Trammell Newton and George Manning Named to Georgia Super Lawyers List
Jones Day lawyers Trammell Newton and George Manning have been named to the 2007 list of Georgia Super Lawyers by Law & Politics, publishers of the Rising Stars lists and Atlanta magazine. Both have extensive experience in antitrust law.

An additional seventeen Jones Day lawyers were included on the Super Lawyers list, which recognizes the top attorneys in their respective practice areas, selected by their peers and verified by the attorney-led research staff at Law & Politics. A process that begins early in the year, the list of 2007 Georgia Super Lawyers is based on surveys of more than 23,000 lawyers across the state. Each lawyer was given a score based on the number of votes received and the source of those votes. The goal is to select as Super Lawyers the top 5 percent of Georgia attorneys in more than 60 practice areas.

Law & Politics publishes annual Super Lawyer publications in 29 states.

Firm Obtains Victory in Pro Bono Client Nursing License Investigation
Jenner & Block Associate Bradley A. Areheart recently obtained a victory for a pro bono client accused of practicing professional nursing without a license.

The client, a recent graduate from college with a nursing degree, was notified shortly after he began working at a hospital that he was under investigation by the Board of Nurse Examiners for practicing professional nursing without obtaining the licensing requirements set forth by the State of Texas. The investigation barred the client from working in the nursing field, causing him to lose his job, and also exposed him to possible civil fines and other sanctions that, if imposed, would be permanently inscribed on his record.

Mr. Areheart worked with the client to prepare a formal response to the assigned investigator based on the allegations. After a two-month investigation, no formal disciplinary action was taken, the investigation was closed and the investigative file was “destroyed.”

The client has since obtained the necessary credentials and is pursuing a nursing career.

Spacapan Addresses Use of Consultants in Law Firms
Jenner & Block Partner Lise T. Spacapan discussed some of the benefits law firms can reap by using non-lawyer consultants and experts in a recent Chicago Lawyer trend story that envisioned greater reliance on economists, accountants, professors, scientists and specialized advisors to help on a case.

Ms. Spacapan said she regularly works with a number of non-lawyer experts in her practice representing large pharmaceutical, chemical and other highly scientific and technical manufacturing corporations. For example, if she is handling a mass tort matter, she may enlist a neurologist, immunologist, epidemiologist, and a toxicologist on one case, the article reported.

“I think my favorite part of practicing law, and one of the more challenging parts, is working with real scientific experts to understand what these medical causation issues are and simplifying it so they can be explained to a judge and jury,” she concluded.

Ms. Spacapan said the use of consultants and experts is not just increasing in matters dealing with the scientific field. “It is expanding more and more to the area of damages, engineering, and other areas of expert testimony.”

In addition, Ms. Spacapan highlighted the importance of the 1993 U.S. Supreme Court case, Daubert v. Merrell Dow Pharmaceuticals, Inc., that said federal court judges are to be the “gatekeepers” of the expert testimony presented in their courtrooms. She noted that lawyers may continually challenge on Daubert grounds, which can be critical in complex cases.

Daubert is a “wonderful” rule, Ms. Spacapan told the magazine, because it can help “keep junk science out of the courtroom,” and thereby protect corporate clients from baseless lawsuits.

Holland & Knight Announces New Leadership in Atlanta
Alfred "Al" Adams has been appointed to serve as executive partner of Holland & Knight's Atlanta office. Adams, a litigation partner and member of the firm's national Directors Committee, will oversee the day-to-day management of the Atlanta office and focus on the expansion of its core practices, which include commercial real estate, business litigation, private wealth services, public law and corporate work. In addition, Litigation Partner Susan Housen has been named practice group leader for Holland & Knight's Litigation-Atlanta group. In her new role, she will provide strategic guidance in developing and expanding the firm's litigation practice in Georgia.

"Al is a highly respected litigator who brings proven leadership skills to his new role as executive partner," said Managing Partner Howell Melton. "Susan is a creative and skilled lawyer with extensive litigation experience. I am confident that the firm and our Atlanta office will benefit greatly from their tremendous talent and energy."

Adams will maintain his successful litigation practice, which includes more than 30 years of experience conducting jury and non-jury trials involving commercial law disputes, product liability cases and civil suits, including construction, environmental, joint venture/partnership, toxic tort, class actions, administrative, probate, premises liability and real estate litigation. He also has successfully resolved litigation through alternative dispute resolution in many forums. In addition to his leadership roles within the firm, Adams has held leadership roles in the community, including former board president of Sheltering Arms, a large Atlanta child care provider; board member of the Georgia Justice Project, Inc.; and a founder of the National Asbestos Council.

Housen practices litigation with an emphasis in securities litigation and regulatory matters, employment litigation, complex commercial litigation, and class actions. Her commercial and business practice includes the representation of banks and mortgage companies in contract disputes and litigation arising from the origination of fraudulent loans. Housen currently serves as a member of the City of Atlanta Board of Ethics.

Former Denver City Attorney and Chief of Staff Joins Hogan & Hartson
Hogan & Hartson LLP announced today that former Denver City Attorney and mayoral Chief of Staff Cole Finegan has joined the firm as a partner.

Finegan left his dual positions as Denver's City Attorney and Chief of Staff to Mayor John Hickenlooper on December 1, 2006. Finegan served as City Attorney, beginning October 2003, and simultaneously as City Attorney and Chief of Staff to the Mayor from July 2005 until his resignation.

