Paul, Weiss Represents Songwriters and Music Publishers in $130 Million Settlement
Paul, Weiss represented a class of songwriters and music publishers in a $130 million settlement with German media company Bertelsmann AG and certain of its U.S. affiliates. The settlement -- which has been widely reported in the press, including the front page of yesterday's Financial Times -- follows more than four years of litigation involving Bertelsmann's investment in Napster, the music "file sharing" service, which was shut down in July 2001 as a result of copyright infringement litigation in which the firm represented a similar class of plaintiffs. The settlement, which was filed in the Northern District of California on Friday, is subject to court approval. The Paul, Weiss team included partners Lynn Bayard, Peter Felcher, Carey Ramos, Walter Rieman and Ted Wells, associates Allison Cohn, Aaron Delaney, Darren Johnson, Elizabeth Smith and Joanna Summerscales, staff attorney Joseph Samuel and paralegal Eric Rosoff; former Paul, Weiss associates Dawn Barker, Theo Cheng and Daniele Chinea; and former paralegals Cory Bortnicker, Matt Blumenstyk, Randall Carter, Virgil Esguerra, Lauren Mills, Delia Ugwu-Oju and Jorge Velazquez.

Dan Kramer Quoted on Hedge Funds in The Deal
Litigation partner Dan Kramer was quoted in the article, "A Big Fat Mess: When Hedge Funds Fail," which appeared in the August 31 issue of The Deal. The article discusses the risky nature of hedge funds and details the myriad of ways well-known hedge funds have collapsed, ranging from investor redemptions following mediocre performance to blowups, or the sudden loss of assets. Dan noted, "The fact is, investing has risks and bad things can happen. The issue is whether the risks have been misrepresented to investors. When an investor loses money, that doesn't necessarily equate to liability."

Joe Simons Quoted in Article on Recent Federal Trade Commission Report
Litigation partner Joe Simons was quoted in the August 31 Bloomberg News article, "No Antitrust Activities Seen in '06 Gas Price Hikes, FTC Says." The article describes the results of a recent FTC report that declared that gas price increases in the spring and summer of 2006 were not due to any antitrust violations. Joe noted that "the FTC has looked at the same phenomenon, which occurs almost every year, year after year, and they get the same result... it's a waste of taxpayers' money."

Tom Online Announces Completion of Privatization
Paul, Weiss client Tom Online Inc., a Cayman company with shares listed on the Hong Kong Stock Exchange and ADRs listed on the NASDAQ, announced the completion of a going private and delisting transaction that was first announced in March 2007. The privatization of the company by its controlling shareholder TOM Group Limited was structured as a scheme of arrangement under Cayman law and was approved by shareholders of both Tom Group and Tom Online. The transaction was a going private transaction under the U.S. securities laws and involved the filing of a schedule 13E-3 with the SEC. Paul, Weiss advised Tom Online Inc. and its independent board committee on U.S. aspects of the transaction. The Paul, Weiss team included corporate partners Jack Lange and Mark Bergman and associates Daniel Levine, Greg Liu and Patricia Vaz de Almeida.

Merchant & Gould Welcomes New Attorney To Denver Office
Merchant & Gould, an intellectual property law firm, announced Greg Johnson has joined its Denver office as an associate.

Mr. Johnson is a 2006 graduate of the University of the Pacific, McGeorge School of Law in Sacramento, California, and has an undergraduate degree in computer science from Brigham Young University. He was previously with Shemwell Mahamedi in San Jose, California.
