Michael D. Heintzman and Jeanne Welch Sopher join Rawle & Henderson LLP
Rawle & Henderson LLP, announced today that Michael D. Heintzman and Jeanne Welch Sopher have joined the Firm as partners in the Firm’s Pittsburgh office.

Michael Heintzman has been a civil defense trial attorney in Pittsburgh for over 30 years concentrating his practice in the defense of product liability, medical malpractice, and toxic tort cases, the last 14 years of which were spent as a partner with Heintzman, Warren, Wise & Fornella, P.C. Mr. Heintzman has defended numerous companies confronted with toxic tort claims. He was selected to serve as National Coordinating Counsel for a company that supplies ash handling technology to power plants. In that capacity, he is currently supervising eight firms in 11 states, coordinating the client’s defense in numerous cases, and serving as lead trial counsel. Mr. Heintzman has tried asbestos cases to verdict in Texas, Pennsylvania, and New York, and settled numerous cases during trial in the same jurisdictions as well as in Michigan, Illinois, West Virginia, California, Oregon, and Georgia.

Mr. Heintzman graduated from the University Of Pittsburgh School Of Law in 1975. He is licensed to practice before the United States Supreme Court and the state and federal courts of Pennsylvania and Colorado.

Jeanne Welch Sopher concentrates her legal practice primarily in the areas of medical professional liability, toxic tort and product liability. She represents physicians and other medical professionals in defense of professional negligence claims and also represents refractory and engineering companies faced with toxic tort claims.

Ms. Sopher received a Bachelor of Science in Business & Administration in 1979 from Duquesne University where she concentrated in the areas of finance and accounting. She received a Masters in Business & Administration in 1987 from Duquesne University and received her law degree from Duquesne University School of Law in 1993.

Ms. Sopher is licensed to practice in Pennsylvania, the United States District Court for the Western District of Pennsylvania and the United States Court of Appeals for the Third Circuit.

District Court Strikes Down Clean Water Act Tulloch II Dredging Rule
The United States District Court for the District of Columbia found that two federal environmental agencies had exceeded their statutory authority and invalidated the “Tulloch II” rule. The rule presumed that the use of “mechanized earth-moving equipment” would result in the discharge of dredged or fill material into waters of the United States and thus would require a permit pursuant to section 404(a) of the Clean Water Act (CWA). National Ass’n of Home Builders v. U.S. Army Corps of Engineers, No. 01-0274 (D.D.C. 2007). The district court also enjoined the Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers (Corps) from enforcing and applying the Tulloch II rule. The ruling makes clear that not all uses of mechanized earth-moving equipment may be regulated under the CWA.

Kansas Supreme Court rules that ERISA violation claims covered by three (3) year Statute of Limitations
Employee filed her lawsuit in federal court claiming wrongful termination in violation of Employee Retirement Income Security Act. Employer moved to dismiss claiming the action was brought after the two year statute of limitations. The Kansas Supreme Court ruled upon the certified question from the U.S. District Court that the three (3) statute of limitations (which is applicable to liabilities create by statute) applies. Burnett v. Southwestern Bell Telephone, Kansas S.Ct. Docket No. 96,793, February 2, 2007.

Mark Osborn Nominated as State Bar of Texas President-elect Candidate
Mark Osborn, a partner in Kemp Smith's Trial Department, is one of two candidates selected to vie for the chance to lead the State Bar of Texas in an election decided by the state's 80,000 lawyers in April. The president elect candidates were nominated during a meeting of the State Bar Board of Directors Jan. 26 in El Paso.

The president-elect will server as the president of the State Bar of Texas from June 2008 through May 2009. More information on Mr. Osborn's campaign is available at Raising The Texas Bar.
