Gilbert Schroeder To Serve as Program Co-Chair of Fidelity & Surety Seminar
Clausen Miller Partner, Gilbert Schroeder, will serve as a program co-chair to the ABA's Fidelity & Surety Law Committee's seminar called Loan Loss Coverage Under Financial Institution Bonds. The program is intended for all professionals involved in the handling of loan loss claims, including insurance company claims representatives and underwriters, banking professionals, attorneys for both claimants and insurers, and consultants.

MBA UNVEILS THE LAWYERS ECO-CHALLENGE
Switch to energy efficient office equipment, shut down computers at the end of the day and turn off lights when walking out of rooms. That’s the message from Massachusetts Bar Association President David W. White Jr., who today unveils a yearlong initiative that urges lawyers to change the way they think and act while conducting business in order to conserve energy and resources.

The Lawyers Eco-Challenge - One Planet, One Voice – begins at a time when concern over global warming and for the future of the environment and is at an all time high. Gov. Deval Patrick declared 2007 “The Year of Energy Efficiency,” and has supported the use of renewable energy and asked state agencies to help reduce greenhouse gas emissions by cutting their electricity consumption. The challenge also comes on the heels of a Sun MicroSystems survey that says 73 percent of workers want their employers to be green. The MBA hopes its comprehensive program will spur similar proposals in other business sectors.

“Lawyers in Massachusetts will prove to be at the forefront of this important issue,” said White, a partner at Breakstone, White & Gluck, PC in Boston. “We are asking people to begin by changing a few habits. It will make a difference.”

White is taking his own advice and has already made changes at his 2 Center Plaza office. Motion detector lights have been installed in the conference room and library, the refrigerator has been replaced with an Energy Star certified appliance, nonessential office equipment has been hooked up to switches that are easily turned off at the end of the day, and all light bulbs are now energy-efficient. All equipment upgrades will be Energy Star compliant.

“It’s easy to turn these words into meaningful action,” said White, who in his hometown, founded the non-profit Westwood Land Trust, Inc. and has chaired the town’s Organization for the Preservation of the Environment and Nature.

The Energy and Environmental Task Force, which is chaired by Nancy Reiner, a lawyer in the international law firm Brown Rudnick, which is based in Boston, will be comprised of a dozen attorneys from throughout the state. The task force will be developing “Green Guidelines” for law firms to be published later this fall. Other task force members include John Tener, a partner at Robinson & Cole LLP in Boston and a Newton resident; and Susan Crane, who lives and practices in Sudbury.

“Lawyers will be leaders in the fight against global warming,” said Reiner, a Lexington resident. “That fight starts in the office and at home, with a commitment to reduce energy usage and to recycle to the greatest extent possible.”

In total, lawyers across the United States go through 24 million trees annually. That’s because each year the average lawyer uses a ton of paper, the equivalent of 24 trees, according to Lawyers Accountable To The Earth, or LATTE, a group formed by task force member and Boston lawyer Jeffrey Glassman.

The task force will also be forging coalitions with business groups and environmental groups throughout the state.
The Eco-Challenge contest will begin in January, challenging lawyers and law firms to demonstrate reductions in energy use. In addition, tips will be posted on the MBA Web site (www.massbar.org) regularly and distributed to members through the MBA’s weekly electronic newsletter, Lawyers e-Journal.

“It’s important for the MBA, as the non-profit legal association with a mission to support the legal community and the larger community, to lead attorneys across the state in this important effort,” said MBA Executive Director Marilyn J. Wellington.

Denise Davis Joins Baker Botts as Special Counsel in Austin Office
Denise Davis, who has advised a number of the state's leading lawmakers on legal issues dealing with parliamentary law and procedure, has joined Baker Botts L.L.P. as special counsel in the firm's government relations practice. She will be based in Austin.

Davis most recently served as Parliamentarian and Special Counsel to the Texas House of Representatives. She has 14 years of legal experience in the Texas House, the Texas Senate, and the Supreme Court of Texas. She has also served as general counsel for Lt. Governor William Ratliff and as director and counsel to the Texas Judicial Council under then Chief Justice of the Texas Supreme Court Tom Phillips. Phillips is now a partner at Baker Botts working out of the firm's Austin office.

"Denise brings to our firm an extensive and unique knowledge of Texas parliamentary procedure and the legislative process through her experience working in state government," said Walt Smith, Managing Partner of Baker Botts. "As we continue to build our government relations practice, Denise will provide the type of quality insight into the inner workings of state government that our clients expect from Baker Botts lawyers."

Davis' practice at Baker Botts will focus mainly on legislative policy and procedure.

"The legal process surrounding local and state government issues can often be challenging," Davis said. "But as with any complex matter, fully understanding the issues and the people involved in them often provides a clear course of action needed to resolve the matter. Having worked extensively in all branches of state government for some 14 years has given me the knowledge and experience necessary to guide our clients through these types of issues that require careful review and management."

Davis earned her undergraduate and law degrees from the University of Texas. While attending law school, she served on the editorial board of the American Journal of Criminal Law. Davis also served as a public information officer for Lt. Governor William P. Hobby before obtaining her law degree.

Davis has received numerous honors for her leadership and work in the community, including being named a "Top 40 under 40" by Emerge Magazine. She currently serves as the Regional Parliamentarian for Jack and Jill of America, Incorporated, and is a member of Town and Gown, the Dyslexia Research Foundation, the KLRU Advisory Board, and Links.

New Associates in the Chicago Office

Five Top Orlando Attorneys Join Fisher & Phillips
Fisher & Phillips LLP announces that five of Florida's most respected labor and employment attorneys have joined the Firm's Orlando office effective September 1, 2007. DBMS Partner, J. Kent Mathewson, recently quoted in the Chicago Tribune.
DBMS Partner, J. Kent Mathewson was quoted in a front-page article in the Chicago Tribune Business Section. The article by Ameet Sachdev titled “Ryan jury not first to have problems” discussed the seriousness of jury misconduct and how appellate judges are confronting issues of jury wrongdoing. The article referenced a recent case in which Mr. Mathewson was the defense attorney and the entire jury was dismissed for misconduct by Judge Richard Posner. Mr. Mathewson said “…he has never had a case in his 25 years of private practice where the entire jury was dismissed. The jury issues were of significant concern as evidenced by what Judge Posner did of his own initiative.” In the end, Judge Posner ruled in favor of Mr. Mathewson and his client, and in his opinion discussed the discharge of the jury.
