McAngus Goudelock & Courie, LLC is pleased to announce that Steve Benjamin has joined the firm as a member of the Columbia office. His practice emphasizes governmental strategic planning, municipal finance, procurement, and general business matters.

Steve received his Bachelors Degree in political science from the University of South Carolina in 1991, and his J.D. Degree from the University of South Carolina School of Law in 1994. He was appointed Director of the South Carolina Department of Probation, Parole and Pardon Services on March 2, 1999. Steve resigned his Cabinet appointment on September 1, 2001 and served as the Democratic nominee for the Office of South Carolina Attorney General in the General Election of 2002. Prior to accepting his Cabinet appointment, he served as Regional Manager of Public and Government Affairs and as the Manager of Corporate Affairs for two Fortune 500 companies, managing the legislative and public affairs activities in South Carolina, North Carolina, Georgia, and Virginia and the District of Columbia. Steve sits on the Board of the University of South Carolina Development Foundation, the University of South Carolina School of Law Partnership Board, and the Boards of Directors of the South Carolina Chamber of Commerce, the Greater Columbia Chamber of Commerce, and the Columbia Urban League. He is admitted to practice before all state courts in South Carolina, the U.S. District Court, Federal District of South Carolina and the United States Court of Appeals for the Fourth Circuit.

McAngus Goudelock & Courie, LLC Elects Seven New Members
MG&C announced that Chad Abramson, Regan Ankney, Lauren Citrano, Jason Lockhart, Brian O’Keefe, J.D. Smith, and Lou Waple have been elected as members of the firm.

Chad Abramson obtained his undergraduate degree from Clemson University and his Juris Doctorate from the University of South Carolina School of Law. He joined MG&C’s Columbia office in 2000.

Regan Ankney received her undergraduate degree from the University of South Carolina and her Juris Doctorate from the University of South Carolina School of Law. She joined MG&C’s Charleston office in 2001.

Lauren Citrano received her undergraduate degree from Rutgers University and her Juris Doctorate from Wake Forest University School of Law. She joined MG&C’s Charlotte office in 2002.

Jason Lockhart received his undergraduate degree from the University of South Carolina and his Juris Doctorate from the University of South Carolina School of Law. He joined MG&C’s Columbia office in 2002.

Brian O'Keefe received his undergraduate degree from Furman University and his Juris Doctorate from Nova Southeastern University. He joined MG&C’s Charleston office in 2002.

J.D. Smith received his undergraduate degree from the College of Charleston and his Juris Doctorate from Cumberland School of Law of Samford University. He joined MG&C’s Charleston office in 2004.

Lou Waple received his undergraduate degree from the University of North Carolina at Chapel Hill and his Juris Doctorate from Campbell University School of Law. He joined MG&C’s Charlotte office in 2001.

Legal Assistant Honored
For 26 years, the Friends of Yates, Inc., a Kansas City not-for-profit organization dedicated to helping victims of abuse, has recognized black men and women in the Kansas City metropolitan area who have made, and contintinue to make, meaningful contributions in their various fields and endeavors. Included among the 2006 recipients of this award is Joanna Smith, a paralegal in McAnany, Van Cleave & Phillips' Kansas City office.

Joanna is recognized for the authorship of her semi-autobiographical book detailing her experiences with emotional abuse and codependency. The work is viewed as making a significant contribution in understanding these problems and as an aid to stopping the cycle of drug abuse.

The award was presented to Joanna during the Black Men & Women of Distinction Program during Black History month on February 26, 2006.

Mark Lee Elected to Serve as Chair of the Board of Directors for Twin Cities Habitat for Humanity
The law firm of Maslon Edelman Borman & Brand, LLP, is pleased to announce the recent election of Mark Lee as Chair of the Board of Directors for Twin Cities Habitat for Humanity (TCHFH).

Mark Lee is a partner and the head of Maslon's Litigation Practice Group. He represents clients in a wide range of Product Liability and Mass Tort Litigation. Over the past ten years, Lee has contributed more than 300 hours of volunteer work with TCHFH and joined the Board of Directors in 2003, most recently serving as Vice Chair to the Board.

Twin Cities Habitat for Humanity strives to eliminate poverty housing from the Twin Cities area and to make decent, affordable shelter for all people a matter of conscience, relying on volunteer labor and tax deductible contributions of cash, materials, professional services and property to build simple, decent homes with low-incomes families. Working under the principle that no profit should be gained from assisting those in need, Habitat for Humanity charges no interest on the homes that it sells. In operation since 1985, Twin Cities Habitat for Humanity has sold 649 homes in the seven-county metro area.

James Duffy O'Connor Publishes in The Journal of the American College of Construction Lawyers
Jim O'Connor's article "Wrestling with Reform: Indemnification Agreements, The Statutory Bars, Promises to Procure, and Insurance Products for the Construction Industry" was published in the February 2007 edition of The Journal of the American College of Construction Lawyers. The Journal is published by Thomson West and can be ordered from www.west.thomson.com.

"Wrestling With Reform: Indemnification Agreements, The Statutory Bars, Promises to Procure and Insurance Products for the Construction Industry" is a 77-page law review article with over 240 footnote references. The article traces the evolution of judicial models used by the courts to evaluate whether indemnification is legally permitted between Owners, Contractors and Subcontractors. It proposes a clause that conforms, where possible, with the statutory restrictions enacted by 44 states. It analyzes the statutory bars prohibiting or restricting the risk transference device, and proposes an independent promise to procure insurance that accomplishes the intent of the device in all but 3 states. Finally, it discusses the insurance products being offered to the construction industry today to secure the promise of indemnification, including the current Additional Insured controversy.

Coincidentally, the Maslon Construction Group has produced what is called The Maslon National Indemnity Program, a digital interactive web-based product that collects in one place indemnity agreements that correspond with the decisional law and statutory criteria of all the 50 states and the District of Columbia. We offer as a service to our clients to set up a secure website where the clauses are modified to replicate in font and size the contract forms of the client and updated regularly so that they remain current with the changing laws of each of the states. When changes in the law require changes in the language of the clauses, the clients are automatically advised of the change by e-mail. The clauses are available to the client 24-7-365, and may be accessed without the need to involve an attorney. Questions may be posted at the site too and are typically answered within a matter of hours.

Employment group Vice-Chair Alan Zuckerman Receives Defense Verdict in David Martorano M.D. v. The Regents of the University of California et al.
Lewis Brisbois Employment Vice-Chair Alan Zuckerman received a defense verdict in a complex sexual harassment trial involving a resident and his supervisor at UCLA's Neuropsychiatric Institute. The Plaintiff in the suit, Dr. Martorano, a Columbia University educated physician and former psychiatric resident at UCLA's NPI unit, alleged he lost a promotion to the post of chief resident as a result of rumors and subsequent termination of an alleged affair with his supervisor. Dr. Martorano sued both the supervisor and UCLA. The supervisor testified the affair never took place and that the story was strategically contrived by Dr. Martorano in an effort to seduce another psychiatrist in the department. The supervisor countersued for slander and invasion of privacy.

The case received a significant amount of media coverage due to its explicit nature and "TV- drama-like" complexities. In his closing argument, Alan Zuckerman described the nine attributes of narcissistic personality disorder in the Diagnostic and Statistical Manual of Mental Disorders and how they applied to the self perception and actions of Dr. Moratano, leading him to sue his supervisor after an inability to accept she would not admit to an affair. After a day of deliberation, Mr. Zuckerman received a defense verdict on behalf of UCLA.
