Seven Nexsen Pruet Attorneys Named Among North Carolina's "Super Lawyers
Seven attorneys in the Greensboro office of Nexsen Pruet Adams Kleemeier, PLLC have been named among North Carolina’s “Super Lawyers” in a Law & Politics publication survey.

The seven, who were recognized in the February edition of North Carolina Super Lawyers, include (click on name to see picture):

Margaret Shea Burnham, a Member who practices in the areas of commercial real estate transactions and litigation, and is a Board Certified Specialist in Real Property Law: Business, Commercial, and Industrial Transactions by the North Carolina State Bar;

M. Jay DeVaney, a Member who practices in the areas of commercial real estate and land-use litigation, and is a Board Certified Specialist in Real Property Law - Business, Commercial, and Industrial Transactions by the North Carolina State Bar ;

Trudy A. Ennis, a Member who practices in the areas of family law, civil litigation, and alternative dispute resolution;

R. Harper Heckman, a Member who practices in the firm’s Construction Practice Group and handles, lien, bond, and construction matters, as well as civil litigation;

Benjamin (Ben) A. Kahn, a Member who practices in the areas of bankruptcy law and commercial litigation, and is certified as a Specialist in Business and Consumer Bankruptcy Law by the American Board of Certification and by the Board of Legal Specialization of the North Carolina State Bar;

Christine (Christy) L. Myatt, a Member who practices in the areas of bankruptcy, creditors' rights and workouts, and is a Board Certified Specialist in Business Bankruptcy Law by the NC State Bar Board of Legal Specialization and the American Board of Certification.

David A. Senter, a Member who chairs the firm’s Construction Practice Group and practices in the areas of construction and surety, commercial litigation and commercial collections. .

Additionally, Burnham and Myatt were named to the publication’s “Top 50 Female Super Lawyers” list.

“Super Lawyers” are designated based on balloting and research conducted by Law & Politics, the parent publication of North Carolina Super Lawyers.

Burnham is a Board Certified Specialist in Real Property Law: Business, Commercial, and Industrial Transactions by the North Carolina State Bar; a certified mediator; a member of the American College of Real Estate Lawyers; councilor for the 18th Judicial District of the North Carolina State Bar; and a member of the state bar’s Board of Governors and former chair of its Real Property Section Council.

DeVaney is a member of the American College of Real Estate Lawyers Board of Governors and a fellow of the American College of Mortgage Attorneys. He is also a former chair of the North Carolina Bar Association’s Real Property Section and a former member of the Board of Governors. He is a Board Certified Specialist in Real Property Law - Business, Commercial, and Industrial Transactions by the North Carolina State Bar. He is also listed in Best Lawyers in America for real estate law and the “Legal Elite” by Business North Carolina Business, and is a member of Outstanding Lawyers of America.

Ennis is involved in CLE committees and activities of the North Carolina Bar Association and the Family Law Section of that organization. She is a Certified Mediator and has been named to the list of Best Lawyers in America in Family Law.

Heckman is a former chair of the North Carolina Bar’s Construction Law Section and is a member of the Contract Documents Steering Committee of the American Bar Association's Forum on the Construction Industry. Additionally, he has been included in the Triad Business Journal's "40 Leaders Under Forty" and was named among the “Legal Elite” by Business North Carolina.

Kahn is certified as a Specialist in Business and Consumer Bankruptcy Law by the American Board of Certification and by the Board of Legal Specialization of the North Carolina State Bar. In addition, he has been named among North Carolina's "Legal Elite" by Business North Carolina.

Myatt is a Certified Specialist in Bankruptcy Law by the Board of Legal Specialization of the North Carolina Bar and in Business Bankruptcy Law by the American Bankruptcy Board of Certification. She chairs the North Carolina Bar’s Bankruptcy Section; is a former chair of the Bar's Board of Legal Specialization and Business Law Curriculum Committee; and was named among the “Legal Elite” by Business North Carolina.

Senter is a member of the Governing Committee of the American Bar Association’s Construction Forum and is a past member of the council of the North Carolina Bar’s Construction Law Section. He is also a member of the Forum on the Construction Industry, the Tort and Insurance Practice Section, and the Litigation Section of the ABA, and is listed in Best Lawyers in America for construction law and among the “Legal Elite” by Business North Carolina.

