Plaintiffs’ Co-Lead Counsel In In Re Genetically Modified Rice Litigation, MDL 1811 (E.D. Mo.) Annou
Don M. Downing, a partner in the law firm of Gray, Ritter & Graham, P.C. (St. Louis) and Adam J. Levitt, a partner in the law firm of Wolf Haldenstein Adler Freeman & Herz LLC (Chicago), Court-appointed Co-Lead and Co-Interim Class Counsel in In re Genetically Modified Rice Litigation, MDL 1811, pending in the United States District Court for the Eastern District of Missouri, are pleased to announce the launch of a new case information website relating to that action.

The website, which can be found at www.bayerricelitigation.com, is intended to serve as a valuable informational resource for all long-grain rice farmers throughout the United States, other interested parties, the media, and the general public. The website contains extensive information and resources relating to the pending litigation – which was brought on behalf of U.S. rice farmers and others, based upon damages they sustained resulting from the contamination of the U.S. rice supply with unapproved, genetically-modified rice seed traits developed and tested by Bayer CropScience LP and related entities. The website includes key pleadings and Court orders; a case summary; a case timeline; newspaper articles; governmental documents; press releases; frequently asked questions; and bios and contact information for the attorneys comprising Plaintiffs’ court-appointed leadership group.

The contamination of the U.S. rice supply – with not less than two distinct genetically modified rice traits, LLRICE601 and LLRICE 604 – has caused significant economic damages to U.S. rice producers and has substantially diminished their ability to cultivate, market, or otherwise distribute their rice crops. These actions seek to hold Bayer, the developer of these genetically modified rice traits, accountable for the market losses and other economic and related damages they have caused U.S. rice producers. In addition to the rice producer actions, a small subset of cases in this consolidated, multidistrict litigation seek damages that this rice supply contamination caused to rice mills, rice exporters, and others.

Scranton Attorneys Gain Defense Verdicts
Partner Gene Feeney of the Firm's Scranton office recently obtained a defense verdict in Luzerne County. The plaintiff alleged that the defendant physician failed to timely diagnose and treat her recurrent thyroid cancer, which ultimately caused or increased the risk of the occurrence of breast cancer. In July 1986, the plaintiff was diagnosed with papillary carcinoma of the thyroid. Later that year, the plaintiff underwent a staged total thyroidectomy during which her most of her thyroid was removed.

Following the procedure, the plaintiff came under the care of the defendant for purposes of monitoring, evaluating and/or treating her thyroid condition. The defendant continued to monitor the plaintiff until November 2000. The records indicated that the plaintiff’s serum thyroglobulin level was elevated between 1986 and November 2000. Plaintiff alleges that despite this knowledge, the defendant did not relay this information to her, nor did he conduct, order or prescribe any follow-up tests, studies or evaluations to determine whether carcinoma of the thyroid existed.

The defendant retired from medical practice in November 2000 and the plaintiff began seeing a different endocrinologist, who noted the plaintiff’s serum thyroid globulin levels to be elevated at 9.1 in January 2001 and at that time, questioned whether her thyroid cancer had returned. The patient agreed to a repeat neck exploration and removal of any disease. The plaintiff ultimately underwent radical neck dissection with removal of approximately 9 metastatic lymph nodes. In the interim between February and July 2001, Plaintiff did have the development of breast cancer for which she underwent a lumpectomy and chemotherapy. Plaintiff alleged she developed breast cancer due to the defendant's negligence. The plaintiff’s demand to settle was $800,000.

In another medical professional liability case, partner Domenick Georgetti obtained a defense verdict in Union County. This trial involved allegations that a urologist was negligent in a his treatment of plaintiff for kidney stones. The plaintiff had a long complicated medical course and ultimately ended up receiving treatment at Hershey Medical Center. The plaintiff’s demand at time of trial was $500,000.

Senniger Powers' Associate Julie Jennings Named Up and Coming Lawyer.
Senniger Powers' Associate Julie Jennings was named one of Missouri Lawyers Weekly's "35 Up and Coming Attorneys" for 2007. She is featured in the August 27 article "Meet the Best of Gen X." The publication selected the 35 attorneys "for their dedication to learning, teaching, and improving their communities."

Ms. Jennings' practice focuses on trademarks, licensing, and copyright, and she is especially interested in several niche topics, including online keyword advertising and copyright protection for fashion designs. She is involved with the Alternative Dispute Resolution Committee of the International Trademark Association, and Volunteer Lawyers and Accountants for the Arts. She is adjunct professor at Washington University where she co-teaches a class in trademark practice. Ms. Jennings is Vice Chair of the Patent, Trademark, & Copyright Section of the Bar Association of Metropolitan St. Louis (BAMSL).

Ms. Jennings is "particularly proud of having represented several small business clients against very large corporations in trademark disputes during the past year...I greatly enjoy developing trademark strategies that augment my clients' overall business model and long-term goals. Ms. Jennings has practical advice for other young lawyers who want to stand out. Transportation and Project Finance Attorney R. Jay Fortin Joins Expanding Patton Boggs LLP New York Office
In a continuing campaign to add top legal talent to its New York office, Patton Boggs LLP has attracted transportation and project finance specialist R. Jay Fortin. Mr. Fortin is the latest lateral partner hire to join the firm’s growing Manhattan office.

He brings over 20 years of experience in project finance, aircraft, and railcar leasing and financing, secured lending, structured trade and commodity finance, and cross-border investment, with particular emphasis on the energy and transportation industries.

“The addition of Jay is the latest step in what has been a measured growth plan for our New York office since we opened in late 2006,” noted Jim Tyrrell Managing Partner of the Greater New York Metropolitan Area. “His project finance experience will enhance our overall capabilities, and thus provide our clients with a wider range of legal services on matters relating to corporate finance, international business transactions, and complex commercial litigation.”

At Patton Boggs, Mr. Fortin will continue to represent foreign and domestic banks and financial institutions, equipment lessors, airlines, developers, and private equity funds in a wide range of domestic and cross-border transactions involving energy and transportation infrastructure, such as power plants and ports, and transportation equipment. He has successfully negotiated numerous joint venture agreements between foreign and domestic parties relating to the acquisition, development, and financing of such assets, and has represented bidders in energy industry privatizations in Latin America and Central and Eastern Europe.

Specifically, Mr. Fortin is experienced with electric power generating facilities and related assets and the acquisition, leasing, and financing of commercial aircraft. He advises both lender/lessors and borrower/lessees in all varieties of structured financing, refinancing, workouts, and restructurings with respect to such assets.

Mr. Fortin frequently speaks on cross-border investment issues at international conferences and has written articles for project and trade finance publications

He graduated from the University of North Carolina at Chapel Hill, earning a J.D. in 1984 and attended the University of Rhode Island, earning a B.S., with honors, in 1977.

Larry King and David Wilk successfully defended Nash Finch Company against a WARN Act class action brought by former Econofoods store employees. The plaintiffs alleged that Nash Finch Company violated the WARN Act when it closed various stores. The week long trial in federal court in Minnesota resulted in the jury finding no violation of the WARN Act.
