Sid Lewis and Laurie Chess to Present Continuing Education Seminar on "Employee Discharge and Documentation"

AKERMAN SENTERFITT'S RICHARD C. MILSTEIN APPOINTED GUARDIAN AD LITEM TO ANNA NICOLE SMITH'S BABY
Akerman Senterfitt shareholder Richard C. Milstein has been appointed guardian ad litem to Dannielynn Hope Marshall Stern, the five-month-old baby of the late Vickie Lynn Marshall, a.k.a. Anna Nicole Smith. Mr. Milstein was appointed by Judge Larry Seidlin of the Broward County Circuit Court. The appointment was made to provide a voice for the deceased's surviving child and to act in the best interest of the child in relevant court proceedings.

Mr. Milstein has been practicing law for more than 30 years and has handled numerous complex and high profile guardianship and probate matters. His practice focuses on Trusts, Estates, Guardianship Litigation and Administration, Family and Marital Law, Alternative Dispute Resolution, as well as Alternative Family Planning, Children's Rights, Elder Law, Probate Law and Same Sex Couple Planning. In his work in family law, he has represented clients of significant means as well as children in disputed relationships, and has performed thousands of hours of pro bono work.

Mr. Milstein has been widely recognized and honored for his work as an attorney, including the Florida Supreme Court Tobias Simon Pro Bono Service Award, American Bar Association's John Minor Wisdom Professional and Public Service Award, and the Florida Bar President’s Pro Bono Service Award For The Eleventh Judicial Circuit. In 1999, the Dade County Bar Association established The Richard C. Milstein Excellence Award, which is now presented each year to a recipient in the areas of professionalism and pro bono.

A certified mediator in the Southern District of Florida and for the State of Florida, Mr. Milstein worked on the first pilot project for dispute resolution through the American Bar Association. He is the only Board Certified Elder Law attorney in Miami-Dade County, and advises clients on all aspects of their life and estate planning for the elderly.

Mr. Milstein is a Miami native and earned his law degree and bachelor's degree from the University of Miami, and his associate's degree from Miami-Dade College. This year he will be inducted into the Miami-Dade College Hall of Fame, in the area of law.

Pera Elected to Serve as At-Large Member of the Board of Directors of the Tennessee Coalition for Open Government
Lucian T. Pera, a member of the Litigation Practice Group, has been elected to serve as an at-large member of the Board of Directors of the Tennessee Coalition for Open Government. The Coalition is a non-profit and non-partisan alliance of media, citizen, and professional groups working to educate Tennesseans about their right to know about the affairs of their government as set out in the state constitution and the state’s “sunshine” and public records laws. It seeks to keep citizens, media and public officials informed about developments and threats to these laws through projects, programs and education.

Pera practices primarily in the civil trial area, including a wide variety of commercial, media, intellectual property and personal injury litigation. He is a member of the Ethics Practice Team and the Commercial Disputes Practice Team. He has represented a number of major media outlets in significant litigation concerning public and media access to public records, open meetings, and court proceedings. These cases include a landmark Tennessee Supreme Court decision granting public and media access to the records of a troubled nonprofit government contractor administering tens of millions of dollars in public money in assistance to low-income mothers. He is an active member of the Media Law Resource Center’s Defense Counsel Section, serving as chair of its ethics committee and as co-author of chapters in two of its national surveys of law relating to the media. He speaks and writes annually on media law issues, both in Tennessee and nationally.

Pera also counsels and represents lawyers, large and small law firms, law departments, and other clients in the area of lawyer ethics, professional responsibility, malpractice and
loss prevention; and he has developed a nationwide practice and reputation in this field. He is a frequent speaker and author on such matters in numerous venues across the country. He served for five years as a member of the American Bar Association’s Special Commission on the Evaluation of the Rules of Professional Conduct, which proposed significant changes that were approved by the ABA in 2002, and which have now been considered by almost all American jurisdictions for adoption. He currently chairs the ABA Section of Business Law’s Committee on Professional Conduct and has chaired the Editorial Board of the ABA/BNA Lawyers’ Manual on Professional Responsibility. Additionally, he has served as chair of the Tennessee Bar Association Standing Committee on Ethics and Professional Responsibility since 2000.

Aside from the leadership roles he has held in various organizations in the areas of media law and lawyer ethics, Pera has also served these organizations in other capacities. Since 1990, with only a three-year break, he has served as a member of the ABA House of Delegates, as well as having served as one of two Young Lawyer Members-at-Large of the ABA Board of Governors from 1994-1997. During his final year on the Board, he became the only young lawyer to ever chair its Finance Committee and served on the ABA Executive Committee. He has also served as the Tennessee Bar Association as its Secretary, a member of its Board of Governors, and as President of its Young Lawyers Division. Pera graduated with honors from Princeton University in 1982, and obtained his Juris Doctorate from Vanderbilt University School of Law in 1985. He is listed in The Best Lawyers in America (First Amendment Law).

Peter G. Verniero - Divisions Deep Over Death Penalty
Peter Verniero, a Member of the Firm, was interviewed for this February 19, 2007 CQ Weekly cover story about the death penalty. According to the article, "'As a practical matter, we [New Jersey] are already operating under the system that the commission has proposed, namely a system in which we have life sentences without parole,' says Peter G. Verniero, a former state Supreme Court justice and Republication attorney general, who thinks his state should drop the death penalty. 'Capital punishment is not something that you should have on the books unless there is a very clear consensus that it is the correct policy.

The Chicago Council on Global Affairs, founded in 1922 as The Chicago Council on Foreign Relations, has been the pre-eminent forum in Chicago and the Midwest for the discussion of world affairs and U.S. foreign policy since its inception. Its roundtables provide a forum for a select group of The Chicago Council’s members to delve into issues associated with a particular nation or world topic. Roundtables meet on a regular basis, often once a month, to consider and discuss one facet related to their topic. The India Roundtable is a pioneering forum geared especially towards those in business, political, civic, and non-profit arenas who wish to commit themselves to active leadership, meaningful programming, and thoughtful dialogue on the issues shaping Indian-U.S. economic and political relations.

Jack Gerstein Featured in National Law Journal Article
RDB partner Jack Gerstein was quoted in the February 19, 2007 issue of The National Law Journal . The article, “’Prepackaged’ bankruptcy shot down by judge,” addresses the recent decision by a federal bankruptcy court judge in favor of RDB’s client.

During the three year case, Mr. Gerstein represented insurers who would have been “left holding the bag” had the insureds been allowed to use a “‘prepackaged’ Chapter 11 reorganization plan.” “The pair of opinions ‘send a message to a small group of lawyers who put together these prepackaged asbestos bankruptcies that they can’t circumvent the law,’” Mr. Gerstein said.

Mary T. Cushing Joins Roetzel & Andress' Cleveland Office
Roetzel & Andress is pleased to announce Mary T. Cushing has joined the Cleveland Office as Of Counsel.

Ms. Cushing focuses her practice on employee benefits law in all aspects of ERISA compliance. She is experienced in the employee benefit aspects of corporate mergers, acquisitions and dispositions, plan terminations; plan-to-plan transfers, mergers and spin-offs; employee-related claims in bankruptcy; and plan design including collective bargaining of employee benefits.
