Luce Forward Paralegals Patricia Kushner and Susan Mohney Named to List of Top San Diego Paralegals
Patricia Kushner and Susan Mohney, who have both been Paralegals with Luce Forward for over ten years, have been named to The Daily Transcript's list of San Diego's Distinguished Paralegals, published February 14, 2007.

Kushner is a part of the firm's Business / Complex Litigation practice group, managing many facets of highly complex litigation matters, including the preparation of court documents and materials. Mohney supervises the Insurance Litigation practice group's case assistants and paralegals, working on as many as 300 active cases at any given time. She also handles many challenging and complex litigation matters, including large class actions and massive multi-party litigation matters.

Only 20 paralegals including Kushner and Mohney were named by The Daily Transcript as Distinguished Paralegals, from a remarkable group of over 190 nominees. Each nominee was judged on the following criteria: honesty and integrity; professionalism; community outreach; enthusiasm and teamwork; and the "x-factor" - unique characteristics that made them stand out from their peers.

Luce Forward is the only firm with more than one paralegal named to The Daily Transcript's list of Distinguished Paralegals. Kathy Castellano, a paralegal in the firm's Family Wealth and Exempt Organizations Practice Group, was named a semi-finalist by the publication as well.

Skadden Ranked #1 In Bankruptcy Litigation, According to Bankruptcy Law 360
Though a number of firms experienced the fallout from the overall drop in Chapter 11 filings in 2006, Skadden Arps Slate Meagher & Flom LLP was unfazed, leading the field in the number of Chapter 11 representations with 36, according to our survey of the 300
largest U.S. law firms.

Skadden is trailed by DLA Piper, Willkie Farr & Gallagher LLP and Lowenstein Sandler PC, with Weil Gotshal LLP rounding out the top five.

The number of company bankruptcy filings dropped 20% in fiscal year 2006, the fifth straight year a decline was reported, according to statistics released on Feb. 13 by the Administrative Office of the U.S. Courts.

Overall, only 27,333 businesses sought bankruptcy protection for the fiscal year ended Sept. 30, 2006, compared with 34,222 in fiscal year 2005. The number of Chapter 11 cases, meanwhile, fell from 6,637 to 6,003.

What makes these statistics more startling is that there was a huge influx of bankruptcies in the first few weeks of the fiscal year, right before the Bankruptcy Abuse Protection and Consumer Act went into effect on Oct. 17, 2005. Just taking into account the first nine months of 2006, the number of business bankruptcies plunged 46% from the same time period last year.

Tyler Cooper Attorney Judges Mock Trial Competitions
Tyler Cooper attorney Michael G. Caldwell acted as a judge for the Long Island Sound Regional Mock Trial Competition of the American Mock Trial Association on Feb. 18, 2007, at Yale University.

Twenty-five teams of undergraduate students from universities throughout the Northeast competed in the event. The students took part in a three-hour mock trial and were assessed on their performance in standard trial procedures, such as opening and closing arguments, and questioning of witnesses.

Mike will judge a regional mock trial for Connecticut high school students at the Judicial District Courthouse in New London on March 31, 2007. That competition is sponsored by the Connecticut Consortium for Law & Citizenship Education. Approximately 100 high school students from southeastern Connecticut will be judged in the mock trial, with the winners going on to statewide competition.

Mike, a former political science professor at the University of Illinois, frequently acts as a judge for moot court and mock trial competitions among students, from the high school through law school levels. In October 2006, Mike judged an appellate moot court competition at the Quinnipiac University School of Law. In March 2006, he was a judge for the Yale Law School’s Morris Tyler Moot Court Competition, which was named for Morris Tyler, a Yale Law School alumnus and one of the founding partners of Tyler Cooper. Mike is also an alumnus of Yale Law School.

“These competitions provide a valuable service to students,” Mike said. “For those at the high school and college levels, the competitions help develop an interest in the legal profession that might lead to a legal career. For law school students, the events provide training in forensic skills.”

Mike is a litigation associate in Tyler Cooper’s New Haven office. He concentrates his practice in the areas of employment law, commercial litigation, personal injury law and appellate work.

Partner Quoted in Hartford Business Journal
Tyler Cooper partner David J. Wiese was quoted in a recent Hartford Business Journal article about a new trend in banking – payroll cards. Dave, who is Chair of the firm’s Financial Services Group, commented on the growing popularity of payroll cards among some employers as an alternative to direct deposit paychecks.

“They do fill a lot of needs, particularly for an employer that has a decent segment of its employee population as an unbanked population,” Dave stated in the article. Payroll cards can be used for purchases or ATM withdrawals, similar to debit cards. Employers whose workers do not have bank accounts can set up payroll card accounts for these workers through a bank or credit union. The employees get access to their earnings without having to use check-cashing services, which charge high fees.

According to Dave, the trend is more prevalent among companies with 200 to 300 workers. The accounts allow employers to reduce the number of paper checks they issue, thus saving on bank processing fees, printing charges and the cost of replacing lost or stolen checks.

Dave is resident in the firm’s Hartford office. He focuses his practice on the banking and financial services industry, with an emphasis on corporate and regulatory matters. He regularly represents banks and other financial institutions at the senior management and board level on issues related to strategic planning, regulatory compliance and policy development. Dave is also counsel to the Connecticut Bankers Association, the industry organization that represents the interests of banks before the Connecticut General Assembly and state regulatory agencies.

Two from Tyler Cooper Elected to Posts in Banking Association
Two members of the Tyler Cooper staff have been elected as officers of the Bank Compliance Association of Connecticut for 2007. Donna Dunn-Sawicki, who is a paralegal in the firm's Hartford office, has been elected president of the association. Arthur T. Corey, counsel in the Hartford office, has been elected Assistant Vice President/Education.

