Douglas G. Wah and J. Scott Wood to Join National Litigation Firm Foley & Mansfield
The national litigation firm of Foley & Mansfield announces today that Douglas G. Wah and J. Scott Wood, shareholders in the Emeryville, CA firm of Bishop Barry Howe Haney & Ryder will become partners of the firm effective April 1, 2007. Mr. Wah is a nationally recognized trial lawyer handling mass tort/environmental claims and Mr. Wood handles construction defect claims on behalf of developers, builders and contractors. Foley & Mansfield’s San Francisco office in Walnut Creek will be relocated to 1111 Broadway, 10th Floor, Oakland, CA 94607 in the Oakland City Center.

KEVIN KUHN JOINS WTK
Kevin J. Kuhn has joined Wheeler Trigg Kennedy as a partner where he will focus his practice in the areas of professional liability, product liability and commercial litigation. A former name partner at Montgomery Little Soran Murray & Kuhn, Mr. Kuhn is a trial attorney with extensive experience in the defense of medical malpractice lawsuits and other professional liability matters. In addition, he handles the defense of personal injury matters and product liability cases. Mr. Kuhn has tried over 60 jury trials and over 50 bench trials.

Kaye Scholer Represents The Port Authority in Successful Petition for Review in the D.C. Circuit
The D.C. Circuit (Judges Brown and Tatel and Senior Judge Edwards) unanimously granted in part the Petition for Review of our client The Port Authority of New York and New Jersey. In February 2005, one domestic airline and 12 foreign airlines using the International Terminal B at Newark Liberty International Airport sued the Port Authority before the U.S. Department of Transportation, challenging new fees the Port Authority had imposed on them for their use of that terminal. DOT upheld nearly all of the challenged fee, and both the Port Authority and the airlines filed petitions for review in the D.C. Circuit. In the Port Authority's petition, we argued that DOT erred in permitting foreign airlines to participate in the proceeding, which we contended was contrary to the statutory language, and in disallowing two small costs from the Port Authority's rate base. In their petition, the airlines sought to set aside essentially all aspects of DOT's decision. In a detailed 42-page opinion, the Court granted the Port Authority's petition for review, holding that DOT erred in permitting the foreign carriers to participate and that DOT did not justify its exclusion of one of the two costs from the rate base. It also rejected the airlines' petition for review in all respects. Partner Jeffery Tomasevich (Washington, DC, Litigation) argued the case. Partner Steven Rosenthal (Washington, DC, Litigation) led the trial team that consisted of Mr. Tomasevich and Counsel Douglas Tucker (Washington, DC, Litigation); and Partner David Bickart (Washington, DC, Litigation) assisted on the appellate briefs. This success is also attributable to strong partnership with, and contributions of, Port Authority in-house counsel Carlene McIntyre and Arnold Kolikoff throughout the DOT trial and D.C. Circuit appeal.

Hunton & Williams Represents Banco Santander in Second Significant Acquisition of Assets from Bank of America.
"Hunton & Williams LLP in Miami today announced that it represented Banco Santander Central Hispano (“Banco Santander”), the leading financial group in Spain and Latin America, the largest bank in the Euro Zone, and one of the 12 largest banks in the world by market capitalization, in a second acquisition of assets from Bank of America. This second acquisition, which involved the transfer of private banking and premiere banking accounts totaling approximately $5 billion, was larger than the acquisition completed between Banco Santander and Bank of America in October 2006, in which Hunton & Williams also served as counsel for the Spanish financial group. This second acquisition also had a more expansive reach, involving the transfer of relationships in Europe and Asia as well as Latin America. The two acquisitions, which together implicated approximately $9 billion in assets, have been widely reported in European news sources this week as evidence of Santander’s growing influence as a provider of global private banking services.

Already a major private banking player in Europe and Latin America, Banco Santander reports that this second acquisition from Bank of America will increase the total assets under the management of Santander’s private banking division, Santander Private Banking, to approximately $39 billion. Santander Private Banking currently operates from Miami as well as from New York, Houston, San Diego, Los Angeles, Nassau, Madrid, Geneva and London.

“This transaction represents the third significant transaction in which Hunton & Williams has represented the interests of Banco Santander in strategic acquisitions which have not only strengthened the bank’s position in Latin American banking but also positioned the Bank to continue to grow its influence in the global private banking sector,” commented Fernando C. Alonso, lead attorney on the transaction and a partner at Hunton & Williams and Chair of the firm’s Latin America Practice Group.

Bank of America, N.A. and Banc of America Investment Services, Inc. were represented by Cleary Gottlieb Steen & Hamilton LLP.

The Hunton & Williams team consisted of partner Alonso and Miami associates Fradyn Suarez and Uriel Mendieta. Hunton & Williams in Miami has been involved in a number of significant banking-related mergers & acquisitions in recent years. Apart from the Santander transactions, another significant M&A transaction closed by Miami attorneys of Hunton & Williams during the past year involved the representation of Panama’s Grupo Banistmo, the largest financial services group in Central America, in a $1.77 billion sale to HSBC."

Townsend Associate Michael Drapkin Named One of Denver's "Forty Under 40"
Michael Drapkin was named to the Denver Business Journal’s annual “Forty under 40,” a select group of Denver’s top young professionals honored for their business achievements and contributions to the community. He will be featured in the March 2 issue of the weekly newspaper and honored at a special event in Denver on March 16.

Drapkin serves on the advisory board for the Silicon Flatirons Technology Program, a regional think-tank of leaders in business and government that present important symposia and papers on economic development in Colorado.

As a member of the Colorado Nanotechnology Taskforce, he helped to create a "nanotech roadmap" to help Colorado develop the industry as a statewide economic engine. He also helped the Colorado Venture Capital Association plan a major forum on intellectual property scheduled for the spring of 2007.
