Richard S. Geiger Receives ICT's Mauk Award
In announcing that Richard Geiger was the 2007 recipient of the prestigious Mauk Award, the Insurance Council of Texas (ICT) released the following announcement:

“Richard S. “Dick” Geiger, general counsel of the law firm of Thompson, Coe, Cousins & Irons, was presented the Raymond Mauk Leadership Award Thursday, July 12 in Austin, at the 15th Annual Mid-Year Property and Casualty Symposium.

Mr. Geiger becomes the tenth recipient of the award.

The Insurance Council of Texas (ICT) presents the Raymond Mauk Leadership Award at its Mid-Year Property and Casualty Insurance Symposium each year. It is the Council’s highest honor and is intended to bestow recognition on those whose labor has made a significant difference in the business of insurance.

Mr. Geiger received his law degree from SMU and was elected to the Texas House of Representatives in 1972 where he served as a delegate to the Texas Constitutional Convention. In 1975, Geiger joined Thompson, Coe and began his 32 years of service to the Texas insurance industry.

Mr. Geiger’s work can be found in legal briefs, written and oral testimony for regulatory and legislative decision makers as well as the laws and plan of operation for the Texas Automobile Insurance Plan Association. His advocacy led to advancements in the residual market, workers’ compensation and general liability.

While serving the industry, Mr. Geiger has also found time to help others in his home town. He is a member of the board of the Dallas Zoological Society, the Texas Legal Protection Plan, Home Health Services and the W.H. Adamson High School Education Foundation. He has also been an active parishioner of the Episcopal Church

In California Supreme Court Victory, Shinoff, Sleeth, Carelli, Morris and Pate Save the Tort Claim Act from Revival Statutes
In a precedent setting decision, the California Supreme Court upheld the stricter time limitations for alleged victims of childhood sexual abuse to file suit against public entities. The reversal of the local Court of Appeal, obtained by attorneys Dan Shinoff, Jack Sleeth, Bill Pate, Jeff Morris and Paul Carelli, all partners with the firm Stutz Artiano Shinoff & Holtz, protects public entities from the so-called “revival” statutes. As the name suggests, the Legislature (under Gray Davis) passed the revival statutes to revive really old claims, which normally would have expired under statutes of limitation. Revival statutes have been the vehicle for the highly publicized clergy abuse claims against the Catholic Diocese. This decision virtually eliminates the ability to bring similar cases against government entities.

Nine SHB Lawyers Named to Best of the Bar
The Kansas City Business Journal’s 2007 “Best of the Bar” supplement has recognized nine Shook, Hardy & Bacon lawyers as “among the most admired and respected lawyers in the Kansas City area.” Honored for their reputations and professional standing were Partners Rob Adams (Tort), Jim Beck (Business Law), Laura Clark Fey (Product Liability Litigation), John Johnston (Tort), Harvey Kaplan (Pharmaceutical & Medical Device Litigation), Bill Martucci (Business Litigation), Madeleine McDonough (Pharmaceutical & Medical Device Litigation), and Pat McLarney (Litigation), and Of Counsel Joel Mosher (Tort). Five hundred Kansas City metropolitan lawyers participated by making nominations for this sixth annual poll, and the final list was vetted by a panel of accomplished area practitioners.

Characterized as “a snapshot of the premier players in Kansas City’s legal community,” the listing included brief statements from each individual selected. Madeleine described her litigation approach as “figuring out whether the problem may also present an unexpected opportunity to improve the client’s business in some way or otherwise advance the client’s greater business goals at the same time.” Pat, who was managing partner in 1998, remembered that SHB opened five new offices in a single year. “I thought at the time that no firm in the world would take that much of a risk in one year,” he said. “It told me a lot about my law firm.”

Several SHB attorneys also expressed gratitude for current and former colleagues who served as pivotal influences in their careers. “I’ve been fortunate to practice alongside some of the most talented attorneys in Kansas City and nationwide throughout my career,” Rob told the Journal. Harvey said of David R. Hardy: “A fine gentleman and a superb advocate, he showed me the value of thorough preparation, and his confidence in me early on served as the inspiration for everything I’ve achieved as a trial lawyer.” In addition, a few nominees not currently affiliated with the firm pointed to SHB lawyers as inspirations and mentors.

Bill has been included on the list for six years; Rob, Harvey and Pat have made the cut for five years; and John has been named three times. This is the second appearance for Jim, Laura, Madeleine, and Joel.

Johnston Elected to Missouri Bar Board of Governors
Kansas City Partner John Johnston (Tort) has been re-elected to a two-year term on The Missouri Bar’s Board of Governors, a 42-member policy-making body that develops and oversees the Bar’s programs and policies. With a membership of approximately 28,000 lawyers, The Missouri Bar acts as an instrument of the state "to improve the legal profession, the administration of justice and the law on behalf of the public." Johnston will represent District 12, the Jackson County portion of Kansas City.

F. Paul Vellano, Jr. elected to Board of Directors of Risk Management Association
F. Paul Vellano, Jr. has been elected to the Board of Directors of the Empire Chapter of the Risk Management Association (RMA). RMA is a not-for profit organization which provides continuous improvement in the principles and practices of commercial lending by banks which is accomplished by lectures, seminars and general informational meetings. Membership is largely made up of banking institutions of all sizes as well as nonbank financial institutions. Mr. Vellano is a member as he provides legal services related to risk management to various financial institutions.

Mr. Vellano is a member of the firm’s Board of Directors and serves as Secretary and Treasurer of the firm. He also manages the Banking Law and Commercial Transactions practice groups. Mr. Vellano’s banking practice includes commercial loan closings, loan documentation and restructuring, property purchase and sale, bank branch formation and general regulatory and compliance issues.

A frequent lecturer before numerous banking groups and the National Business Institute, Mr. Vellano has presented topics including loan and deposit documentation, loan closings and structuring, loan workouts, lender liability planning and collection methods and strategies. He is a co-author of “Enforcing Judgments and Collecting Debts in New York.”

Milling Litigation Team wins partial Summary Judgment on Insurance Coverage in Mesothelioma case.
Tabor v. Anco Insulations, Inc., No. 66,929, 16th Judicial District Court for St. Martin Parish, La. Our client and its insurer cross-moved for summary judgment on boiler and machinery policy coverage. The plaintiffs sued the client alleging that their decedent's exposure to asbestos during machinery repairs in the 1960s caused their decedent's mesothelioma. The client third-partied the insurer alleging that the repairs had been necessitated by covered accidents and breakdowns involving the machinery. The insurer moved for summary judgment on the grounds that the client could not identify any specific accident or breakdown and that notice of the claim was late. We cross-moved for partial summary judgment on liability and were able to show that while we could not identify breakdowns by time and date, they regularly occurred during the plaintiffs' decedent's employment. The court found this evidence sufficient to invoke coverage and held that notice of the plaintiffs' claims five months after the client became aware of them was sufficient. Jim Irvin briefed and argued the cross-motions. He was assisted by team members Mag Bickford, Bill Davis, Philippe Langlois and Jennifer Fiore
