Gunnar Nistad joins the firm's Charleston office
McAngus Goudelock & Courie, LLC is pleased to announce that Gunnar Nistad has joined the firm as a member of the Charleston office. He practices civil litigation including medical malpractice, legal malpractice, construction defects, commercial disputes, products liability, and complex litigation.

Gunnar graduated from Dartmouth College with a B.A. in history and obtained his Juris Doctorate from the University of South Carolina School of Law. He is a member of the American Bar Association, the South Carolina Bar Association, the Charleston Bar Association, and the South Carolina Defense Trial Attorneys’ Association. Gunnar is also admitted to practice in the United States District Court in the District of South Carolina and the Unites States Court of Appeals in the Fourth Circuit.

David graduated from the University of South Carolina with a Bachelor of Arts degree in history and received his Juris Doctorate from the USC School of Law. He served as law clerk for the Honorable L. Casey Manning of the Fifth Judicial Circuit. David is a member of the South Carolina Bar Association, the Columbia Homebuilders Association, and the Greater Columbia Association of Realtors.

CBLH Ranks in Survey of Top Patent Firms
Intellectual Property Today released its annual survey of top patent firms and CBLH ranked among them. Between 2005 and 2006, CBLH increased the total number of issued patents by 13.5%.

IP Today, as it is commonly referred to, is a monthly publication that focuses its content on patent, trademark and copyright laws.

Sutherland’s Allegra J. Lawrence-Hardy Honored With Gate City Bar Foundation Award
Sutherland Asbill & Brennan LLP is pleased to announce that Litigation Partner Allegra J. Lawrence-Hardy was recently selected as the recipient of the Gate City Bar Foundation’s 2007 A.T. Walden Outstanding Lawyer Award.

Ms. Lawrence-Hardy was one of four outstanding individuals honored by the Gate City Bar Foundation at its Black History Month program held February 21 at the Atlanta History Center. Established in 1948, the Gate City Bar Association is the oldest African American Bar Association in the State of Georgia. Others receiving awards during the event included the Honorable Robert Benham, former Chief Justice of the Georgia Supreme Court, Atlanta Mayor Shirley Franklin, and U.S. Congressman John Lewis.

Ms. Lawrence-Hardy, a graduate of Spelman College (1993) and Yale Law School (1996), focuses her practice on labor and employment law. She has litigated cases in federal and state courts for Fortune 100 companies, regularly advises employers on compliance with employment laws, and speaks to management, lawyers, and human resources professionals on labor and employment law issues.

Georgia Trend magazine recognized Ms. Lawrence-Hardy, who chairs Sutherland’s Diversity Committee and is a member of the firm’s Hiring Committee, as one of the “40 Under 40” Rising Stars in Georgia in 2003, and has repeatedly named her in its annual listing of the state’s “Legal Elite,” including 2007. The Fulton County Daily Report featured her in its annual “On the Rise” issue in August 2004, and in 2005, Atlanta Woman named her one of “Atlanta’s 25 Power Women to Watch.”

She is a founding member of the Atlanta Legal Diversity Consortium, a past president of the Georgia Association of Black Women Attorneys, a member of the Board of Directors for the Justice Center of Atlanta, and chairs the Georgia Bar’s Women and Minorities in the Profession Committee. She serves on the boards of the Georgia chapter of the Arthritis Foundation and the Atlanta Legal Aid Society, and she is an active member of the Northwest Girl Scout Council.

Schottenstein Zox & Dunn Welcomes Thornton to IP Practice
Schottenstein Zox & Dunn (SZD) is pleased to welcome the addition of Jeremy J. Thornton as Associate to the firm’s Intellectual Property Practice Group.

Thornton joins SZD from Finnegan, Henderson, Farabow, Garrett & Dunner, LLP, in Washington, D.C., and focuses his practice on trademark, unfair competition and domain name matters. He advises clients in the selection and use of trademarks, effective handling of trademark and domain name disputes, and strategic counseling for brand management. Thornton also has experience working for Ulmer & Berne LLP in Cleveland, Ohio.

After receiving his undergraduate degree from Ohio Northern University, Thornton completed his Juris Doctor at the University of Akron School of Law, cum laude.

Pan American Hospital bankruptcy reogranization plan and sale confirmed
South Florida bankruptcy attorneys, Robert C. Charbonneau and Jacquelin Calderin, obtained confirmation on the sale of Pan American Hospital for $34 million in cash and a Chapter 11 bankruptcy reorganization plan which will return 30% on the dollar to unsecured creditors following a highly contested and complex, 3 year Chapter 11 proceeding.

Charbonneau and Calderin represented Pan American Hospital Corporation through Chapter 11 Bankruptcy proceedings which culminated in the negotiation and sale of its assets to Metropolitan Community Health Services, Inc. for approximately $34.0 million cash and $6.0 million in accounts receivable. Metropolitan was the winner of a Bankruptcy Court auction held in November 2006.

Following a long drawn out battle on behalf of Pan American Hospital in Bankruptcy Court which included an attempted plan of reorganization with the goal of returning most of what is owed to the unsecured creditors, Charbonneau and Calderin negotiated the final deal with Metropolitan, and assisted on bankruptcy related matters during the closing.

Kluger Peretz Kaplan & Berlin attorneys, Dale S. Bergman and Karyl A. Argamasilla with assistance from paralegal Marie Chavarri of the firm's business & real estate transaction practice handled the transaction closing. The transaction included both a real estate component in the sale of Pan American’s real estate property and a corporate component in the sale of its other assets.

“The transaction was further complicated by the overlay of Bankruptcy Court protection for Pan American, which included the court-imposed closing deadline of February 8, 2007, and the regulated nature of being a hospital, including employee staffing and license compliance matters,” explained Bergman.

Pan American, a nonprofit hospital founded by Cuban exiles in 1963 to serve other Cuban expatriates, got into financial trouble after acquiring 17 clinics from United Healthcare Insurance Co. for $65 million and agreeing to pay a percentage of the clinics’ proceeds. The hospital filed for bankruptcy protection in March 2004.

Metropolitan Health Community Services Corp, SSM operates eight hospitals in Puerto Rico under the Metropolitano and Pavia Health Management names, plus 10 satellite clinics, pharmacies, labs, and a radiation oncology center. Metropolitan had been looking at the Miami market, and Pan American Hospital in particular, for several years.
