Nine Thompson Coe Attorneys Named 2006 Super Lawyers

Franklin Drake elected Mayor Pro Tem of Wake Forest
Attorney Franklin Drake was recently elected Mayor Pro Tem of Wake Forest. He previously served as the Town Commissioner. Mr. Drake is also actively involved in his community's efforts to preserve and restore historic sites and homes.

Mr. Drake has over 27 years of legal experience. He concentrates his practice in the areas of creditors’ rights, creditors’ bankruptcy, and commercial litigation. He has worked with credit unions, banking and financial institutions, consumer and commercial lenders, and student loan agencies to enforce contracts, minimize losses, and fight fraud.

Bettie Kelley Sousa, Partner, will be attending a Women In Law Breakfast with Justice Sandra Day O'Connor on September 22, 2006. Sponsored by the Wake Forest University School of Law, the event will be held at the Graylyn Conference Center and follows a presentation by Justice O'Connor the prior afternoon at Wait Chapel on the Wake Forest campus.

Barkett Authors Piece in ABA E-Discovery Publication
Partner John Barkett (Miami -- Tort) has written an article outlining the new federal rule requirements for the discovery of electronically stored information (ESI). The American Bar Association's Section of Litigation published the article, "The Battle for Bytes and New Rule 26," in a special 2007 publication on e-discovery.

Barkett discusses the recently implemented changes to the rules as well as those unchanged discovery provisions that apply with equal force to ESI. The article includes ten rules for ESI management that will be helpful for clients frequently involved in litigation. According to Barkett, "If you have to start the hunt [for ESI] anew with every new action, you are not organized."

A second sidebar tells a few ESI horror stories, including a summary of the Morgan Stanley case in which a failure to pay meaningful attention to preservation, production and disclosure obligations led to sanctions directly related to liability issues.

Schwartz Quoted in ABA Article on ATLA Name Change
If a shark called itself a kitten fish, I still would not put my goddaughter in to play with it,” Partner Victor Schwartz (Washington, D.C.--Public Policy) was quoted as saying in a recent ABA Journal article about the Association of Trial Lawyers of America, which as of December 11, 2006, officially became the American Association for Justice (AAJ). In “New Name, New Strategies,” AAJ leaders suggested the group will employ more aggressive tactics to “demonize” corporations and politicians tied to big business. Victor added that the AAJ, moving beyond attempts to thwart tort reformers, is looking to “increase their market share, create new markets, especially at the federal level – such as the criminalization of product liability in some circumstances. That would help their civil cases.”

According to the article, the latest name change is the fourth since the group’s inception. “I realize these are very smart and sophisticated people,” Victor concluded. “If the tort reform side sticks to its old playbook, these people could have some success. They’re not just changing their name, they’re changing the definition of the debate.

Barkett, Erickson, Pratt Present at Joint CLE Summit
Partners John Barkett (Miami-Tort), Dave Erickson (KC-Tort), and Tim Pratt (KC-PMDLD) were all featured speakers at the recent ABA Section of Litigation Joint CLE Summit meeting in Snowbird, Utah. Attended by over 180 lawyers from across the country, the annual meeting was co-sponsored by the Environmental Litigation, Product Liability Litigation, and Mass Torts Litigation Committees of the ABA Section of Litigation.

John Barkett provided 1 hour of CLE ethics credit to attendees when he presented a new paper entitled “Refresher Ethics: Conflicts of Interests, Informed Consent and Motions to Disqualify.” Dave Erickson served as panel moderator for a discussion about the overlap and interrelationship between toxic tort litigation with neighbors and investigation and remediation of contamination at industrial sites. The panel discussion was entitled “Environmental Remediation and Toxic Tort Litigation: Keeping the Two Connected.” Tim Pratt provided a one-hour program specially targeted at young lawyers.

Grever, Andreasen Address AWMA Conference
Partner Tom Grever (KC-Tort), chair of the Midwest Section of the Air & Waste Management Association (AWMA), organized this year's successful annual section conference, held January 31, 2007, in Kansas City. The Kansas City conference brought together federal, state and local regulators; company managers; and attorneys from Missouri, Kansas, Iowa, and Arkansas.

Tom provided a welcoming address for the all-day, multi-track event and gave a litigation and regulatory update on New Source Review. Of Counsel Jim Andreasen (KC-Tort) also presented at the conference as part of a panel discussion with Tyson Foods, Inc. and U.S. Environmental Protection Agency representatives on environmental developments affecting the agricultural industry. Jim focused on the regulation of water pollution from concentrated animal feeding operations, based on an article he has written for an upcoming American Bar Association publication.

Panelists from Aquila, Burns and McDonnell, Black & Veatch, SCS Engineers, consulting firms, the Mid-America Regional Council, and environmental agencies addressed a wide array of topics from pollution regulation and litigation, vapor intrusion, environmental and safety management issues, Brownfields, and green initiatives to renewable energy, global warming, and spill-prevention control and countermeasure plans. Mike Carter, manager of health, environment and safety for Bayer HealthCare's Animal Health Division, gave the keynote luncheon address on emergency preparedness and business continuity.

The AWMA is a nonprofit, nonpartisan professional organization that provides training, information and networking opportunities for more than 9,000 environmental professionals in 65 countries.
