Capitelli Joins Jones Walker's New Orleans Office
The law firm of Jones, Walker, Waechter, Poitevent, Carrère & Denègre, L.L.P. is pleased to announce that Christopher M. Capitelli has joined the firm as an associate in the Business & Finance Practice Group. He will practice from the firm’s New Orleans office.

He received his J.D., cum laude, from the University of Texas School of Law in 2005 and his B.S. from the University of Texas in 2001.

Wiley Rein Secures Major Victory for Wireless Carriers and Equipment Manufacturers in Cases Alleging Cell Phone Emissions Cause Injury
A team of Wiley Rein communications attorneys led by Andrew G. McBride and Joshua S. Turner recently secured a major victory in a set of consolidated cases involving allegations of injury caused by radiofrequency emissions from wireless devices and systems. In Murray v. Motorola, the Superior Court of the District of Columbia dismissed a number of tort claims brought by several plaintiffs against many key players in the wireless industry, including claims for fraud and misrepresentation, strict liability, negligence and failure to warn.

In its ruling, the court explained that such claims are preempted under the doctrines of express preemption, conflict preemption and field preemption, stating that, “this Court concludes that the Motion to Dismiss has merit and that all of the Complaints must be dismissed with prejudice. There is only one reason for the dismissal, i.e., that the claims are preempted as a matter of law. This is not a close question. Having found that multiple alternative preemption doctrines are controlling, this Court has no discretion to allow the claims to proceed any further.”

This victory is an important one not only because of the breadth of the Court’s ruling on preemption, but also because there are numerous similar cases presently winding through the state and federal court systems. Wiley Rein served as lead counsel for a group of wireless carriers and manufacturers in the cases, including Verizon Wireless and Nokia.

GOVERNOR BUSH RE-APPOINTS RUDEN McCLOSKY CONSULTING’S MCKEE TO BROWARD JUDICIAL NOMINATING COMMISSION
Governor Charlie Crist re-appointed Clarence V. McKee, a Principal with Ruden McClosky Consulting in Fort Lauderdale, to the 17th Circuit Judicial Nominating Commission which makes recommendations to the Governor for Judicial vacancies in the Broward Judiciary.

Mr. McKee specializes in providing Government, Community, Media and Public Relations Consulting advice to clients and is the former owner of a Tampa Bay television station and a communications consultant. Prior to coming to Florida, he spent over twenty years in a variety of government and political posts in Washington, D.C including serving as a Legal Assistant to a Commissioner at the Federal Communications Commission. During the Reagan-Bush Administration he was appointed by President Reagan and served as Vice Chairman of the nation’s Legal Service Corporation which provides funding to legal assistance programs for the poor. Mr. McKee has been admitted to practice law in the District of Columbia, Pennsylvania and New York.

In Florida, he has served on the Boards of several companies including Barnett Banks, Inc., American Heritage Insurance Company, Florida Progress Corporation and its subsidiary Florida Power Company and is a current member of the Board of Directors of Associated Industries of Florida, Inc. In Fort Lauderdale, Mr. McKee is involved in a variety of civic activities including serving as a Mentor to the Principal of Blanche Ely High School and was a member of the Broward County School Board’s Task Force which reviewed funding options for the Broward District Schools. He is a Senior Executive Fellow of the Broward Chamber of Commerce and is a Member of the Executive Committee and Communications Chairman of the Broward Republican Party. In 2003, Governor Bush appointed him to the Destination Florida Commission.

Bob Bauer Shares Insight on Supreme Court Election Decision
In an article that appeared in the Washington Post, Bob Bauer, a partner in Perkins Coie's Washington, D.C. office, shared his views of the U.S. Supreme Court's ruling in June that may change the landscape in campaign finance law. The Court held that the Constitution did not permit Congress to rule out of bounds all "issue ads" or grassroots lobbying referring to federal candidates and funded by corporations and unions immediately before an election. The FEC will now use the opinion as a guide to establish specific guidelines on when an ad is lobbying Congress on an issue, and therefore is permitted, and when an ad crosses the line into electioneering. The article quoted election law experts, such as Bauer and Richard Hasen of Loyola Law School in Los Angeles, who's interpretation of the ruling is quite different. "His position is that the law has been shaken to its foundations and is in danger of collapse. Mine is that the opinion is more narrowly drawn than he claims and that ads paid for by corporations of the Swift boat type -- hard attacks on persona, character or fitness -- will remain out of bounds in the pre-election period," Bauer was quoted as saying in the article. Pennington shareholder Gene Adams invited to serve on Zoning Committee for new Elementary School
Pennington shareholder Gene Adams was recently invited to serve on the Leon County Schools Zoning Committee for new Elementary School L.

Mr. Adams, along with the other committee members, will listen to the concerns of members of the community, evaluate factors related to school zoning, and to make a responsible decision in the best interests of all of the children of Leon County Schools.

Pennington shareholder Marc W. Dunbar appointed to the Board of Directors for the NTRA's Political Action Committee, Horse PAC
Pennington shareholder Marc W. Dunbar was recently appointed to the Board of Directors for the National Thoroughbred Racing Association's Political Action Committee, Horse PAC. The NTRA is a broad-based coalition of horse racing interests consisting of leading thoroughbred racetracks, owners, breeders, trainers and affiliated horse racing associations, charged with increasing the popularity of horse racing and improving economic conditions for industry participants.

Horse PAC is one of the largest federal gaming PACs in the U.S. It supports federal political candidates who serve on Congressional committees that oversee matters pertaining to livestock and agricultural issues. The PAC also follows internet gaming and taxation issues and it endorses legislation providing tax relief and growth opportunities for racehorse owners, breeders and businesses. Horse PAC disbursements to date exceed $1 million.
