CRAVATH REPRESENTS UNDERWRITERS OF SWITCH AND DATA IPO
Cravath represented the underwriters (led by Deutsche Bank Securities and Jefferies & Company) in connection with the $198 million initial public offering of common stock of Switch and Data, Inc., a leading provider of network neutral interconnection and colocation services primarily to Internet dependent businesses. The shares were listed on the Nasdaq Global Market. The lawyers involved in this matter were partners John T. Gaffney and Andrew J. Pitts, and associates Sarah S. Jones, Frank X. Schoen and David W. Azarkh.

Chapman and Cutler Again Ranked as Most Active Bond Counsel in US
Continuing an unbroken success streak that dates to 1981 and longer, Chapman and Cutler LLP has once again advised on more tax-exempt transactions than any other law firm.

The public finance league tables for 2006 were issued recently by Thomson Financial, with Chapman again ranked the Number 1 legal advisor by number of long term issuer financings.

Chapman served as issuer bond counsel on 600 tax-exempt financings last year, accounting for 160 more deals than the next highest law firm. On negotiated deals, the firm’s total of 481 deals was 180 more than the Number 2 firm. Chapman’s public finance group counseled state and local municipalities and entities on a wide range of financings in 2006, raising $8.7 billion in proceeds used to fund spending on new roadways, dormitories and other school and university facilities, water and sewage plants, hospitals and other public works. Issuers represented by Chapman are based largely in Illinois and the Midwest, as well as in California and Utah. Clients range from state governments and agencies to cities, counties, and incorporated villages and townships, as well as school districts and special purpose districts and non-profit corporations and authorities.

The firm’s transaction total dipped somewhat from 2005’s total of 652 deals, though it marked only the fourth time in 26 years that financings reached 600 or higher. In 1981 – the first year that Thomson Financial monitored the municipal market – Chapman advised on 150 tax-exempt issues.

Chapman also stood out in a number of other categories as bond counsel in 2006. The firm was ranked ? Number 1 advisor in Illinois, handling 522 new issues, accounting for $5.97 billion in proceeds ? Number 1 for advising on largest number of education issues (261) and higher education (40) ? Number 1 for advising on largest number of new issues involving pollution control financings (17) ? Number 2 advisor for new issues by dollar volume tied to multi-family housing ($321.0 million) ? Number 3 advisor for long-term new issues in Utah by dollar volume ($343.2 million) Nationally, Chapman also ranked in the Top 10 by dollar volume in a number of other noteworthy segments, including Number 4 advisor for combined utilities new issues and Number 6 advisor for health care new issues. The firm was the most active legal advisor in the U.S. for general obligation issues, refundings, and for long-term new issues under $10 million.

“While not quite a record year, 2006 was among the most active periods for new financings, as municipalities and taxexempt authorities showed a strong need to fund a host of important public projects in what has remained a moderate environment for interest rates,” said Daniel Johnson, who chairs the public finance practice at Chapman and Cutler.

Cadwalader Adds Intellectual Property Attorney
Cadwalader, Wickersham & Taft LLP, one of the world’s leading international law firms, announced that James T. Bailey has joined the firm as Special Counsel in the firm’s Litigation Department concentrating on intellectual property and patent infringement litigation and counselling. Mr. Bailey will be based in the firm’s New York office.

Mr. Bailey, a former partner at Kirkland & Ellis, will focus primarily on litigating patent infringement cases involving a wide variety of technologies as well as other intellectual property litigation and counseling on intellectual property matters. Mr. Bailey received his B.S., with high distinction, and M.S. from the University of Virginia. He received his J.D., magna cum laude, from the University of Michigan Law School, where he was honored with the Saul L. Nadler Memorial Award. Mr. Bailey is admitted to practice before the U.S. Patent and Trademark Office and in the State of New York.

