Salzman Named an “Up and Coming Lawyer” by Missouri Lawyers Weekly
Stinson Morrison Hecker LLP Partner Matt Salzman was named as an “Up and Coming Lawyer” by Missouri Lawyers Weekly. He is one of 35 attorneys selected to this 10th annual issue who “stand out for their dedication to learning, teaching, and improving their communities.”

The publication received a record number of nominations, which were sought from the readers of Missouri Lawyers Weekly as well as the paper’s newsroom. Honorees were selected because they “dedicate themselves to a vocation, not merely a job, and believe being a lawyer means more than winning a big verdict or writing a killer contract.”

From an early age, Salzman, a partner in the business litigation division, has been involved in significant cases. He found himself, at the age of 34, as lead defense counsel in two nationwide securities class action and derivative lawsuits. He successfully defended the directors of a public company in these two lawsuits that arose from an attempted management buy-out and sale of the company. Salzman found it to be a humbling experience that his clients, very distinguished directors, had faith in him to defend them and, to some extent, placed their personal fortunes in his hands.

Within the firm, Salzman serves as a member of the firm’s client development committee. His civic interests center around Kansas City’s downtown development and children’s issues. He was selected to participate in the Civic Council’s Kansas City Tomorrow Program and in the KC Chamber of Commerce’s Centurions Leadership Training Program. Both of these programs are dedicated to training the emerging business and civic leaders in Kansas City. Salzman also was named one of Ingram’s "40 Under 40."

Rumberger, Kirk & Caldwell Partner Wins Important Case for Retail Auto Dealer Industry
Rumberger, Kirk & Caldwell Partner Joshua Lerner won a landmark decision for King Motor of Deerfield, a result that will have significant and positive impact on the retail automobile industry, both in Florida and nationwide.

On August 31, 2007, the Honorable Victor Tobin, Chief Judge of the Circuit Court of the Seventeenth Judicial Circuit in Broward County, entered summary judgment in favor of Rumberger, Kirk & Caldwell’s client King Motor of Deerfield, on a consumer’s claim for violation of the federal Truth in Lending Act (TILA) and Florida Motor Vehicle Retail Sales Financing Act.

The court held the auto dealer did not violate TILA when it sold a vehicle to the plaintiff, allowed her to drive away in it and then required that she return the vehicle when no third party lender would approve financing of the deal. The plaintiff had alleged the bailment agreement, commonly referred to as a “sign-and-drive agreement,” that allowed her to take immediate possession of the vehicle before her financing was approved negated the disclosures regarding the credit arrangement that are required by TILA. Mr. Lerner argued that the sale was conditional, pending approval of financing by a third-party lender, but the Truth in Lending disclosures were not illusory because the only deal the consumer was bound to was the one contained in the contract. Because the plaintiff was unable to secure financing, the sales contract was null and void.

This was a case of first impression in Florida. Prior to the decision in favor of Rumberger, Kirk & Caldwell’s client, no Florida state or federal court had previously been presented with the question. A federal district court in Ohio had ruled on a similar case, but not identical facts, that the practice does violate TILA.

RDB and ACLU Seek Injunctive Relief for Muslim Woman Forced to Remove Headcovering
RDB attorneys, along with the ACLU, filed a complaint seeking injunctive relief this week in federal court in Santa Ana against Orange County and certain of its supervisory employees on behalf of a Muslim woman who was forced to remove her religious headcovering when booked into the Orange County jail on a misdemeanor charge. Several male jail employees, detainees and men from our client's mosque who came to court to assist our client saw her without her headcovering, which is a serious breach of her faith and resulted in intense distress and humiliation to our client. Although the jail’s rationale was that the headscarf posed a safety concern, other female detainees were allowed to wear items of clothing (such as fishnet stockings) that would appear to pose the same concern. Further, the federal prison system has a written policy allowing female inmates in the federal system to wear religious headcoverings.

Becki Kieffer, one of the RDB attorneys working on the case, was featured on KFI-AM radio in a discussion about the case.

Nixon Peabody LLP Expands Intellectual Property Practice in Chicago; Georgia C. Evans, Patent Attorney, Joins Chicago Office
Ms. Evans is an experienced attorney who provides counsel on prosecution cases primarily in the fields of biotechnology and chemistry. She has prosecuted applications involving novel compositions, drug delivery systems, diagnostic assays, molecular techniques and processes, transgenic organisms, pharmaceutical and industrial compounds and compositions, glasses, and glass ceramics. Additionally, Ms. Evans has extensive experience in patent interferences, licensing, and other transactional matters, client counseling matters, and patent litigation.

