Wiley Rein Preserves Important Victory for American Chemistry Council
Wiley Rein attorneys in the Chemicals, Safety & Environment Group preserved an important victory in the U.S. Court of Appeals for the District of Columbia on behalf of the American Chemistry Council's Methyl Bromide Industry Panel. The Panel is a consortium of all manufacturers who supply the pesticide methyl bromide to the U.S. market. Methyl bromide is a critical fumigant for growers of agricultural commodities and food processors. The ruling preserves an earlier victory for the Panel that allowed the continued production and imports of the pesticide.

Methyl bromide is subject to an international environmental treaty known as the Montreal Protocol. Under the treaty, production and imports of methyl bromide were phased out on a world-wide basis as of 2005, except for certain "critical uses" for agriculture. In late December 2004, the environmental group Natural Resources Defense Council (NRDC) filed suit challenging new regulations issued by the U.S. Environmental Protection Agency to implement the "critical use" program. The Panel intervened on the side of EPA and challenged whether NRDC had standing to bring the suit. In March 2006, the Court dismissed NRDC's challenge on that basis. NRDC sought rehearing. In August 2006, the Court granted rehearing, but sided with EPA and the Panel on the merits, and NRDC's suit was dismissed for a second time. In November 2006, NRDC sought rehearing on this decision. In its ruling earlier this week, the Court denied NRDC's second rehearing request, thus letting its August 2006 decision on the merits stand.

Salans Paris Partner Gérard Delile has been elected president of the French Association of Intellectual Property Lawyers (AAPI) for a term of three years.
Gérard Delile leads Salans' IP/IT/Telecoms practice Group in Paris. He practices in all the different areas of intellectual property law (trademarks, patents, designs, domain names, copyright, unfair competition and trade secrets), both as a litigator and in counseling. He is also active in the fields of media and entertainment, licensing and transfers of technology, press and advertising law, as well as in litigation and arbitration in IP and commercial law.

The AAPI is a national association of IP lawyers with more than one hundred members. Together with the members' associates it brings together more than four hundred Intellectual Property specialists across the country. The AAPI represents the community of IP specialists before French Government Authorities (the Ministry of Justice, the Ministry of Industry, the Ministry of Finance, the French Patent and Trademark Office, etc.), professional bodies (the Paris Bar, the National Council of the Bars), and before the judiciary (Tribunals, Courts of Appeal and Supreme Court).

Perkins Coie Names Tom Lindley Chair of Environment & Natural Resources Practice
Perkins Coie is please to announce that Tom Lindley has been named the new firmwide chair of the firm's Environment & Natural Resources practice. He has been a partner with the firm for more than 10 years.

Lindley has more than 25 years of experience assisting clients on cutting edge environment and natural resource matters, including air, water, and hazardous waste and solid waste permits. He also advises clients on water quality and rights, the Endangered Species Act, enforcement defense, site investigations and remediation, and audits and due diligence. He provides strategic counseling and has extensive litigation and trial experience.

He is leading a team of more than 45 attorneys focused on environmental and natural resource issues. The group has extensive experience, working with businesses, financial institutions, trade associations, nonprofit organizations, government agencies and individuals to address environmental issues throughout the United States and abroad.

Lindley has been an adjunct professor at the Lewis & Clark Northwestern School of Law and the IIT Chicago-Kent College of Law. He received his law degree from Vanderbilt University Law School and his undergraduate degree from the University of Illinois.

Morrison & Foerster Represents China Huiyuan in US$300 million IPO
Morrison & Foerster represented China Huiyuan Juice Group Limited in its US$300 million (HKD 2.4 billion) initial public offering on the Hong Kong Stock Exchange. China Huiyuan (Stock Code: 01886) is a leading fruit and vegetable juice manufacturer in China, holding 42% of the market share for pure-fruit juice beverages.

China Huiyuan is the largest Hong Kong IPO year to date. Trading commences today on 23 February 2007.

Morrison & Foerster also represented the company last year in a series of convertible bonds and share placements that raised an approximate total of US$222.25 million (HKD 1.7 billion). Investors included, among others, Group Danone, Warburg Pincus and Holland Development Bank. Danone, one of the largest dairy food producers in the world will have a 22.18% shareholding in China Huiyuan, which includes US$122 million (HKD 950 million) in new shares acquired at the IPO price. With Danone's new subscription, the total amount raised by the company in the IPO exceeds over US$400 million (HKD 3.1 billion).

The Morrison & Foerster IPO team was led by Hong Kong partners Xiaohu Ma and Ven Tan.

Former General Counsel of Florida Governor Joins Miami Trial Practice
The Florida office of McDermott Will & Emery is pleased to announce the arrival of Raquel "Rocky" Rodriguez as a partner in the Firm's Trial Department. Prior to joining McDermott, Ms. Rodriguez served as general counsel to Florida Governor Jeb Bush. Her practice focuses on commercial, international, constitutional and election litigation, dispute resolution and strategy government ethics advice, inter-governmental relations and economic incentives.

"Rocky is a great addition to our Florida team," commented Ira Coleman, partner-in-charge of the Miami office. "She brings a unique perspective of state government in addition to her expansive portfolio of private practice experience. She will add very important skills to our ever expanding platform here in Florida."

Ms. Rodriguez’s clients have included Fortune 500 companies, foreign government entities and entrepreneurs. She has published articles in numerous legal publications, and she is a frequent speaker and panelist on a wide range of legal topics at seminars and continuing legal education events. She has also been an adjunct professor of law at the University of Miami Law School. Ms. Rodriguez was listed in Florida Trends Legal Elite (government lawyers) in 2005 and 2006. She received the Dade County Bar Association and Eleventh Judicial Circuit “Put Something Back” Exceptional Participation Pro Bono Service Award for representing Cuban refugees at Guantanamo Naval Base in litigation against U.S. Attorney General Janet Reno. In law school, she was a member of the University of Miami Law Review and the Order of the Coif, and she was class valedictorian. She earned her B.A. summa cum laude in politics and public affairs from the University of Miami.

"The experience Rocky brings with her complements our existing Firm-wide trial practice while adding depth to our local Miami litigation group," commented Jeffrey Stone, head of the Firm's Trial Department. "She is a key addition to our expanding trial practice."

In addition to previously being a shareholder at an international law firm in both its Miami and Washington, D.C. offices, Ms. Rodriguez served as executive director of a London-based multinational association of independent law firms. She is admitted to practice in Florida, as well as before the U.S. Supreme Court; U.S. Court of Appeals, Eleventh Circuit; U.S. District Court, Southern District of Florida. Ms. Rodriguez is also qualified as a solicitor in England and Wales. Since 2003, Ms. Rodriguez has been a member of the Florida Bar Judicial Nomination Procedures Committee. She is fluent in Spanish and speaks French.

Bairnco Corporation in Definitive Merger Agreement With Steel Partners II
Debevoise & Plimpton LLP is advising Bairnco Corporation in its definitive merger agreement to be acquired by BZ Acquisition Corp., an affiliate of Steel Partners II, L.P. Under the terms of the agreement, BZ Acquisition will amend its existing tender offer for Bairnco to acquire all of the outstanding common shares of Bairnco at an increased price of $13.50 per share in cash. In addition, all shareholders of record on March 5, 2007 will continue to be entitled to receive the declared first quarter dividend of $0.10 per share, for total cash proceeds of $13.60 per share.
