigation conducted by Willkie and KMPG, Dell Inc. said it would restate more than four years of its financial results. The WSJ wrote that "a massive internal investigation found that unidentified senior executives and other employees manipulated company accounts to hit quarterly performance goals." The Journal notes that as part of the investigation Willkie conducted 233 interviews with 146 individuals.
