Byron Mason to Co-Chair ABA Mass Torts Committee
Byron K. Mason, a partner at Baker & Daniels LLP, was recently appointed by the Chair of the American Bar Association Section of Litigation to co-chair that section's Mass Torts Committee, a 600-member group of the ABA.

The appointment is a three-year term. During that time, Mason's responsibilities will include leadership of the committee, overseeing the group's eight subcommittees and planning national and regional substantive programs in the area of mass torts for the Section of Litigation, as well as publishing articles.

Mason previously served in a leadership role with the Product Liability Committee of the ABA Section of Litigation. Mason, who joined Baker & Daniels in 1988, practices in litigation, focusing primarily on commercial, products liability and mass tort matters. He represents several Fortune 500 companies.

Mason is actively involved in a number of community activities and has served on numerous for-profit and not-for-profit boards in Indianapolis. He currently serves on the board of trustees at Franklin College and board of directors for the Humane Society of Indianapolis. He graduated from Indiana University and the University of Iowa College of Law.

Robinson & Cole Partners Participate in “Charting Your Legal Future” Program
As part of the annual program "Charting Your Legal Future" for first year law students of color, Robinson & Cole's Alan D. Fox and Kip Dwyer led a panel discussion of other attorneys in New York entitled "Conceptualizing Your Specialty." The program was originally launched in Boston by the The Boston Lawyers Group (program sponsor) and as a result of its great success has expanded to New York and Washington, D.C.

Through the program, which was held on February 12, 2007, the students gain the unique opportunity to meet in small groups with practicing attorneys for an open discussion on important issues such as: Job Searching, The Summer Associate Experience, Mentoring as a Survival Skill, Life as a Lawyer and Living & Practicing Law, and Conceptualizing Your Specialty. The turn-out was impressive; many law students of color from the New York area attended, and took part in the lively panel exchanges.

O'MELVENY & MYERS REPRESENTS ALLYES IN SALE TO FOCUS MEDIA
O'Melveny & Myers LLP represented Allyes Information Technology Company Ltd., the largest Internet advertising agency and provider of Internet advertising technology in China, in its sale to Focus Media Holding Limited (Nasdaq: FMCN), a deal valued near US$300 million in cash and stock.

The multi-office O'Melveny team was led by Shanghai partner Kurt Berney and Hong Kong counsel David Lin, with assistance from Hong Kong associate Lei Jin and Shanghai legal consultant Xiqin Fan. Beijing partners Larry Sussman and Howard Zhang provided tax and corporate advice, respectively. Shanghai counsel Susan Munro, Shanghai associate Maggie Li, and New York counsel Bruce Goldberger also provided advice on the transaction.

Under the terms of the acquisition agreement, Focus Media will pay US$70 million in cash and US$155 million in stock at the first closing, which is expected to take place before the end of March 2007. Allyes shareholders will also receive an additional payment of up to US$75 million in Focus Media stock if Allyes meets certain earnings targets during the 12 months from April to March 2008.

This acquisition will enable Focus Media to enter China's growing Internet advertising market.

O'MELVENY & MYERS REPRESENTS MINDRAY MEDICAL INTERNATIONAL IN SECONDARY OFFERING OF AMERICAN DEPOSITARY SHARES
O'Melveny & Myers LLP recently represented Mindray Medical International Limited, a leading developer, manufacturer, and marketer of medical devices in China, and certain selling shareholders in a US$277 million secondary offering of 11,301,303 American Depositary Shares (ADSs) of Mindray at US$24.50 per ADS, including the exercise in full by the underwriters of their option.

Goldman Sachs (Asia) L.L.C., J.P. Morgan Securities Inc., and UBS AG acted as the joint bookrunners for the offering. The underwriters have a 30-day option to purchase up to an additional 1,474,083 ADSs from the selling shareholders in this offering.

The O'Melveny team was led by Newport Beach counsel Scott Graziano and included Shanghai partner Kurt Berney and Hong Kong paralegal Edward Yee. Beijing partner Larry Sussman advised on tax matters.

O'Melveny previously represented Mindray in its US$270 million initial public offering.

Finnegan Henderson Client HDI Wins Summary Judgment in Blood Glucose Monitor Case
following a three-year battle between Roche and Finnegan Henderson client Home Diagnostics (HDI), Judge Larry J. McKinney, Chief Judge of the U.S. District Court for the Southern District of Indiana, granted summary judgment of noninfringement in favor of HDI, concluding that no reasonable juror could find that HDI products infringed Roche's U.S. Patent No. 5,366,609 relating to blood glucose monitors. Phase I of the case was concluded successfully for HDI in 2005, when the court ruled following a bench trial that Roche's other patent-in-suit (U.S. Patent No. Re 36,268) had been obtained by inequitable conduct and is unenforceable.

HDI is the largest co-brander of blood glucose products for diabetics, joining with retailers like Walgreens and CVS to sell a product for diabetics that is a high quality, low-cost alternative to the products offered by HDI's competitors.

Trademark Watchdog Gets Bitten
NameProtect Inc. filed suit against competitor Brandimensions Inc. on November 13. The two companies offer trademark clearance and brand protection services. When Brandimensions announced in October that it was launching a new company called BrandProtect, NameProtect got defensive. “The problem that NameProtect faces is that it selected a very weak name as a mark,” says Julia Anne Matheson of Finnegan Henderson. “With all due respect to them, [NameProtect] went the easy route and instead of picking a more distinctive name they’d have to spend a lot of money in marketing to explain, they picked an easy one. The scope of what they’re entitled to is narrow.
