LOWELL PETERSON APPEARS ON CBS
Lowell Peterson, of Meyer, Suozzi, English & Klein's New York City office was called upon again recently to provide a legal viewpoint to CBS's "Up to the Minute". Anchorwoman, Meg Oliver spoke with Mr. Peterson on the recent Wal-Mart class-action sexual discrimination lawsuit and states that "the court supported the plaintiff's claims that female employees of the world's largest retailer were subjected to a common pattern in practice of discrimination, earning, and advancing les than their male counterparts."

Mr. Peterson responds by saying, "You know, Wal-Mart interposed a lot of defenses basically saying everything that plaintiffs had to say was bunk. This is too big a class, it's gonna put too much pressure on the company to settle. There's no evidence that there's centralized corporate discriminatory practice."

When asked to speak about some of the evidence that stood out to him regarding the lawsuit, he replied, "Well, there was a testimony by some experts about the sort of sociological impact of having a centralized bureaucracy, having subjective decisions made by managers about pay and promotional practices. And the court below said, "look, this, we're not saying that there's a fire here, but there's a lot of smoke to suggest that these kinds of practices in fact are discriminatory." They used words like stereotyping, gender stereotyping, permitting a culture of discrimination to dominate nationally, even though of course we're talking about thirty-five hundred stores."

Mr. Peterson concludes by saying, "I think it's going to be litigated for a long time and there will be a settlement frankly. There'll be a settlement with charges in practices and there's going to be some payments.

Local Environmental Attorney Joseph Manko Speaks on Global Warming at the University of Pennsylvania's Institute of Environmental Studies. Wednesday, February 28 at Noon – Free to General Public
Joseph M. Manko, a founding partner of Manko, Gold, Katcher & Fox, LLP in Bala Cynwyd and a Penn Law Lecturer in Environmental Law, will give a presentation on global warming at the University of Pennsylvania’s Institute for Environmental Studies (IES) on Wednesday, February 28 at 12 p.m. Free and open to the public, the seminar is held at the Carolyn Lynch Room, 1st floor Chemistry Building, at 34th and Spruce Streets (entrance on 34th Street) in West Philadelphia. Due to the timeliness and worldwide impact of the issue, Manko is building awareness by delivering his lectures to local and international audiences, most recently having presented at an international conference entitled “Ravage of the Planet 2006” in Bariloche, Argentina, where he was the only lawyer invited to speak. The aim of IES’s weekly Seminar Series is to promote interactions among interested community members, faculty and students. It is dedicated to improving the understanding of key scientific, economic, and political issues that underlie environmental problems and their management.

Manko, a strong advocate and academic expert on environmental compliance and protection, will discuss the impact of and responses to global warming, highlighting the forthcoming U.S. Supreme Court decision which will determine for the near future how the nation intends to address the emission of carbon dioxide and its suspected impact on global warming. Manko’s lecture, entitled “Laboratories of Democracy: The Collision of Federal and Local Global Warming Policy in the United States, comes on the heels of a recent report by an Intergovernmental Panel on Climate Change stating that the increase in greenhouse gases are dominated by human activity and are a cause of global warming.

Manko will employ his thirty-three years of experience in the field of environmental law when he presents seminar attendees with a wealth of information that he believes will serve as a constructive tool for understanding the severity and importance of global warming and the interplay between the federal government and the nation’s states.

Manko, Gold, Katcher & Fox, LLP concentrates its practice in environmental, energy and land use law and litigation both in the Mid-Atlantic region and on a national basis. Manko, a lecturer on environmental law at the University of Pennsylvania and Vermont Law Schools, has expressed his concerns for environmental protection locally and globally by lecturing to local civic organizations on a variety of topics including global warming, Brownfield and other real estate development issues, land recycling, indoor air liability and financial disclosure of environmental liabilities. New California Global Warming Law Affects Many Industries
Jeffer, Mangels, Butler & Marmaro LLP (JMBM), one of California’s foremost full-service law firms, together with leading brokerage firm Cantor Fitzgerald, is holding an executive briefing on Friday, February 9, 2007, addressing AB 32, California Global Warming Solutions Act of 2006. The new state law caps California’s greenhouse gas emissions at 1990 levels by the year 2020. This legislation represents the first enforceable state-wide program to cap all greenhouse gas emissions from major industries, with penalties for non-compliance.

Malcolm Weiss, a partner with JMBM's Environmental Group, who has 25 years of experience with emissions trading and air regulatory compliance counseling, will be one of the seminar presenters.

"AB 32 affects California industry like no other piece of environmental legislation in history, with the most impacted sectors being power producers, utilities, mineral products, cement, petroleum and transportation," said Weiss. "We are urging companies to think about the Act's implications to their business, and are suggesting specific steps to plan for a carbon constrained future."

About 50 people are expected to attend Friday's briefing, which is the second in the series. Additional seminars are tentatively planned for San Francisco and San Diego. Former California assemblyman Joe Nation, a co-author of AB 32, will speak at Friday's seminar.
