Request for Preliminary Injunction Against Client Denied
EAPD client NessCap Co., Ltd. announced today that the U.S. federal district court in the Southern District of California has issued an order denying Maxwell Technologies, Inc.'s request for a preliminary injunction. The order states that Maxwell has not established a likelihood of success in the patent infringement action it filed in October 2006, accusing NessCap's ultracapacitor products of infringing Maxwell's U.S. Patent No. 6,631,074. As a result, U.S. District Judge John A. Houston ruled that a preliminary injunction will not issue, thus allowing NessCap to continue making, using, selling, or offering to sell its non-prismatic ultracapacitors in the United States while the litigation is pending. George Neuner (Boston), Brian Gaff (Boston), Scott Weston (Boston), and Hilary Dudley (Boston) all worked successfully on this matter.

Adams and Reese Moves to RSA Battle House Tower - Firm Demonstrates Commitment to Mobile and City’s Continued Economic Growth
The Mobile office of Adams and Reese LLP has moved into its new home on the 23rd floor of the RSA Battle House Tower. The regional firm leased 20,000 square feet of the newly-built, 41-story high rise which is the tallest and largest office building along the Gulf Coast.

The RSA Battle House Tower offers spectacular views of Mobile’s revitalized waterfront. Stretching some 745 feet skyward, the building’s lighted crown is visible for 30 miles up Mobile Bay.

“This is an important move for our firm,” according to W. David Johnson, Partner in Charge of the Mobile Office of Adams and Reese. “It is indicative of our commitment to Mobile and the city’s continued economic growth. Mobile is rapidly gaining momentum not only as one of the most thriving cities in the state, but in the South.”

The Mobile office is part of a regional network of approximately 300 attorneys and advisors resident in ten offices throughout five states and the District of Columbia.

Weil Gotshal Partners Ira Millstein, Holly Gregory Ranked Most Influential Players in Corporate Governance by Directorship Magazine; Partner E. Norman Veasey Also Cited
Weil, Gotshal & Manges LLP partners Ira Millstein and Holly Gregory have been highly ranked in the Directorship 100, the Most Influential Players in Corporate Governance, by Directorship Magazine in its September 2007 issue. Partner E. Norman Veasey was also cited for his distinguished career on the bench as former Chief Justice of the Delaware Supreme Court.

Ira Millstein, a Senior Partner at Weil Gotshal & Manges LLP, was ranked the eighth most influential player in corporate governance by Directorship for his leadership in counseling numerous boards of directors, including those of General Motors, Westinghouse, Bethlehem Steel and WellChoice. According to the publication, many regard Mr. Millstein “as the field’s preeminent lawyer,” and one judge called him “the grandfather of corporate governance.” Mr. Millstein was also recently recognized by Yale University, which named its Center on Corporate Governance and Performance in his honor. Among many other accomplishments, Mr. Millstein serves on the board of the World Trade Center Memorial Foundation, the entity charged with overseeing the fundraising and construction of the World Trade Center Memorial.

Holly Gregory was recognized for her participation in organizing corporate governance programs for the OCED, the World Bank, the Global Corporate Governance Forum, Yale’s International Institute for Corporate Governance, Transparency International, the SEC, and Columbia University School of Law’s Institute Investor Project.

Judge Veasey was cited for his tenure with the Delaware Supreme Court, "capped by a sterling reputation for leadership and humanitarian service." The Delaware courts overall were characterized as having "influence on corporate governance matters" that "rivals that of the SEC or Congress."

The Directorship 100 was compiled by a panel of 12 experts in corporate governance and reader nominations. The list includes directors, professors, regulators, politicians, advisors, and entities.

Kaitz + Associates LLP join Sherin and Lodgen LLP
Sherin and Lodgen LLP announces today that the attorneys of Kaitz + Associates LLP have joined the firm. Richard (Rick) Kaitz, Paula Curry, Lisa Avery-Peck and Jane Thomassen will relocate to the firm’s offices at 101 Federal Street, bringing the total number of attorneys to forty-eight.

“Attorneys of both firms put client service as their top priority,” said Gary Markoff, managing partner of Sherin and Lodgen LLP. “It was clear to us that we all value the critical needs and success of our clients.”

Real estate attorneys at Sherin and Lodgen have worked with the Kaitz group on numerous transactions over many years. Attorney Victoria de Lisle of New Orleans Named to International Who's Who of Real Estate Lawyers

Labaton Sucharow Files Class Action Lawsuit Against Semtech Corp
Labaton Sucharow filed a class action lawsuit on August 10, 2007 in the United States District Court for the Southern District of New York, on behalf of persons who purchased or otherwise acquired publicly traded securities of Semtech Corp. (“Semtech” or the “Company”) (NASDAQ: SMTC) between September 11, 2002 and July 19, 2006, inclusive, (the “Class Period”). The lawsuit was filed against Semtech and certain officers and directors (“Defendants”).

The complaint alleges that Defendants violated Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated thereunder. Specifically, the complaint alleges that Defendants artificially inflated Semtech’s previously reported financial results through an improper stock option backdating scheme that was perpetrated at the highest levels of the Company. Defendants carried out this scheme by intentionally manipulating the grant date of stock options awarded to themselves and other officers and directors of the Company, selecting dates on which Semtech’s stock was trading at a much lower price than the actual date of grant. In public disclosures, however, Defendants falsely claimed that the grants were dated and priced as of the date of the actual grant.

On July 20, 2006, Semtech revealed that it expected to record material amounts of additional compensation expense and restate its financial results from fiscal 2002 through 2006, and that its prior financial statements should not be relied upon. Semtech’s share price fell in reaction to the announcement, falling from $13.19 to $12.37 per share. Semtech shares continued to fall in reaction to the news on July 21, 2006, closing at $11.60 per share.
