Frederick W. Morris Admitted to American Board of Trial Advocates
Frederick W. Morris has been admitted to the American Board of Trial Advocates (ABOTA). He was admitted for membership as an “advocate,” having at least eight years of active trial experience, trying at least 25 jury trials to conclusion and accumulating 500 points, which are awarded based upon the number of days spent in a jury trial that is tried to conclusion. Morris has tried cases to juries in a number of state and federal courts throughout the United States and currently represents clients in litigated matters from coast-to-coast.

Resnick Discusses Commercial Real Estate Transactions with Kellogg MBA Candidates
To provide advice on how real estate professionals can best work with their lawyers, Jenner & Block Partner Donald I. Resnick gave a presentation on “Dealing with Attorneys” to students from Northwestern University’s Kellogg School of Management. As part of a Kellogg Real Estate Club event, approximately 25 MBA candidates, along with several alumni of the program, visited Jenner & Block’s Chicago office after spending the day at various other Chicago businesses involved in commercial real estate, including Related Midwest, JMB/Urban Development Company, and Mesirow Financial.

Drawing on his more than 30 years of experience in the practice of commercial real estate law, Mr. Resnick highlighted several important aspects of attorney-client communication in real estate transactions.

Mr. Resnick advised the aspiring business professionals on how to select attorneys based on the type of property and nature of the deal, and stressed the importance of laying out the ground rules and objectives of a negotiation with their attorneys at the deal’s inception.

“The communication method of the attorney and his client has a direct impact on the tone of the negotiations in a transaction,” said Mr. Resnick.

In addition, Mr. Resnick suggested that real estate professionals should actively manage the negotiation process throughout a deal, and communicate to the attorneys when they expect work to be done.

Mr. Resnick also touched upon payment of attorney fees. To avoid unnecessary controversies, he indicated that clients should pay promptly, and that discounts should be negotiated before the deal begins.

“The development of a strong personal relationship with your attorney takes time, but it is a key component to success in real estate deals,” Mr. Resnick concluded.

Mr. Resnick, the Chair of the Firm’s Real Estate Practice and Co-Chair of the Firm's Real Estate Securities Practice, represents clients in connection with all types of real estate transactions, including acquisitions and dispositions, leasing, joint ventures and like-kind exchanges involving office buildings, multi-family apartment projects, retail projects, hotels and industrial facilities.

Following the discussion, Jenner & Block hosted a reception for the MBA candidates and the Kellogg alumni presently working in the commercial real estate field. The reception was attended by members of Jenner & Block’s Real Estate, Tax, Environmental, Energy and Natural Resources, and Bankruptcy, Workout and Corporation Reorganization Practice Groups.

On Behalf of Nassau County District Attorneys Office, Edwards Angell Palmer & Dodge Attorneys Defeat Criminal Defendant’s Attempts to Overturn His Conviction and Reduce His Sentence For Armed Robbery, Attempted Armed Robbery and Criminal Menacing
Anthony J. Viola and Andre K. Cizmarik, litigators in Edwards Angell Palmer & Dodge’s New York Office, successfully opposed a criminal appeal filed by a repeat offender who this time was attempting to overturn his latest conviction for armed robbery, attempted armed robbery and criminal menacing. The conviction was affirmed and the criminal defendant will continue to serve the remainder of his 15-year sentence. Typically, these appeals are defended by the District Attorneys Office. However, in this instance, Messrs. Viola and Cizmarik were appointed as Special Assistant District Attorneys by District Attorney Kathleen Rice and served in a pro bono capacity on behalf of the Nassau County District Attorneys Office. The defendant was charged with felony counts of robbery in the second degree, attempted robbery in the second degree and criminal menacing. The defendant was convicted by a jury and later sentenced to concurrent, determinate sentences of 15 years, 7 years and 1 year for the respective crimes. On appeal, the defendant argued that the conviction should be overturned because he received ineffective assistance of counsel by virtue of his attorneys’ failure to challenge the constitutionality of his warrantless arrest in his home and because the verdict was against the weight of the evidence. The defendant also challenged his fifteen year sentence as being harsh and excessive. The Appellate Division, Second Department rejected all defense arguments and upheld the conviction and sentence for this felony offender. Alison Reuter, a Fordham University law student and a 2005 and 2006 summer associate (who will be joining EAPD in the fall of 2007 as an associate) provided invaluable assistance in this case. Ms. Reuter’s involvement in drafting the appellate brief exemplifies the hands-on, practical experience and responsibility enjoyed by summer associates at EAPD.