The Bank Compliance Association is a volunteer organization that provides compliance education to Connecticut financial institutions. The association currently has more than 150 members from banks and companion industries such as credit unions, mortgage brokers and mortgage lenders. Tyler Cooper has frequently provided speakers for the organization in forums that address topics of concern to the financial services industry.

Donna is a paralegal in the firm's Financial Services Department concentrating on matters pertaining to banking. Prior to joining Tyler Cooper, she worked for Citizens Bank, where she was Assistant Vice President of Compliance for Connecticut and was responsible for bankwide compliance for deposit services, small business lending, and the call center. Her background also includes working for the former Bank of New Haven as Assistant Vice President of Compliance and Security.

Art focuses his legal practice on regulatory compliance for financial institutions. He represents financial institutions in areas relating to new product development, regulatory compliance in the deposit and credit areas, and issues relating to bank fraud. Prior to joining Tyler Cooper, Art served as Chief Executive Officer and General Counsel for the Connecticut Credit Union Association.

Tyler Cooper Attorney to Head Regional Planning Commission
Tyler Cooper attorney Charles R. Andres has been elected Chairman of the South Central Regional Planning Commission for 2007. Chuck is Counsel in the firm's New Haven office.

Chuck will head the regional planning commission for an area encompassing 15 municipalities in South Central Connecticut with a population of approximately 550,000. The area includes Bethany, Branford, East Haven, Guilford, Hamden, Madison, Meriden, Milford, New Haven, North Branford, North Haven, Orange, Wallingford, West Haven and Woodbridge

Members of the commission review and update the Regional Plan of Development for South Central Connecticut. They examine land use proposals that impact more than one of the municipalities, particularly proposals that affect the environment, transportation and density. The commission also reviews certain municipal projects that seek state funding for consistency with the regional plan.

Chuck is a litigator who focuses his practice on zoning and land use, municipal law, tax valuation and tax appeals, administrative law, personal injury defense, and public utility and telecommunications matters. He has advised numerous local land use commissions throughout the state. He has also represented land use commissions, private landowners and developers before local land use boards and in state and federal court litigation.

New Attorneys Head New York Office
Tyler Cooper is pleased to announce the opening of its New York City office and that Harvey Sigelbaum and Carl Ginsburg have joined the firm and will lead the new office.

The opening of Tyler Cooper's first out-of-state office expands the firm's market reach and also provides existing clients with resources in the world's business and financial capital. Located at 1790 Broadway, the New York City office handles complex commercial litigation and bankruptcy cases, and provides legal counsel in business transactions.

Harvey Sigelbaum and Carl Ginsburg, who will be resident in our New York office, bring an extraordinary breadth of legal and business talent to our practice. From 1996 to 2006, Mr. Sigelbaum served as president and co-CEO, as well as vice chairman and then executive chairman, of MultiPlan, Inc., one of the country's largest healthcare network organizations. MultiPlan was sold to the Carlyle Group last year. Previously, Mr. Sigelbaum worked for 17 years as president and CEO of Amalgamated Life Insurance Company, a New York-domiciled, "A" rated national insurer which specializes in multi-state employee benefit plans. Prior to that he was president and CEO of Urban Community Insurance Company, a New York domiciled, "A" rated regional auto insurer.

In his new capacity at Tyler Cooper, Mr. Sigelbaum will draw upon decades of experience in the insurance industry on a broad range of issues pertaining to industry growth and strategic planning, with special expertise in healthcare cost containment matters.

Mr. Sigelbaum has been active on a number of boards, including service as chairman of the National Cooperative Bank, a government-initiated, Washington, D.C.-based national bank for cooperatives; and chairman, National Association on Drug Abuse Problems. Other board work included Americas Health Insurance Plans; Council for Affordable Quality Healthcare; Life Insurance Council of New York; New York Urban Coalition; America's Association of Cooperative/Mutual Insurance Societies (International Cooperative & Mutual Insurance Federation); and Overseas Cooperative Development Council.

In addition, Mr. Sigelbaum served on the board of directors of the Overseas Private Investment Corporation (OPIC), a self-sustaining U.S. government agency that provides political risk insurance and financing for U.S. business investing in emerging markets and developing nations around the world. Appointed by President Clinton in 1994, Mr. Sigelbaum was confirmed to this position by the U.S. Senate.

Mr. Sigelbaum has also worked as adjunct associate professor at The College of Insurance. A graduate of the University of Miami and Brooklyn Law School, Mr. Sigelbaum and his wife, Barbara, live in Manhattan. They have four children and (by last count) eight grandchildren.

For 25 years, Carl Ginsburg has reported on and advocated in behalf of injured individuals and groups. As a producer at NBC and subsequently CBS News in the 1980s and 90s he covered courts, government agencies and business. Later, his investigative work took special aim at the healthcare sector. A Carter Center Fellowship in mental health affairs allowed Carl to firmly set his focus on healthcare matters nationwide and his published works have appeared in The Nation magazine and aired on network and cable TV programs. Carl also taught journalism to graduate students at New York University's School of Journalism and at Hunter College. He has lectured in the United States and abroad on methods of investigation, legal harm and the political economy of healthcare.

In the late 1990s, Carl began a collaboration with Howard Pierce, a Tyler Cooper partner, to develop methods of investigating healthcare abuse, with particular emphasis on witness development. In this capacity he has traveled throughout the United States seeking the participation of first-hand observers to abuse and fraud in the healthcare system.

Carl is a graduate of Northeastern University School of Law and Columbia University. He lives in Manhattan with his wife, Helen Demeranville, and son.

For Tyler Cooper, expansion into New York City represents a natural progression, and the addition of Mr. Sigelbaum and Mr. Ginsburg enhances our ability to serve our clients in New York and beyond.