Finegan's practice at Hogan & Hartson will focus on working locally and nationally with businesses and governmental entities to create and expand public-private partnerships similar to those created in Denver at Stapleton, Cherokee-Gates, and the Denver Union Station development. He also will build upon his past experience in private practice with regulatory law, land use and development law, and legislative and public policy law.

Tom Strickland, managing partner of the firm's Colorado offices, said "Cole Finegan is an outstanding attorney who possesses a rare combination of legal, business, and political judgment. His career reflects great success at the highest levels of government and the private sector and we are thrilled with his decision to join Hogan & Hartson."

During his tenure as City Attorney, Finegan reorganized that office of 100 attorneys for the first time in 20 years, which saved the city over $1 million by cutting outside legal services and expanded the city's capabilities to try its own cases. As Chief of Staff, he led the successful campaign to change Denver's charter to add a Chief Financial Officer and to modernize the city's 100-year old financial services structure.

From 1991 to 1993, Finegan served both as Chief Legal Counsel and Director of Policy and Initiatives for Colorado Governor Roy Romer. During that period, Finegan handled the Governor's legal matters, advised the Governor on judicial appointments, and supervised a policy development staff of 60 persons working on economic, environmental, health care, energy, telecommunications, transportation, and education policy issues.

From 1978 to 1986, Finegan worked in Washington, D.C. as Chief Legislative Assistant, then Chief of Staff to U.S. Representative James R. Jones of Oklahoma. Jones chaired the U.S House of Representatives' Budget Committee from 1981-1985 and chaired the House Ways and Means' Subcommittee on Trade.

Finegan presently serves as Co-Chair of the Downtown Area Plan, the entity created by the Downtown Denver Partnership and the city to present a 20-year plan for the downtown area's future development. Finegan's additional community involvement includes serving on the Metro Denver Chamber of Commerce’s board of directors, the Denver Public Schools Foundation's board of directors, the board of the Colorado I Have A Dream Foundation, and as a member of the Colorado Forum. His past service includes membership on the State Board of Agriculture, the State Board of Colleges, the Auraria Higher Education Center, and the Greater Denver Corporation Board.

Finegan received his law degree from the Georgetown University Law Center in 1986 and his bachelor's degree from the University of Notre Dame in 1978.

Hogan & Hartson Announces the Promotion of Four FDA Regulatory Affairs Specialists
Hogan & Hartson LLP has announced the promotion of four FDA regulatory affairs specialists in the firm’s Washington, D.C. office, effective January 1, 2007. Susan Tiedy-Stevenson has been promoted to senior director of regulatory sciences. Leif E. Olsen and Randy J. Prebula have been promoted to directors of regulatory sciences. Kelliann H. Payne has been promoted to associate in the firm’s food, drug, medical device, and agriculture practice group.

“The firm is very proud of Susan, Leif, Randy, and Kelliann. We commend them on their dedication to Hogan & Hartson and their hard work on behalf of our clients,” said Jonathan S. Kahan, co-director of the firm’s food, drug, medical device, and agriculture practice group.

Tiedy-Stevenson's practice focuses on the development of FDA premarket regulatory strategy, preclinical and clinical study design and premarket submissions for medical devices, diagnostics, biologics, and drug products, as well as good manufacturing practices (GMP) issues related to these products. She has over 18 years of broad-based managerial and hands-on regulatory and quality experience in the biotechnology and medical device industries, having served in positions of vice president and director of regulatory/clinical affairs, quality assurance, and quality control at in vitro diagnostics, medical device, and in vivo diagnostics companies.

Olsen focuses his practice on premarket clearance of medical devices, diagnostics, and biological products, as well as GMP issues related to these products. He has more than 28 years of experience in the medical device and biologics industry. Prior to joining Hogan & Hartson, Olsen was vice president of regulatory affairs and quality assurance for a leading bioscience company. In this position, he was responsible for directing regulatory affairs activities pertaining to government agencies for compliance to local, state, and federal laws, with an emphasis on FDA and U.S. Department of Agriculture matters. He also directed the activities of the Quality Assurance Group to carry out and enforce policies for compliance to current good manufacturing practices and assure the quality of final products.

Prebula's practice focuses primarily on the areas of medical devices, in vitro diagnostic assays, biological products, human cellular and tissue products, retrovirus detection, blood bank testing and donor screening, and quality status review (QSR) issues related to manufacturers, process validation, and manufacturing facilities. Prebula joined Hogan & Hartson in 1998 after having worked in immunoassay and bioassay research and development, parenteral vaccine quality control, in vitro diagnostic quality, regulatory affairs, and manufacturing. Since joining Hogan & Hartson, he has assisted many clients in the preparation of regulatory submissions, including premarket notifications, premarket approval applications, investigational device exemption submissions, investigational new drug applications, and biologics license applications.

Payne's work focuses on issues related to medical devices. Her experience includes the development, regulation, and litigation of medical devices. Prior to joining Hogan & Hartson, Payne was a senior consultant for a well known scientific consulting firm. In this position, her activities included analysis of complex regulatory challenges and regulatory strategy for innovative products, preparation of medical device regulatory submissions, assistance with preclinical and clinical programs, preparation for FDA meetings and Advisory Panels, postmarketing product stewardship, due diligence for investments and acquisitions, and critical review of scientific data and regulatory literature. In addition, Payne was a U.S. correspondent for the Regulatory Affairs Journal (RAJ).
