S.D Jury Finds Microsoft For $1.5 Billion
In one of the biggest patent verdicts ever, a federal jury in San Diego found that Microsoft Corp. had infringed Alcatel-Lucent’s patents and should pay the company $1.5 billion in damages. The jury ruled Thursday that Microsoft had infringed two Alcatel-Lucent patents with its Windows Media Player, and it awarded the company $769,028,351 in damages for each patent. Supreme Court Debates Critical Component
The U.S. Supreme Court heard arguments on Wednesday over the extent to which U.S. Patent laws can be applied to software that is sold overseas, in a case that could make U.S. software companies more vulnerable to infringement claims. Erik Puknys of Finnegan Henderson told MIP Week the arguments demonstrate how difficult it is to conceptualize software and how different this type of technology is from the kind of technology that the patent laws have traditionally had to deal with. “I always felt that Microsoft had the better arguments on the ‘supplying’ issue. In other words, the foreign computer manufacturers, not Microsoft, supply the ‘components of a patented invention’ by making copies of Microsoft’s master disc and then installing the software companies on their computers,” he explained.

Exceptional Coverage of Fasken Martineau in LEXPERT
The recent Fasken Martineau/Stringer Saul merger was covered in a feature story published in the February issue of the prestigious magazine LEXPERT. Davis Polk Advises Morgan Stanley on Its Acquisition of a Majority Stake in Montreal Terminal
Davis Polk & Wardwell is advising Morgan Stanley on its acquisition of a majority stake in Montreal Gateway Terminals from TUI AG. Davis Polk is also advising Morgan Stanley in connection with the non-recourse financing for the acquisition and development of the port facilities. Montreal Gateway Terminals is a container-shipping operation that runs two terminals on the St. Lawrence River that handle approximately 90% of all containers that go through the Port of Montreal. TUI is a German shipping and tourism conglomerate.

According to the terms of the transaction, Morgan Stanley will acquire an 80% interest in Montreal Gateway Terminals, while TUI's shipping line, Hapag-Lloyd, will retain a 20% stake in the Montreal facilities. The financial terms of the transaction were not disclosed.

The Davis Polk corporate team includes partners E. Waide Warner Jr. and John H. Butler, associate Julie Chang and legal assistant Alfonso Silva. Partner William H. Weigel and associate Kimberly A. Champlin are providing tax advice. Partner Paul W. Bartel II is providing antitrust advice. Associates Monica Lamb, George Kazakov and Samuel L. Watson are providing credit advice. All members of the Davis Polk team work in the New York office.
