Fraser Stryker Obtains First Letter Ruling Reflecting IRS Proposed Regulations
Fraser Stryker obtained for one of its tax-exempt organization clients the first 403(b) retirement plan letter ruling that reflects the Internal Revenue Service's complete positions taken on proposed regulations. Since 2003, the IRS has been working to write the first comprehensive set of 403(b) retirement plan regulations in over 40 years. During a four-year letter ruling process, Fraser Stryker worked with IRS headquarters to apply the Service's proposed regulations to a client's real-life situation. The recent letter ruling affects retirement plans for churches, schools, and other tax-exempt organizations. The IRS recently announced that it has completed its portion of the final 403(b) regulations project and is only waiting for the U.S. Department of Labor to issue its final approval.

Fraser Milner Casgrain Rises to Second Ranking Among Bloomberg’s Canada Equity Offerings: Manager Advisers in 2006 Q4 Report
Building on its steady growth in 2006 Q3, Fraser Milner Casgrain (FMC) has jumped to second place in Bloomberg’s Legal Adviser League Table for "Canada Equity Offerings: Manager Advisers." FMC now has a market share of 9.0%, an increase of nearly a full per cent from the previous quarter. The firm also maintained its Top Ten standing in Bloomberg’s "Canada Equity Offerings: Issuer Advisers" ranking.

Armstrong Teasdale Receives Top Verdicts in 2006
Paul Kovacs, Dan Nelson, James Martin, Mark Sophir and Craig Moore received one of the Top Business Verdicts and Settlements of 2006 (Dale Finke and Albert Riederer v. Morgan Stanley, et al) in the state of Missouri as reported in Missouri Lawyers Weekly. The $95 million dollar settlement, the second largest in 2006, was awarded to Dale Finke and Albert Riederer of General American Life Insurance Co. regarding a lawsuit with Morgan Stanley over the investment bank's role as adviser to the insurance company before the insurer's collapse in 1999.

Tim Gearin and Kristin Byrd received the Top Defense Verdict of 2006 (Nora Marie Hussey, individually and as plaintiff ad litem, et al. v. SSM Health Care St. Louis d/b/a St. Joseph's Health Center, Donald E. Binz et al) in the state of Missouri as reported in Missouri Lawyers Weekly. The family of a man brought a wrongful death lawsuit against the hospital and the man's doctor after the man went to the hospital with an infected toe and died when his myocardial infarction went undiagnosed. The defense argued that the standard of care was met by the hospital and doctor in both the assessment and treatment of the patient.

Carlton Callenbach served as co-counsel on two of the Top Largest Settlements in 2006 as reported in Missouri Lawyers Weekly. The 4th largest settlement (Lashley, et al v. Dairy Farmers of America, et al), involved a wrongful death case where the family of a couple killed in a collision with a milk tank trailer settled for $3,575,000 in Howell County, Missouri. The 9th largest settlement (Irsik and Boyer v. Estate of Douglas, et al), involved an automobile accident where two college students died and a third was injured when the car they were riding in was struck by a tractor trailer at an intersection under construction in Maryville, Missouri in October 2002. Settlements totaling almost $2.2 million were reached with defendants including Loch Sand Construction Co., which had been working at the scene of the accident; the Missouri Highway Transportation Commission; and Carroll Gene Foster, the driver of the tractor trailer.

Michael Dunnam of Woodcock Washburn Presents at MidAtlantic Venture Group
Michael P. Dunnam, a partner with the intellectual property law firm Woodcock Washburn LLP, is presenting to the MidAtlantic Venture Group on February 5 at the Science Center. His topic is “Articles Nexis Primer on IP for Angel Investors.”

Wiley Rein Partner: Global Warming Not “Near-Term Coverage Issue” for Insurers
In an article discussing the potential for lawsuits against industrial companies following the release of a U.N. report linking human activity to global warming, Wiley Rein partner Laura A. Foggan said she believes global warming is not “a near-term coverage issue” for insurers.

The article, “U.N. Climate Report Stirs Liability Fears” interviewed Foggan and other pollution liability experts.

Foggan explained that even assuming that global warming contributes to climate change, plaintiffs would still have to prove a company’s specific activities caused a particular event such as a hurricane. Then they would have to link that event to a specific bodily injury or economic loss covered under an insurance policy. Additionally, she believes commercial general liability pollution exclusions would still stand.
