Greenberg Traurig Ranked #1 in Trademark Litigation.
Companies overwhelmingly choose Greenberg Traurig LLP litigators to represent them when protection of valuable trademarks and brand integrity is at stake according to IP Law360. In the online publication’s survey of the 2006 federal dockets, it found that Greenberg Traurig was involved in 148 trademark litigation cases – more than three times that of its nearest competitor. The publication notes in its article that “Greenberg Traurig, LLP has emerged by a wide margin as the top trademark litigator in the United States in 2006....Greenberg Traurig took on a whopping 148 new cases in 2006, representing a lead of more than 100 cases over the runner-up.”

Terry Clark, co-chair of Greenberg Traurig’s intellectual property practice, said “For today’s corporations, intellectual property can be a source of both major revenue and considerable risk. As infringement and counterfeiting cases have become more common, companies have seen the potential costs involved in protecting their IP rights rise dramatically. Enforcing IP rights against infringement often requires quick and decisive action to secure injunctive relief and experienced advocacy to recover monetary damages. GT provides IP protection and enforcement with both the wide-ranging experience of a boutique and the staff and resources of an international firm.”

In addition to the number one trademark litigation ranking, IP Law360 also ranked Greenberg Traurig number three in the area of patent litigation, as well as number eight for copyright litigation, among the firms that took on the most cases in these areas in 2006.

Respected Securities Litigators Join McKee Nelson LLP
The law firm of McKee Nelson LLP announced today its expansion with the addition of a highly respected, six-partner business litigation practice that focuses on the defense of lawsuits involving complex financial transactions. The litigation defense group adds a new dimension to McKee Nelson’s capital markets transactions practice which, in 2006, advised issuers and underwriters in connection with the sale of over $800 billion in securities – more than any other law firm in the world.

Led by Jeffrey Q. Smith and including Steven G. Brody, Susan F. DiCicco, Scott E. Eckas, Michael M. Gordon, and Jennifer Hurley McGay, McKee Nelson’s new business litigation partners come to the firm from the New York office of King & Spalding. When fully staffed the group will be composed of about 25 lawyers and will increase the number of McKee Nelson lawyers to more than 200.

Reed Auerbach, Managing Partner of McKee Nelson’s New York office and a leader of the firm’s capital markets practice, notes, “A huge portion of the U.S. economy is financed by complex securities transactions. They almost always work as anticipated, but in those rare cases in which a deal goes wrong, the cost to the participants can be enormous. Successfully managing a problem transaction requires experienced litigators who also have a deep understanding of both the capital markets and complex transactions. Our new partners have those unique qualifications.” New partner Jeff Smith adds, “Our practice aligns almost perfectly with McKee Nelson’s existing capital markets transaction practice and its other enforcement practices. We represent the same clients, speak the same language, and focus on similar financial transactions.”

According to Will Nelson, the firm’s Managing Partner, all clients, whether they are working with the new litigation practice or with its transaction practices, will benefit from the addition: “Our new partners will enhance our ability to plan and execute transactions by helping us avoid the mistakes of others. At the same time, he says, “their ability to defend transactions will be enhanced by the technical and real time market knowledge of our transaction lawyers.”

On the subject of possible future acquisitions, Nelson says: “We don’t seek to add lawyers for growth’s sake. However, we are always interested in adding top practices that focus on our financial institutions and Fortune 500 client base and complement our existing capital markets, financial products, tax and enforcement practices.

Osgoode Hall Law School Students win 34th Annual FMC Gale Cup Moot
Fraser Milner Casgrain LLP, one of Canada’s leading business law firms, announced today that a team of law students from Osgoode Hall Law School has won top honours at the 2007 FMC Gale Cup Moot, Canada’s premier bilingual mooting competition held this past weekend at historic Osgoode Hall, the seat of Ontario’s highest court.

The four-member team beat out 18 other Canadian law school teams by arguing their "moot" – or hypothetical case – before a panel of judges from across the country. The moot, which simulates an actual court hearing, was based on Montreal’s infamous R. v. Labaye "swingers’ club case" decision of 2005, in which the Supreme Court of Canada held that a private club in Montreal was not a "common bawdy house," as it did not pose a significant risk of harm to society, and was therefore not promoting indecent criminal conduct.

It was Osgoode Hall’s third time winning the Gale Cup Moot. As the winning team, they now have the opportunity to travel to Kenya in September 2007 to compete in the Commonwealth Mooting Competition.

"Once again, the Gale Cup Moot brought out the best and the brightest students from Canadian law schools who exhibited an exemplary command of legal expertise and courtroom knowledge and procedures," says Chris Pinnington, Managing Partner, FMC Toronto. "The winning team did an outstanding job presenting its case and I commend them and their coaches on their delivery, creativity and flair. Judging from what we saw at this year’s competition, Canadians have a lot to look forward to when these exceptional students are called to the Bar."

Second place went to the team from Queen’s University, followed by University of Toronto in third place and University of Victoria in fourth place.

The prize-winning teams were recognized at the awards banquet on Saturday evening by Master of Ceremonies Senator David P. Smith, P.C., Q.C., Chairman Emeritus, FMC.

Named after former Ontario Chief Justice George A. Gale, the FMC Gale Cup Moot is Canada’s premier bilingual moot competition. The Gale provides a particularly valuable experience for students in that it uses real judges and occurs in a courtroom instead of a mock venue. This year’s panel of finalist judges consisted of Mr. Justice Robert Blair of the Court of Appeal for Ontario, Mr. Justice Marc Beauregard of the Québec Court of Appeal and Mr. Justice Ross Goodwin of the Québec Superior Court.

This marks the 27th year that Frank Bowman, Partner, FMC Toronto, has been involved with the annual moot competition. The company has been a major sponsor of the event since 2000. An adamant supporter of education, FMC currently employs many articling students and many of its partners teach at law schools across Canada.
"The Gale Cup Moot provides a marvelous opportunity for Canada’s prospective lawyers to hone their litigation skills and familiarize themselves with high-level legal proceedings," says Frank Bowman, Partner, FMC Toronto. Crowell & Moring Adds Nine Lawyer Financial Institutions Team In New York
Crowell & Moring LLP has bolstered its New York office through the addition of nine financial services and distressed debt lawyers, including partners William M. O’Connor, Robert G. Frucht, and Evelyn H. Seeler. The team, whose representative institutional and hedge fund clients include Wachovia Bank, Lehman Brothers, UBS, and Silver Point Capital, joins Crowell & Moring’s Corporate and Litigation groups. Crowell & Moring’s New York office will now comprise 29 lawyers after opening just five months ago. The lawyers come from Buchanan Ingersoll & Rooney PC.

Our Corporate Group has served clients on the transactional side for many years, across our U.S. and European offices. Gardiner, Crowell & Moring chairman.

O'Connor, who leads the financial institutions team coming to Crowell & Moring, is a former member of Buchanan’s Board of Directors and managing shareholder of its New York office. He will lead the New York-based creditors’ rights team that represents leading financial institutions in a range of concerns, including litigation, loan workouts, bankruptcies, restructurings, debt portfolio acquisitions, international documentary credits, multinational insolvencies, and Foreign Sovereign Immunity Act cases. The team also includes partners Seeler and Frucht and consists of seasoned transactional and trial lawyers who work to solve the diverse challenges that its financial clients confront—from conducting due diligence in distressed deals for hedge funds to advising on public and private offerings on debt and equity securities.

In addition to the three partners, the team includes four counsel: Douglas R. Arntsen, Timothy J. Fierst, Prassana Mahadeva, and James Maisano. Associates joining the firm include Genelle R. Francis and Jamie Krapf.
