T&K Attorney Publishes Article on Debate About Courts' Role in Arbitration
Arbitration has often been considered the preferred alternative to traditional litigation. However, attorneys and their clients are becoming more critical of arbitration, thus causing concern about the level of court involvement in arbitration review, according to Thompson & Knight Partner Scott P. Stolley. Stolley's article "Circuits Grapple with Courts' Role in Arbitration" was published in the February 19, 2007 issue of The National Law Journal.

According to the article, as complaints have surfaced about the increased cost and time spent on arbitrations and the quality of arbitration decisions, parties to arbitration contracts are proposing the need for some kind of check on arbitrariness, such as contract language expanding the scope of judicial review. Questions about the implementation of such language under the Federal Arbitration Act ("FAA") have resulted in a circuit split among the U.S. Courts of Appeals.

"Ultimately, either Congress or the Supreme Court will have to resolve this policy debate," says Stolley. "Until the FAA is amended, or the circuit split is resolved, the controversy surrounding the enforceability of contractually expanded review could create a growing reluctance to agree to arbitration clauses."

Stolley is a Partner in the Trial Practice Group of Thompson & Knight's Dallas office. He focuses his practice on the representation of appellants and appellees in state and federal appellate courts, including evaluation of appeals, drafting briefs, and arguing to appellate courts. In addition, he consults and assists on dispositive, significant, and post-trial motions in trial courts and provides trial support on appellate-related issues, such as preservation of error and preparing and objecting to the jury charge. Stolley is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization.

DLA Piper appoints leading marine insurance partner
LA Piper is pleased to announce the appointment of marine insurance specialist David McKie, who will join as a partner to further strengthen the Litigation and Arbitration Group's growing shipping team. David was a partner at niche insurance and re-insurance firm, Elborne Mitchell, where he had worked for 13 years.

David specialises in liability, energy, hull and cargo insurance, shipping and international trade dispute resolution, in arbitration, litigation and mediation. He is regularly retained by a wide variety of leading insurers, charterers, port authorities, classification societies, ship-owners and traders.

DLA Piper's UK marine team handles all aspects of contentious and non-contentious marine and transportation-related work. It forms part of a global team of shipping and offshore specialists covering all of the main international maritime centres.

Julian Stait, EMEA head of DLA Piper's Litigation and Arbitration Group commented: "David's appointment represents a further significant addition to our London marine team and his practice complements perfectly that of the existing growing partner team. His arrival at this stage in the development of DLA Piper's global shipping practice is particularly opportune, co-inciding with the launch of our EMEA Shipping and Offshore sector initiative, designed, amongst other things, to utilise fully the benefits to our clients in this sector of our extensive resources and geographical spread. I am thrilled that he has decided to join us."

Mike Pollen, who leads the London Marine team commented: "David's recruitment is part of a continuing and concerted campaign to grow the firm's marine capability both in the UK and overseas. His arrival is hot on the heels of the promotion to partner of Matt Illingworth, who joined the team from Inces 2 years ago, and the recruitment last year of Jae Park from Richards Butler".

David McKie commented: "I am delighted to be joining the highly-respected marine team at DLA Piper. I look forward to being able to provide clients with an excellent, comprehensive and competitive service in these areas which DLA Piper are very keen to grow.