Phil Lader Named Smithsonian American History Museum Trustee
Philip Lader, a Charleston-based partner in Nelson Mullins Riley & Scarborough, has been named a trustee of the Smithsonian National Museum of American History.

Located on the mall in Washington, D.C., the museum has 4 million visitors each year and houses more than 3 million artifacts, including the original Star Spangled Banner, Abraham Lincoln's top hat, Duke Ellington's sheet music, and Dorothy's ruby slippers from "The Wizard of Oz." Its exhibitions, including those on America's First Ladies, African-American Migration, and The American Presidency, explore major themes in American history and culture.

Also named to the museum's board was Pulitzer Prize-winning historian David McCullough, author of biographies of John Adams and Harry Truman. President Adams served as America's first Ambassador to the Court of St. James's, the post held by Mr. Lader from 1997 to 2001.

Attorney Phil Campbell Spoke at USF College of Medicine
Shumaker, Loop & Kendrick is pleased to announce that C. Philip Campbell, partner in the Tampa office, spoke on January 24, 2007, to internal medicine residents at the University of South Florida College of Medicine regarding what physicians should know about providing testimony in depositions and medical liability litigation.

Mr. Campbell has extensive experience in representing both private and public corporations in litigation disputes including shareholder disputes, contract disputes and class actions. He also regularly represents the broadcast media on first amendment issues and intellectual property matters and has substantial experience in the health care field regarding practice management issues and contracts. Mr. Campbell received his J.D. from Stetson College of Law in 1973 and his B.A. from Rutgers in 1970.

Attorney Barbara Pankau Elected to Board of Directors of Florida Academy of Health Care Attorneys
Shumaker, Loop & Kendrick is pleased to announce that Barbara R. Pankau, Partner in the Tampa Office, has been elected to the Board of Directors of the Florida Academy of Health Care Attorneys for the term 2006 to 2010. Mrs. Pankau is past president of the FAHA (Florida Academy of Hospital Attorneys).

Mrs. Pankau, a board certified health lawyer, has extensive experience representing physicians, hospitals, IPAs, HMOs, home health agencies, rehabilitation agencies and other providers and payers. She has substantial experience in managed care and integrated delivery systems, anti-referral legislation, health information privacy issues (HIPAA), state licensure and regulation, provider operational issues such as employment and other contractual arrangements, Medicare and Medicaid certification and reimbursement, medical staff matters (including staff privileges), and various administrative law and corporate law matters.

Peter Pearl Joins Bankruptcy Practice At Blacksburg Office
Peter M. Pearl of Roanoke has joined the law firm of Sands Anderson Marks & Miller as a member of the Business, Finance and Real Estate practice group focusing on bankruptcy law, firm president C. Thomas Ebel announced today.

Pearl has been practicing law for over two decades in bankruptcy and creditor’s rights. Prior to joining Sands Anderson Marks & Miller, he was a partner with and headed the Commercial and Bankruptcy Law Section of a major Atlanta, Georgia law firm where he practiced for nearly 17 years.

“During his significant career, Pete has handled the affairs of large and important clients during lengthy and complicated bankruptcy proceedings, and we are pleased to have his expertise within our statewide creditors’ rights practice,” said Brian R. Pitney, chair of the firm’s Business, Finance and Real Estate practice group.

Pearl, who has also represented secured and unsecured creditor clients in workouts, will join the firm through its Blacksburg office. He is admitted to practice in Virginia and Georgia, and has lectured over the years on various topics of bankruptcy law and workouts. He served as Chair of the Bankruptcy Section of the Atlanta Bar Association in 2002 and 2003 and was a board member of the section for six years.

A native of Martinsville, Virginia, Pete received his B.A. degree from Washington & Lee University. He earned his J.D. degree from George Mason University.

Employment Section Defeats Wage & Hour Class Action; Recovers Fees and Costs
Rutan & Tucker's Employment Section recently obtained a complete defense victory in a wage & hour class action brought against two Orange County road construction companies. The plaintiff alleged that the companies had failed to pay him and his coworkers prevailing wages and overtime, failed to provide meal and rest breaks, and violated other sections of the Labor Code and unfair competition laws. After the case was dismissed, the Court ordered the plaintiff to reimburse our clients for all of their attorneys' fees and costs. Rutan & Tucker attorneys handling the defense were Partner Mark Payne and Associate Shawn Larsen.
