David W. Denton: Outstanding Lawyer, Cherished Friend and Devoted Family Man
We mourn the loss of our friend and colleague, David W. Denton. While only with Porzio, Bromberg & Newman for a short time, we have a deep respect for Dave, a highly talented lawyer who chaired our corporate and government investigations and white collar practice.

Dave Denton's legal career can best be described as prestigious. From 1977 to 1992, he served as an Assistant U.S. Attorney in the Southern District of New York, where he handled grand jury investigations, and trials and appeals of a wide variety of federal crimes. While at the U.S. Attorney's Office, he held a number of supervisory and executive positions under then-U.S. Attorney Rudy Giuliani, including Executive Assistant U.S. Attorney, Associate U.S. Attorney and Chief of the Criminal Division.

Upon leaving government service in 1992, Dave was appointed Director of the Investigations Department at Citibank. He supervised a worldwide staff of financial investigators handling a broad range of internal wrongdoings, external frauds and fraud prevention programs, and served as Deputy General Counsel for Security and Investigations.

He joined Porzio in 2006 and was resident in our Manhattan office. We honor his memory. We extend our deepest condolences to his family. His loss will be deeply felt by the legal community.

Venable Adds Veteran Commercial Litigator Caroline Petro Gately
Continuing the national expansion of its commercial litigation practice, Venable LLP has added Caroline Petro Gately, an experienced litigator and a past president of the D.C. Women’s Bar Association Foundation, as a partner in the firm’s Washington, D.C. office.

Ms. Gately, 42, joins Venable from the Reston, Virginia office of DLA Piper. She will also practice out of Venable’s office in Tysons Corner. Ms. Gately's commercial litigation practice focuses on real estate and creditors’ rights disputes.

“Caroline Gately is a highly versatile litigator with a depth of experience in critical areas, including real estate and bankruptcy matters,” said J. Douglas Baldridge, chair of the Commercial South Litigation Group at Venable. “Caroline brings an established practice, and her reputation in our courts and community as an outstanding trial lawyer is of great value to our group.”

Ms. Gately is the latest in a string of high-profile partners to join Venable. A six-person employment law group, headed by Ari Karen and Caryn Pass, arrived just last month. Venable also added a group of five IP litigators led by JoAnna Esty to its recently launched Los Angeles office.

“Venable has long been known in the Washington region for its strength in commercial litigation. I have watched with increasing interest as the firm has expanded its practice nationally, including its recent expansion in New York and Los Angeles, without compromising its regional stature,” Ms. Gately said. “I am looking forward to the opportunities that Venable's preeminence provides for me and the clients that I serve. I was also drawn to the firm’s dedication to the diversity of its workforce, an area in which I hope to provide significant leadership, and its commitment to pro bono work.”

Ms. Gately is well known for her own civic and charitable work. She served as president and a director of the Women’s Bar Association Foundation, the charitable affiliate of the Women’s Bar Association of the District of Columbia, one of the oldest women’s bar associations nationwide. The Foundation’s principal mission is to empower women in the legal profession through networking, mentoring, and education.

Ms. Gately recently has served as a pro bono training instructor on sexual harassment and retaliation for the D.C. Department of Corrections. She also has represented children in abuse and neglect proceedings in D.C. Superior Court and was a guest teacher in Washington, D.C. public schools through a Federal Bar Association program.

Ms. Gately earned her J.D. from the University of Michigan Law School in 1989 and an A.B. from Princeton University in 1986, where she graduated cum laude.

T&K Attorneys Receive Favorable Appellate Opinion in Racial Discrimination Case Involving Medical Peer Review of Physician
The U.S. Court of Appeals for the Fifth Circuit has upheld a lower court ruling that the Methodist Health System in Dallas did not violate the civil rights of an African-American cardiologist whose privileges were temporarily suspended. The three-judge panel unanimously found that the physician, Dr. Mark Jenkins, presented no evidence that race was a factor in his suspension. The appeals court ruled that the hospital suspended Dr. Jenkins only after employees complained that he created a hostile work environment, and that racial prejudice did not motivate the hospital's actions.

In a related matter, the appeals court also upheld the lower court's sanctions against Dr. Jenkin's trial attorney. The appellate decision affirmed that the lawyer's summary-judgment briefing misquoted a witness in an affidavit and that "the error was glaring and could have had a serious impact" on the district court's decision.