Daniel N. Sharkey to speak at 9th Annual Automotive Suppliers Symposium on March 8
Butzel Long attorney and shareholder Daniel N. Sharkey will be a featured speaker at the 9th Annual Automotive Suppliers Symposium on March 8, 2007 at Grand Valley State University’s Van Andel Global Trade Center in Grand Rapids.

Mr. Sharkey's presentation is titled, "Increased Raw Material Costs and the Law: Who Gets Stuck with the Tab?" He will discuss strategic approaches to material cost issues and how the courts address disputes in the automotive supply chain. He will provide a balanced discussion of key legal issues and how to best leverage a negotiating position.

Mr. Sharkey has represented suppliers ranging from large Tier I companies to small tool and die shops and molders. He concentrates his practice in commercial, construction and environmental litigation, and corporate compliance and internal investigations. He has additional significant experience in litigation involving class actions, franchises and dealerships, insurance coverage, products liability, securities, creditors' rights, real property, and sales representative commissions. He has tried more than 30 cases in U.S. District, Magistrate, Bankruptcy, and Military Courts, and represented parties before more than 20 administrative boards.

Prior to joining Butzel Long, Mr. Sharkey was a Captain in the U.S. Army Judge Advocate General's Corps, 3d Infantry Division (Mechanized), where he served as a Trial Counsel and Special Assistant United States Attorney.

Mr. Sharkey is the author or co-author of several articles, including, "The Class Action Fairness Act of 2005: Sensible Reform or Orwellian Title?" 25 Michigan Business Law Journal 3 (Fall 2005) and, "Protective Orders: Safeguarding the Manufacturer's Confidential Information," Products Liability Advisory Council, Annual Seminar, March 2000.

Mr. Sharkey presented "Increasing Raw Material Costs and Decreasing Vehicle Prices: What Gives? A Legal Perspective" to the Original Equipment Suppliers Association in 2006, was a speaker at the American Bar Association's Annual Meeting in 2003, is a member of the Michigan State Bar's Commercial Litigation Committee, and is the former Chair of the Young Lawyer's Division of the Federal Bar Association's Eastern District of Michigan Chapter.

Mr. Sharkey is a graduate of the University of Notre Dame (B.B.A., cum laude, 1992) and Vanderbilt University School of Law (J.D., 1995). He was admitted to the State Bar of Michigan in 1995.

Prince Leads Transportation Committee
Blackwell Sanders Partner Tom Prince has been elected to serve as chair of the Downtown St. Louis Partnership’s Transportation Committee. Topics of focus include the I-64 reconstruction project, the New Mississippi River Bridge and the expansion of the Metrolink system. Prince has been a member of the Downtown St. Louis Partnership’s Board of Directors since 2004.

The Transportation Committee monitors and collaborates with others on behalf of the downtown community on traffic and transportation plans and issues. Among these issues are street and sidewalk improvements, increased transit participation, traffic signalization, taxi zones and parking.

The Downtown St. Louis Partnership is a not-for-profit organization representing its members in pursuit of a healthy and vital downtown area. In that role, it also serves as the manager of the Community Improvement District that provides funding to implement services that make downtown clean, safe and inviting.

Weil Gotshal’s Trade Group Obtains Important Victory
Weil, Gotshal & Manges LLP achieved another significant victory on behalf AREVA and its affiliate, Eurodif, that should result in the return of millions of dollars of duties inappropriately collected from Eurodif. Since 2001, the US Government has been collecting estimated countervailing duty cash deposits on every import of low enriched uranium from France. Through several rounds of litigation, Weil Gotshal argued that the US Government's actions are contrary to the statute, which does not cover the purchase of enrichment services involved in the import transactions. On February 9, 2007, the US Court of Appeals for the Federal Circuit sided with Weil Gotshal, dismissing the action and holding that the US Government was required to revoke the countervailing duty order against Eurodif’s imports.

The Weil Gotshal team working on this matter consisted of partner Stuart Rosen, counsel Greg Husisian and associate Andrew Ryu.
