Two Zuckerman Spaeder Partners to Speak at ABA's White Collar Crime National Institute Meeting
Miami partner Steven J. Bronis and Washington, DC/Baltimore partner Paula M. Junghans will speak at the the American Bar Association's 21st Annual White Collar Crime National Institue Meeting in San Diego, CA, March 1st and 2nd.

This year's keynote panels will focus on the role of ethics and corporate compliance in today's business environment.

On March 1st, Paula M. Junghans will speak on criminal tax fraud, reviewing recent developments, current enforcement priorities, and strategies and tactics for defending individuals and entities under criminal tax investigations.

Steven J. Bronis will follow, addressing healthcare fraud and abuse, which continues to be one of the government's top prosecutorial priorities. This panel will analyze the current trends in such prosecutions and where likely future actions may occur.

Frank Brown Named GAHBA Associate Member of the Year
Frank O. Brown, Jr., a litigation partner with Weissman, Nowack, Curry & Wilco, PC was named the Greater Atlanta Home Builders Association's Associate Member of the Year. He received the award at the HBA's annual awards dinner.

The Associate Member of the Year Award recognizes an HBA associate (non-builder) member for accomplishments in service to the industry and association, professional excellence and community involvement and furthering the mission and goals of the association.

"We congratulate Frank on this most deserved honor. The leadership he exhibits through his practice and work in the community is exemplary," said Tonia C. Sellers, managing partner of Weissman, Nowack, Curry & Wilco.

Brown is general counsel to the HBA. He has served on The Housing Institute/Certified Professionals Home Builder program Board of Directors since 2003 and is a HomeAid Atlanta founding board member. He guided the organization on its Partnering Guide and Homeowner Handbook and contracts developed for use by HBA members. Additionally, Brown serves on the Action Fund Committee that oversees all legal actions taken by HBA and authors amicus briefs used by the HBA Government Affairs department.

He represents builders and developers in real estate development and construction disputes and is a registered arbitrator with the American Arbitration Association. Brown is editor of Developments, Weissman, Nowack, Curry & Wilco's newsletter to builders and developers and has authored articles for industry publications. A frequent speaker on builder/developer issues, he is also a guest instructor in the Emory Trial Advocacy Program.

Brown is a member of the Advisory Board of the Atlanta Volunteer Lawyers Foundation, American Arbitration Association, Atlanta Bar Association, Lawyers Club of Atlanta and the State Bar of Georgia.

The Greater Atlanta Home Builders Association is a 4,100 member, not-for-profit trade association affiliated with the Home Builders Association of Georgia and the National Association of Home Builders.

Weissman, Nowack, Curry & Wilco, PC, founded in 1991, is nationally recognized for its extensive real estate, community association and litigation practices.

WWHGD Win Named Among "Top Defense Verdicts of 2006"
Missouri Lawyers Weekly has named one of WWHGD’s trial victories to its list of “Top Defense Verdicts of 2006.” The tragic premises liability and traumatic brain injury case took place in Kansas City, Missouri, in April 2006. Having only been brought into the case three weeks before trial, WWHGD partners Terry Sullivan, Kevin Williams and Al Maxwell waged an uphill battle in their defense of a mall security company, IPC International.

The horrific events began on the evening of November 9, 2003, when 32-year-old Eric Wheaton decided to take his date to the Applebee’s at Blue Ridge Mall in a Kansas City suburb, adjacent to highway I-55. There, they were confronted as they walked toward the restaurant by two teenagers attempting to steal Mr. Wheaton’s car.

One of the teens, Ronald Morris, shot Mr. Wheaton in the head, resulting in the destruction of the frontal lobe of his brain and subsequent permanent brain damage. He was unable to recall anything that happened after the shooting and is trapped in a child’s mind requiring 24/7 care.

The mall security company was sued based on the following allegations: failure to patrol the restaurant area; grouping the two on-duty guards together on other duties away from the shooting (i.e., leaving no one to sweep the area); and lack of training and equipment. Plaintiff’s counsel demanded $40 million, while the victim’s life care plan alone approached $7 million.

