Hochuli Keynote Speaker at ACTL & ICSC
Edward G. Hochuli, a partner with Jones, Skelton & Hochuli, P.L.C., will be the keynote speaker at the American College of Trial Lawyers (ACTL) Spring Meeting and the International Council of Shopping Centers (ICSC) Southwest Idea Exchange.

The ACTL Spring Meeting will be held March 8-11, 2007 at the La Quinta Resort and Club in La Quinta, CA. Hochuli's presentation, "Is This Pop Warner or the SuperBowl," will be held on March 9. The ICSC Southwest Idea Exchange will be held March 14-15, 2007 at the Phoenix Convention Center in Phoenix, AZ. Hochuli's presentation will be held on Thursday, March 14.

Hochuli concentrates his practice on legal malpractice and professional liability, extra-contractual defense, transportation defense, products liability, premise liability, and personal injury defense. He is a member of the Federation of Defense and Corporate Counsel, the USLAW Network, and an advocate member of the American Board of Trial Advocates. He is also a Director of the Trucking Industry Defense Association. In his free time, Mr. Hochuli moonlights as a Referee in the National Football League.

D.C.-Shanghai Team Obtains Unanimous U.S. Supreme Court Victory for Chinese Client
A team of lawyers located in Jones Day's Washington, D.C. and Shanghai Offices obtained a 9-0 victory in the U.S. Supreme Court on behalf of our client Sinochem International Co., Ltd., in an important dispute involving the jurisdictional rules that apply in U.S. federal courts. In Sinochem Int'l Co., Ltd. v. Malaysia International Shipping Corp., No. 06-102, writing for the unanimous Court, Justice Ginsburg held that "a district court has discretion to respond at once to a defendant’s forum non conveniens plea, and need not take up first any other threshold objection."

The Supreme Court's holding reversed the Third Circuit's ruling, which required that the district court first conclusively establish personal jurisdiction over Sinochem before granting Sinochem's motion to dismiss a suit on the ground of forum non conveniens. The Court went on to observe that "[t]his is a textbook case for immediate forum non conveniens dismissal," and that "[j]udicial economy is disserved by continuing litigation in the Eastern District of Pennsylvania." This victory for Sinochem may also have important consequences in future cases brought in U.S. courts against non-U.S. companies having little or no connection to the United States, because the non-U.S. companies will now able to seek prompt dismissals on forum non conveniensgrounds without first requiring the federal courts to make a conclusive inquiry into jurisdiction, which in many cases can be costly and prolonged.

Employment Law 360 Profiles Firm’s Labor and Employment Practice
Jenner & Block’s Labor and Employment Practice was recently featured in an Employment Law 360 profile on the practice’s unique approach and how it draws upon many of the Firm’s practices to serve its corporate clients.

“Our organization doesn’t quite match the way other groups are organized,” Jenner & Block Partner Carla J. Rozycki told Employment Law 360. “Depending on the demands of a particular case, we can handle a variety of aspects by assigning litigation attorneys whose expertise best fits the demand of the particular case,” she said. Ms. Rozycki serves as Co-Chair of the Labor and Employment Practice along with Partner, David K. Haase.

The article cited Jenner & Block’s representation of General Dynamics in a lawsuit in which the defense contractor was accused by a class of younger workers of violating the Age Discrimination in Employment Act of 1967. At issue in the case was a collective bargaining agreement with a union, which eliminated the company’s obligation to provide retirement health benefits to current workers, except those at least 50 years old. The Firm represented General Dynamics from the district court through later appellate proceeding, leading to an argument before the U.S. Supreme Court in 2004. At each stage, the article noted that the Firm marshaled resources and attorneys from a variety of its practices.

Eventually, the Supreme Court ruled in favor of General Dynamics. “In respect to federal age discrimination claims, the Court said there’s no such thing as reverse discrimination,” Ms. Rozycki said about the precedent setting case. “There’s nothing unlawful about discriminating in favor of an older worker, and therefore against a younger worker, relatively,” she added.

In addition, the Employment Law 360 article also discussed trends the Firm’s Practice sees on the horizon for the labor and employment industry. “One of the trends that we’ve seen and that will continue is the increased early use of alternate dispute resolution, mediation to resolve claims,” Ms. Rozycki said. For instance, Ms. Rozycki told Employment Law 360 that the firm successfully mediated over 40 race discrimination case settlements over a six-month period for one client, which helped set a precedent for future cases.

J&C Welcomes Katherine Battiste, Michele Dearing and Mackenzie McNaughton
Jackson & Campbell is pleased to welcome Katherine A. Battiste, Michele L. Dearing and Mackenzie P. McNaughton to the firm as Associates. Ms. Battiste has joined the Real Property & Asset Management and General Litigation Practice Groups. She focuses her practice on real estate and general commercial matters. Before joining J&C, Ms. Battiste worked as a litigation consultant and was an Associate at Jordan, Coyne & Savits. She earned her J.D. from Thomas M. Cooley Law School in Michigan.

Ms. Dearing is a member of the Liability Insurance Coverage Practice Group. Her experience includes civil litigation, including insurance coverage disputes, insurance bad faith matters, employment law, and insurance defense. Prior to J&C, Ms. Dearing served as law clerk to the Honorable Delores R. Boyd in the U.S. District Court for the Middle District of Alabama. She earned her J.D. from the University of Miami School of Law.

Ms. McNaughton is a member of the Business and Real Property & Asset Management Practice Groups. She focuses her practice on federal and state taxation issues, as well as counseling clients on a wide array of business and corporate law issues. Before J&C, Ms. McNaughton was an associate at Smolen Plevy. She earned her J.D. from Chicago-Kent College of Law and LL.M. in Taxation from Georgetown University Law Center.

Arent Fox Announces Tom Gustafson as Senior Health Policy Advisor
Arent Fox LLP announced today that Thomas A. Gustafson, PhD, will join the firm’s health care group in April, 2007 as senior health policy advisor.*

The firm welcomes Dr. Gustafson from a distinguished 30-year career at the Department of Health and Human Services (HHS). Most recently, he served as acting director of the Center for Medicare Management (CMM), which coordinates the fee-for-service portion of the Medicare program and sets payment rates for more than a million providers.

Dr. Gustafson joined HHS in 1976 as an economist concentrating on welfare and retirement issues. He moved to the Health Care Financing Administration in 1985, where he held several executive posts responsible for Medicare and Medicaid legislation, research and demonstrations, strategic planning and regulations. He led the development and implementation of hospital acute care outpatient and inpatient reimbursement systems, and he overhauled procedures for the regulations affecting Medicare’s managed care programs. In 2003, Dr. Gustafson became deputy director of CMM, where he supervised the development of coding and payment policies affecting approximately $300 billion in Medicare spending on hospitals, physicians, nursing facilities, home health agencies and other providers.

Dr. Gustafson received his doctorate in economics from Yale University and his bachelor’s degree from Williams College.