Dykema’s Appellate Litigation Specialist Receives Honor
Kathleen McCree Lewis, Member of the firm’s Litigation Practice and past president of the American Academy of Appellate Lawyers, has been named one of the top ten lawyers in Michigan by Michigan Lawyers Weekly.

As leader of Dykema’s Appellate Practice Team, Ms. Lewis represents clients and consults with other lawyers and law firms on civil appeals in the Michigan Court of Appeals and Supreme Court, the U.S. Court of Appeals for the Sixth Circuit, and the United States Supreme Court. She also has practiced in the Courts of Appeals for the Seventh, Eighth, Ninth, Tenth, Eleventh, and Federal Circuits. She has participated in seminars on state and federal appellate practice sponsored by the American Academy of Appellate Lawyers, American Bar Association. Defense Research Institute, Detroit Metropolitan Bar Association, Federal Bar Association (Detroit and Cincinnati Chapters), Michigan Appellate Bench-Bar Conference, National Bar Association, Network of Trial Law Firms, State Bar of Michigan, Women Lawyers of Michigan, Wayne Region, and Wolverine Bar Association.

From 1996 to 1999, Ms. Lewis chaired the Sixth Circuit’s Rules Advisory Committee and is a Life Member of the Sixth Circuit Judicial Conference. From 1992 to 1995, she co-chaired the Appellate Practice Committee of the American Bar Association Section of Litigation and is a member of the Council of the State Bar of Michigan Appellate Practice Section. In 1999 and 2001, she was nominated by President Clinton to serve on the U.S. Court of Appeals for the Sixth Circuit.

A resident of Detroit, Ms. Lewis received her J.D. and B.A. degrees from the University of Michigan.

First French PPP Under New Regulation
White & Case advised Dexia Crédit Local in its role as lender in the first Public Private Partnership (PPP) established under France's new PPP Regulation, which came into force in 2004. In the deal, a €250 million contract for the upgrade of France's elite national sports academy INSEP (L'Institut National du Sport et de l'Éducation Physique) was awarded to a consortium formed by GTM Construction and Barclays European Infrastructure Fund (BEIF). Although a number of PPPs in France have been established in specific sectors under a sector-specific PPP regulation introduced in 2003, the deal is the first signed under the new general PPP regulation of June 17, 2004.

The White & Case team advising Dexia Crédit Local was jointly led by Energy, Infrastructure and Project Finance partners Jacques Bouillon and Paule Biensan, with the former leading on project contract issues and the latter on financing issues. They worked closely with associates Jean-François Le Corre, Bénédicte Levier, Marianna Sedefian and Caroline Marchand.

Kenda K. Tomes Named a Member of the Missouri Securities Advisory Committee
Stinson Morrison Hecker LLP attorney Kenda K. Tomes is currently serving on the state of Missouri’s Securities Advisory Committee. Tomes was asked to sit on the committee by Secretary of State Robin Carnahan.

Participants on the Securities Advisory Committee are asked to provide feedback to the Missouri Securities Division regarding issues relating to the investments industry and securities regulation.

Tomes, a corporate finance partner in the Kansas City office, serves as outside general counsel for a wide range of publicly and privately held companies. She advises her clients regarding public and private offerings, securities law and corporate governance compliance, joint venture and consulting arrangements, contract negotiation, mergers and acquisitions, financing transactions, spin-offs and other business matters.

Carson Joins The Law Firm Of Rumberger, Kirk & Caldwell
Matthew J. Carson recently joined the Tallahassee office of Rumberger, Kirk & Caldwell as an associate practicing in commercial litigation, employment and labor law, and appellate work. Prior to working at Rumberger, Carson was assistant general counsel for the Florida Department of Education.

Carson participated in the University of Florida’s honors program and graduated in 1997 with a bachelor’s degree in zoology and a minor in secondary education. He went on to earn his J.D. cum laude from the University of Florida College of Law in 2004. While in law school, he served as managing editor for the Journal of Law and Public Policy.

He is a member of The Florida Bar, the Tallahassee Bar Association, the Young Lawyers Division of the Tallahassee Bar Association, and he is admitted to practice in the Northern District of Florida.