Despite the trial judge’s disallowing any history in evidence about Mr. Morris’ prior criminal record, which included numerous prior jailings, institutionalizations and violent crime, WWHGD’s attorneys debunked the plaintiff’s scientific testimony related to foreseeability of the crime in general and deterability of this gunman in specific. The trial court’s decision to prevent the jury from seeing a complete picture of the gunman’s checkered criminal history allowed the plaintiff’s counsel to paint the shooting as an “accidental punk teen shooting.” This erroneous theory was further bolstered by an eye witness who claimed that the gunman looked “surprised” after pulling the trigger.

Interestingly enough, the WWHGD team was able to show that there was no Missouri case law addressing the intent of the shooter as being relevant to these issues. Other states have found such evidence relevant, but the trial court was not persuaded.

Even though hamstrung by the omission of key evidence regarding the gunman’s record, WWHGD’s attorneys were still able to show the jury that a security vehicle with flashing lights and an unarmed security guard would not have deterred this specific criminal.

SCHIFF HARDIN LLP WELCOMES JONATHAN FRIEDLAND AS A PARTNER IN THE CHICAGO OFFICE
Schiff Hardin LLP has added Jonathan Friedland as a partner in its Bankruptcy, Workouts, and Creditors' Rights' Group in the Chicago office, effective March 1, 2007. He joins the firm from Kirkland & Ellis in Chicago, where he was a partner. Earlier in his career, Mr. Friedland was an associate at Schiff Hardin.

Mr. Friedland focuses his practice on restructuring troubled companies. He has extensive experience in guiding companies through a variety of transactional and litigation settings, with an emphasis on out-of-court workouts, chapter 11 proceedings, and representing parties in buy/sell transactions. His litigation experience includes a wide array of business disputes, including, preference, fraudulent conveyance, equitable subordination, substantive consolidation, and chapter 11 plan confirmation issues. Mr. Friedland's practice also includes providing general legal counsel to healthy companies and their principals.

Mr. Friedland, who is Martindale-Hubbell A/V rated, has been repeatedly selected as an "Illinois Super Lawyer" by Law & Politics Magazine. He is a popular speaker and writer on issues related to general corporate and insolvency-specific issues. Mr. Friedland was recently elected to the Board of Directors of the American Bankruptcy Institute, one of the youngest ever elected.

MS&K Partner Adam Levin Receives 2007 CLAY Award
Mitchell Silberberg & Knupp LLP, a leading California law firm that has provided integrated legal and business solutions for nearly 100 years, announced that Adam Levin, a partner in the firm’s Litigation practice, has been selected as a California Lawyer Attorney of the Year (CLAY) award winner by California Lawyer magazine.

“Adam’s selection as a California Lawyer of the Year is well deserved,” said Thomas Lambert, managing partner of Mitchell Silberberg & Knupp. “He is among the most creative and skillful trial lawyers I have seen in action and a major strength to our firm.”

California Lawyer received nearly 200 submissions for the prestigious award. The winners were selected by the publication’s editors for making a significant impact on the law, the profession, an industry, public policy, for a client or for the benefit of the public in 2006 that is expected to have a significant impact on the law.

Levin received his CLAY award for successfully litigating Lyle v. Warner Bros. Television Production before the California Supreme Court, where he obtained a unanimous decision in favor of several writers and the producers of the hit television series "Friends" in a wrongful termination and harassment suit brought by former writers' assistant Amaani Lyle. Lyle, who admitted she had been warned before taking the job that writers could get raucous during the creative process, claimed their discussions went far beyond the scope of the show, including frequent discussions of their personal sexual experiences.

At stake was freedom of speech within the work environment to address potentially offensive topics such as sex, race and religion in the logical course of doing one's job whether writing for a TV sitcom, discussing stories in a newsroom or academic discussion in a university classroom. Named one of Daily Journal Extra's “Top 20 Lawyers Under Age 40 in California” in 2005, Levin has established himself as one of the leading labor and employment lawyers in California.

Levin represents employers in all areas of labor and employment law, including serving as lead counsel in numerous employment discrimination, wrongful termination, trade secret/unfair competition and right of publicity cases, labor arbitrations, National Labor Relations Board hearings and other administrative proceedings with a focus on the motion picture and television; video game; advertising; and broadcast industries.
