Lee Quoted in The Times-Picayune
Jones Walker partner Andrew Lee was quoted in The Time-Picayune article titled "Credit problems are keeping many musicians out of Musicians Village." The January 2nd article spotlighted musicians that have been turned away from a Habitat for Humanity project that has raised millions in the name of housing New Orleans musicians. Lee, Habitat board vice president, said Habitat is fulfilling "something of a cultural mission" in fundraising with a musician angle. The article also highlighted Lee's work, including forming coalitions, finding resources, helping musicians clean up their credit, and recruiting other lawyers for the effort.

DEA Judge Recommends Doctor's Registration to Grow Marijuana for Medical Research
Jenner & Block Partner Julie M. Carpenter on February 12, 2007 convinced a Drug Enforcement Administration (DEA) Administrative Law Judge to issue a recommendation that Dr. Lyle Craker be granted a DEA registration allowing him to legally grow marijuana at the University of Massachusetts-Amherst to be used by medical researchers.

Prior to this decision, the DEA had long limited its registration to only one federally-contracted grower in the United States, the National Institute on Drug Abuse (NIDA). However, evidence at the hearing established that the medical marijuana the government made available to researchers was not adequate in quality or quantity to meet those researchers' needs.

The ALJ in the case held that Dr. Craker met all necessary qualifications required for registration, that there was not adequate competition in the provision of marijuana for such purposes, as the relevant statute requires, and that there is currently an inadequate supply of marijuana for medical research.

The ALJ's decision is a recommendation to be taken under consideration by the DEA Administrator, who will render a final decision later this Spring.

Partner Paulette Brown Receives American Bar Association's Spirit of Excellence Award and is Nominated for Membership on the Association's Board of Governors
Short Hills, NJ February 13, 2007 Employment attorney Paulette Brown, a Partner in the Litigation Department in the New Jersey office of the 520-attorney national law firm of Edwards Angell Palmer & Dodge, has received the American Bar Association’s prestigious Spirit of Excellence award. She has also been designated for membership on the American Bar Association’s Board of Governors for a three year term beginning August 1, 2007.

Paulette Brown is a Past President of the National Bar Association; President of the YWCA of Central New Jersey; Member of the ABA Commission on Women in the Profession; and Council Member, ABA Section of Litigation. Brown litigates in both federal and state courts, as well as arbitration forums for both unionized and non-union employees. She is a certified mediator for the United States District Court, District of New Jersey.

The Spirit of Excellence Award was established by the ABA Commission of Ethnic & Racial Diversity to celebrate the efforts and accomplishments of lawyers who work to promote a more racially and ethnically diverse legal profession. Awards are presented to lawyers who excel in their professional settings; who personify excellence on the national, state, or local level; and who have demonstrated a commitment to racial and ethnic diversity in the legal profession.

The Board of Governors has the authority to act and speak for the American Bar Association, consistent with previous action of the House of Delegates, when the House is not in session. The Board oversees the general operation of the Association and develops specific plans of action. Brown was nominated to hold the Woman Member-at-Large seat on the Board and will be presented to the House of Delegates for election in August. Once elected, Brown will serve a three-year term on the 37-member board.

A resident of Plainfield, NJ, Brown received her law degree from Seton Hall Law School and her undergraduate degree from Howard University. She is licensed to practice in New Jersey.

White & Case Advises Panamanian Government on Historic Public-Private Partnership Deal
White & Case LLP acted as legal counsel to the Republic of Panama in connection to the proposed redevelopment of the former Howard Air Force Base located adjacent to the Panama Canal. The $700 million project stands out as one of the largest development projects in the world, covering 2,750 acres and generating an estimated 20,000 jobs.

The project, known as the Howard Project, has an estimated 40-year building forecast and incorporates a 1.7 mile airstrip built by the United States, but largely abandoned since US forces pulled out of the country eight years ago. The site is earmarked for a massive new trading hub, known as a "multimodal port" which will take in both the airstrip, access to the canal and build vast depots to store a variety of goods that pass through the canal.

