Pittsburgh Intellectual Property Attorney Michael Dever Quoted on Microsoft Patent Ruling
Attorney Michael L. Dever, who chairs Buchanan Ingersoll & Rooney's Intellectual Property Section, was quoted in a February 23, 2007, article by The Associated Press (AP) on the recent $1.52 billion federal jury ruling against Microsoft for patent infringement. The article appeared in leading news publications, including TIME and BusinessWeek, and on Forbes.com.

He was also quoted on the ruling in a February 23, 2007, Dow Jones Newswire article.

The infringing patents, related to mp3 technology, could have far reaching consequences for other technology companies, which "have been relying on the fact that they thought they had critical licenses necessary to practice the technology," Dever told AP.

On the other hand, Alcatel-Lucent "obtained an award for all Windows Media in all systems, so they cannot recover damages twice," he told Dow Jones, noting that having won against Microsoft, Alcatel cannot also sue companies that use Microsoft technology, such as Napster or SanDisk.

New York Litigation Attorney William DeStefano Quoted in Philadelphia Inquirer on Fumo Case
White-Collar Defense attorney William A. DeStefano was quoted in the February 22, 2007, edition of The Philadelphia Inquirer in an article reviewing the 1980 case against state Senator Vincent J. Fumo. DeStefano is a shareholder practicing in the Litigation Section of Buchanan Ingersoll & Rooney's Philadelphia office.

The senator's testimony in the 1980 trial is expected to be closely reviewed by both sides as Fumo's February 6 federal indictment heads for court.

DeStefano, who represented some witnesses called before the grand jury as part of the current indictment, said the senator's successful fight against two previous criminal cases could bode well.

"He's been through this twice before and came out of them both successfully.

New York Litigation Attorney Barry Slotnick Quoted on Winnie the Pooh Victory
Litigation attorney Barry I. Slotnick was quoted in the February 17, 2007, edition of the Los Angeles Times regarding a victory on behalf of the Slesinger family in the long-running litigation over the copyright for Winnie the Pooh.

The victory, which effectively ended Walt Disney Co.'s efforts to take back the Pooh copyright, opens the door for a suit seeking damages and unpaid royalties.

Slotnick told the LA Times, "The court specifically indicated in its order that Disney's claims against the Slesingers were inappropriate and improper. We plan to ask Disney to pay us billions of dollars in compensatory and general damages."

Slotnick, a shareholder in Buchanan Ingersoll & Rooney's New York office, maintained that "the court once again has ruled that Disney's claims against Slesinger are improper. Now that Disney's misguided claims have been dismissed, we can focus on pursuing Slesinger's claims against Disney for damages, trademark and copyright infringement, breach of contract and fraudulently underpaying royalties."

Andrew D. Skale, who led Buchanan's Intellectual Property portion of the case, appeared on the CNBC program "Squawk Box" on February 15 to discuss the case just before the ruling was handed down.

Litigation Attorney Kevin Brobson Quoted on New Pennsylvania Lobbying Law
Harrisburg Litigation attorney P. Kevin Brobson was quoted in the February 16, 2007, edition of the Philadelphia Business Journal in an article about gray areas in Pennsylvania's new Lobbyist Disclosure Act.

Brobson, who is advising Buchanan Ingersoll & Rooney's State Government Relations team on compliance with the new law, said that the biggest change brought by the new law was the addition of procurement to the definition of lobbying.

"It includes efforts to secure contracts, so we now have clients who are considered to be lobbying that never were before," he told the Business Journal. "The biggest questions we are getting are, 'Is what I'm doing considered lobbying, and if so, do I have to report it?'"

"It's a little counterintuitive," Brobson added, "because when we think of lobbying, we think of going to the capitol to argue for or against legislation. The challenge is getting a handle on what all of your people are doing.
