Strasburger Obtains $8.2 Million Jury Verdict for Texas Mutual
Strasburger & Price, LLP, a full-service law firm with in seven offices, obtained a Travis County jury award for client, Texas Mutual Insurance Company for actual damages of $5,077,390 and punitive damages of $2,500,000 against the Defendant, Gary C. Quintinsky. The case was tried in the 419th District Court, Judge Orlinda Naranjo, presiding (Cause No. D-1-GN-06-003093; Texas Mutual Insurance Company v. Gary C. Quintinsky on February 6, 2007.) The verdict is expected to result in a judgment of approximately $8.2 million after adding lawful interest.

Texas Mutual is the State's insurer of last resort for employers who are not able to purchase workers' compensation insurance in the private market. Quintinsky controlled a number of companies--referred to by the parties globally as the United Crane Companies--that purchased workers' compensation insurance from Texas Mutual. The jury found clear and convincing evidence that Quintinsky had conspired with other individuals and companies to defraud Texas Mutual of lawful premium due for workers' compensation insurance. In short, Quintinsky and his co-conspirators lied to Texas Mutual about the insured companies' payroll and operations in an effort to avoid paying lawful premiums due because of the companies' poor claims history.

The conspirators created false financial records and forged Texas Workforce Commission reports in furtherance of the conspiracy. Robert O'Boyle, a litigation partner in the Austin office of Strasburger & Price, LLP represented Texas Mutual. "We are grateful that the ury saw fit to send a warning to any employer who might be tempted to avoid paying lawful premium for workers' compensation insurance. This type of fraud adversely impacts not only honest policyholders and employers who may see a rise in premiums and who pay the lawful premium due but must compete in the marketplace with the unscrupulous employer," said O'Boyle.