Stephen F. Fink and Anthony J. Campiti represented the hospital and the hospital's executives and administrators who were also defendants in the case.

Former SEC Senior Trial Counsel Jose F. Sanchez Joins Sidley Austin LLP as a Partner in Its Securities Litigation Practice
Sidley Austin LLP today announced that Jose F. Sanchez has joined the firm as a partner in its Los Angeles office’s Securities Litigation Practice. Mr. Sanchez will focus his practice on securities litigation, government investigations and compliance counseling. He joins the firm from the United States Securities and Exchange Commission (SEC), where he served as Senior Trial Counsel in the agency’s Pacific Regional Office.

“Jose Sanchez is a highly respected securities litigator and we are thrilled to add him to our team of more than 80 litigators in the Los Angeles office,” said Chuck Douglas, Chair of Sidley’s Management Committee and head of the firm’s global litigation team. “As a former SEC trial lawyer, he brings tremendous first-chair trial experience, and a singular ability to advise clients on a range of SEC requirements and compliance rules.”

Theodore Miller, Vice-Chair of the Management Committee and head of the West Coast offices added, “Jose is a terrific litigator and strategist. His trial experience at the SEC provides him with invaluable insights into securities law enforcement and regulation. He joins other former senior SEC colleagues who practice in the firm and who counsel clients with respect to compliance, investigations, enforcement and class actions. Jose’s arrival adds a valuable facet to our robust securities litigation practice on the West Coast.”

Mr. Sanchez has extensive experience in a wide range of complex enforcement cases involving financial and accounting fraud, unregistered securities offerings, insider trading, and broker, investment adviser and other regulated entities. He has played a leadership role in several high profile cases, including the first SEC case connected with the recent market timing scandal that went to trial before a jury and a financial fraud case that led to the imposition of one of the largest penalties against an individual. Mr. Sanchez successfully helped try two of only ten court cases the SEC took to trial in 2006.

Mr. Sanchez received his J.D. at Stanford Law School, where he was awarded a two-year Skadden Public Interest Law Fellowship. He received his B.A., magna cum laude, from Harvard College. Mr. Sanchez also served as a law clerk for the Honorable Richard A. Paez, then of the Federal District Court of the Central District of California and for the Honorable Harry Pregerson of the Ninth Circuit Court of Appeals.

New Banking & Finance Partner Joins London Office
The law firm of McDermott Will & Emery UK LLP announces the appointment of Georgia Quenby as a partner in its Banking and Finance Group. Georgia will be working closely alongside existing Banking and Finance partners, Andrew Watson and Cam Brockie.

Georgia is a well-respected finance lawyer who represents clients across a broad range of industry sectors. She focuses on acquisition finance, debt restructuring, asset-backed lending and mezzanine finance. She is dual qualified to practice in New York as well as England and Wales.

Attorney-PH.D. Bolsters Intellectual Property and Life Sciences in Boston
The Boston office of McDermott Will & Emery is pleased to welcome Stephen Gaudet, Ph.D. as counsel in the Firm's Intellectual Property, Media & Technology Department. Dr. Gaudet brings with him more than 15 years of experience in science and law dealing with patents, copyrights, trademarks, trade secrets, unfair competition, licensing, securing venture capital and scientific misconduct. He focuses his practice on biotechnology including molecular biology, pharmaceuticals, immunology, small molecules, proteomics, chemical and biomedical devices. In addition, he has served as a scientific expert witness.

"Steve will be key to our intellectual property practice here in Boston and Firm wide will be a significant player in our life sciences/medical device practice," commented Toby Kusmer, head of the Boston office intellectual property practice. "His combination of legal plus scientific and technical experience is a great addition to our team."

Dr. Gaudet earned a Ph.D. with distinction in biochemistry/molecular biology from Georgetown University, a J.D. from Suffolk University Law School, a M.S. magna cum laude from Villanova University, a M.A. from Washington Theological Union and an A.B. from Merrimack College. After receiving his Ph.D., he conducted biomedical research in the area of neurotoxicity at the National Institutes of Health (NIH), for which he received an award from the National Academy of Sciences. Following his tenure at the NIH, Dr. Gaudet taught at the university level. He is admitted to practice in Massachusetts and before the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of Appeals for the First Circuit, the U.S. District Court for the District of Massachusetts and the U.S. Patent and Trademark Office (USPTO).