"About 60 percent of the trade in and out of the United States passes through the Panama Canal. When you combine thousands of new homes, hotels, a science park and a golf course, with the proximity to the world's busiest trade canal, you can see why the global investment community is taking note of this project," said H. William Walker, who headed the White & Case team that included Pedro A. Alvarez and Albert Diaz-Silveira. White & Case worked with local Panamanian co-counsel Gabriel González-Ruiz from Icaza, González-Ruiz & Alemán.

London & Regional Properties, a privately owned British developer, has secured the right to build a new "mini-city" on the banks of the Panama Canal. Other interested parties included the Codina Group, from Florida, and Cabi Control, from Mexico. Only Miami-based property firm Easton Group and L&R remained in the final bidding and L&R submitted the successful bid. The Panamanian Cabinet is due to ratify the decision to appoint L&R next week, with completion expected next month. A formal master planning application will be submitted three months later.

"A classic public-private partnership, this project underlines the attractiveness of bringing together public and private interests from across the globe. It will eventually total in the billions of dollars and have a significant impact on neighboring countries and throughout Latin America," added Mr. Walker.

Thompson Coburn LLP Wins Case in U.S. Supreme Court
In a 9-0 decision in Norfolk Southern Railway Company v. Sorrell, the Supreme Court of the United States Wednesday ruled in favor of Thompson Coburn LLP client Norfolk Southern in a case that involved whether the Missouri Supreme Court's mandatory jury instructions accurately state the causation standards for comparative fault under the Federal Employer's Liability Act (FELA).

The Court agreed with Norfolk Southern's position that the Missouri instructions misstate the law, and that the same legal standard applies to railroad negligence as to contributory negligence by employees under FELA, the federal statute governing compensation for on-the-job injuries for railroad employees. The Supreme Court returned the case to Missouri courts for further proceedings.

David Dick, a partner in Thompson Coburn LLP's Railroad Litigation practice, developed the challenge to the Missouri jury instructions and handled the case through the Missouri court system. Supreme Court specialist Carter Phillips of Sidley Austin LLP of Washington, D.C. appeared for oral argument, his 52nd argument before the Supreme Court. David and Jim Erwin, a partner in the Firm's Appellate practice, worked on the briefing throughout the case, and David attended the oral argument at counsel table.

Bradley Wm. Bowen Elected Chair of the UC PAC Committee
Shareholder Bradley Wm. Bowen is the newly elected chair of the Utah CPA Political Action Committee for the Utah Association of Certified Public Accountants (UACPA). This committee represents the interests of its members on various political issues. Mr. Bowen has served on the UACPA Professional Conduct Committee and was chair of the Tax Symposium Task Force.

Mr. Bowen earned a Juris Doctorate degree from the University of Utah in 1987 and has been employed by Strong & Hanni since November 1985. Mr. Bowen earned a Bachelor of Arts degree in Accounting from the University of Utah in 1984, graduating cum laude. In college he was a member of the Beta Alpha Psi, National Accounting Service and Honor Society, and worked as a tax accountant for First Security Bank. The State of Utah licensed Mr. Bowen as a Certified Public Accountant (CPA) in 1985.

Mr. Bowen became a member of the Utah State Bar, and was admitted to practice before the Utah Supreme Court and the United States District Court in 1987. He was admitted to the United States Tax Court in 1991. Mr. Bowen served as President of the Business Law Section of the Utah State Bar from 1994 to1995, and has served as a Bar Examiner, Estates & Wills, from 1992 to present. He has served as an advisor to the Board of Directors for the United Way of Davis County since 1997. Mr. Bowen served on the Board of Directors of the Salt Lake Estate Planning Council in 1999 and 2000, and served on the Utah Association of Certified Public Accountants annual tax symposium committee from 1996 to 2002. Mr. Bowen was selected as the Distinguished Tax Practitioner Of The Year for 2006 by the Tax Section of the Utah State Bar.

Mr. Bowen frequently presents seminars on estate planning, trusts, probate and business planning to the Utah Association of Certified Public Accountants, Utah Society of Public Accountants, International Association of Financial Planners, and other professional and community groups. He is a member of the Salt Lake County Bar Association; Davis County Bar Association; American Institute of Certified Public Accountants; and the Utah Association of Certified Public Accountants. Mr. Bowen is fluent in Spanish.
