Successful Defense of Hospital and Emergency Physicians
Lowis & Gellen partner Brian Levin successfully defended Sherman Hospital and its emergency department physicians in a recent trial. The case was brought on behalf of a 58-year old woman with multiple co-morbid conditions. Plaintiff’s counsel claimed the emergency room physicians, on two separate visits, failed to diagnose Coumadin toxicity (a condition that hampers the blood's ability to clot when a bleed occurs) and failed to reverse the potentially fatal condition in a timely manner. When an acute, but not active, brain hemorrhage was detected, Vitamin K (which reverses Coumadin toxicity) was given and the patient was transferred to the care of a neurosurgeon at another hospital. The bleed healed without surgery, and the patient was placed back on Coumadin. She experienced a series of subsequent bleeds, and died more than five months later, due to an infection contracted from a central IV line. Plaintiff’s counsel asked the jury for $4.9 million in closing arguments. The jury returned a defense verdict for the hospital in under three hours.

The firm's real estate land use and zoning practice in Southern California was singled out by a client as being 'the absolute leader in its field.'

King & Spalding Represents Underwriter Credit Suisse in $83 Million Common Stock Offering
King & Spalding, a leading international law firm, advised client Credit Suisse Securities (USA) LLC in its role as sole underwriter of Life Time Fitness, Inc.’s 1.5 million-share common stock offering.

The offering raised $83.1 million in gross proceeds. Net proceeds will be used to partially pay down Life Time Fitness’s revolving credit facility. The transaction closed August 29, 2007.

The King & Spalding legal team involved in the transaction was led by partner Tracy Kimmel of the New York office.

Kelley Drye's Insurance Recovery Group Builds Chicago Presence
Kelley Drye & Warren announced today that Marla H. Kanemitsu, a Senior Litigation Associate with its Insurance Recovery Group, has moved to the firm’s Chicago office.

“Marla has tremendous experience representing individual and corporate policyholders in high-stakes insurance coverage disputes. We are confident that she will continue to serve as a valuable resource to Kelley Drye’s Fortune 500 clients, particularly those in the Chicago area,” said John Heintz, Chair of the Washington, D.C.-based Insurance Recovery Group. “While our practice always has been national in scope, we are excited by the opportunity to expand our physical presence beyond Washington and New York.”

Ms. Kanemitsu recently served as counsel in a four-month bench trial involving non-products coverage for asbestos-related bodily injuries. It was the first such case resolved favorably against the insurers after a full trial on the merits. She also was counsel in a multi-million dollar jury trial against an insurance broker accused of negligence, and represented a policyholder in litigation valued at over $400 million in a successful appeal to the Third Circuit Court of Appeals. Subsequently, she helped defeat the petition for certiorari filed with the U.S. Supreme Court.

In addition to insurance recovery, Ms. Kanemitsu’s litigation experience includes class action prosecution and defense, white collar criminal defense, and international trade matters. She earned her J.D. from Cornell University Law School in 2000 and joined Kelley Drye & Warren in 2007.

Katten’s National Trusts and Estates Practice Named Finalist for STEP Private Client Awards
Katten Muchin Rosenman LLP is pleased to announce that its National Trusts and Estates Practice has been named among three finalists by the Society of Trusts and Estates Practitioners (STEP) for its annual STEP Private Client Awards. The Firm was nominated in the North America Private Client Team category of the awards, presented each year by the prestigious, London-based international trusts and estates organization. The winners will be announced at a black-tie awards ceremony on September 13 in London.

The STEP Private Client Awards highlight excellence among private client solicitors and attorneys, accountants, barristers, bankers and trust managers. Those who service the industry, such as publishers and investment managers, are also recognized for their contributions to the profession.

New JW Partner: Sue Snyde
Jackson Walker is proud to welcome Sue Snyder as a partner in the Business Transactions section in the Austin office. Ms. Snyder comes to the firm from Advanced Micro Devices, where she served for over ten years as the Vice President of International Policy and Relations.

Ms. Snyder's areas of expertise include corporate, environmental, and international law and government relations. She has experience with international regulatory and licensing issues, establishing international public/private partnerships, handling import/export and antitrust issues in Europe, and negotiating incentives for facility construction. She previously worked as a private practice attorney at Vinson & Elkins, where her practice was concentrated on environmental, health, and safety matters, including complex administrative, enforcement, and permitting actions. Ms. Snyder earned her B.S. degree in Civil and Environmental Engineering, with distinction, from Cornell University. She received her J.D. degree, with honors, from the University of Texas, where she was Order of the Coif and Associate Editor of the Texas Law Review.