“Georgia is well-versed in providing counsel to our clients involved with patent interferences, licensing, and transactional issues,” said Richard D. Rochford, leader of Nixon Peabody’s national Technology and Intellectual Property practice group. “Her knowledge and understanding of patent issues will be particularly beneficial to our clients in Chicago and nationwide.”

Stephen Rudisill, managing partner of Nixon Peabody’s Chicago office, added, “Georgia is an important part of our strategy to grow our intellectual property practice in Chicago. We’re looking forward to getting her involved right away with a variety of new client work.”

Ms. Evans is originally from Rochester, New York. She earned her J.D., cum laude, from the University at Buffalo School of Law, where she was the note and comment editor of the Buffalo Law Review, and received her B.A. in chemistry from Binghamton University. She is a member of the American Bar Association and the American Intellectual Property Law Association.

McKenna Long & Aldridge LLP has advised Career Sports & Entertainment, Inc. on the acquisition of JM Associates, Inc., a leading producer of outdoor television programs for ESPN, including The Fishin’ Hole, which is second only to Sportscenter as the longest running series on ESPN. The transaction closed August 24.

McKenna Long & Aldridge attorneys Ann-Marie McGaughey and Clayton Coley advised Career Sports on the acquisition.

Rhonda Melton, Ginger Schones Named Litigation Paralegals
McAfee & Taft has named Rhonda Melton and Ginger Schones litigation paralegals.

Rhonda Melton serves as a paralegal for the firm's intellectual property practice group and is responsible for case management, preparing and filing pleadings, discovery support and analysis, exhibit preparation, trial preparation, and assisting attorneys at trial in disputes involving patents, trademarks, copyrights and other areas of intellectual property law.

Prior to transitioning to her current role, Rhonda spent the last 10 years working in the firm’s labor and employment practice group as a secretary/assistant.

Rhonda graduated magna cum laude with a bachelor's degree in organizational leadership from Southern Nazarene University and is volunteer for Children of Promise - Mentors of Hope partnered with Big Brothers Big Sisters.

Ginger Schones provides litigation support for attorneys engaged in the representation of clients in complex commercial litigation, business disputes, products liability litigation, ERISA litigation, insurance litigation, administrative proceedings, and arbitrations and mediations. Her responsibilities include preparing and filing pleadings, reviewing and organizing documents, and preparing for trial. She began her legal career in 1990 and most recently worked as a legal secretary for McAfee & Taft for four years.

Stephen Hood Joins Firm as a Partner in São Paulo
Leading international law firm Mayer Brown today announced it is expanding its geographic presence in Latin America and is in the process of establishing an office in São Paulo, Brazil. Stephen Hood, a lawyer with extensive international experience, particularly in the Brazilian legal community, will become a Partner of the firm and will run the office.

"Our expansion into Latin America represents another significant step forward in our global growth plans," said James D. Holzhauer, chairman of Mayer Brown. "We have actively represented clients in Brazil and throughout Latin America for more than 15 years but have done it from afar."

Holzhauer noted that Brazil is one of the world's fastest-growing financial markets and a country that continues to experience a surge in IPOs, infrastructure financing and cross-border acquisitions. Foreign investment in Brazilian businesses and real estate continues to be brisk. He added, "Mr. Hood is a tremendously well-respected and experienced lawyer with established legal and business relationships in Brazil that will immediately benefit our clients."

As to office growth, Holzhauer said the firm expects to add approximately a dozen lawyers in São Paulo over the next 18 months, complementing the 40 Latin American practice group lawyers who will continue to work from other Mayer Brown offices around the world. It is expected that lawyers in the São Paulo office will focus on foreign investment, debt and equity capital markets, structured finance, corporate transactions, infrastructure, trade and project finance. Lawyers will practice U.S. and English law only, and will continue close working relationships already established with major Brazilian law firms.

Commented Vice Chairman Paul Maher, "It is rewarding to be taking another step toward achieving our goals by establishing a long-term presence in São Paulo. Latin America, in particular, is a market of clear strategic importance to our clients' interests."

Mr. Hood joins Mayer Brown from Clifford Chance, where, since 1978, he was an equity partner. During that time, Mr. Hood served on the management committee as well as serving as Managing Partner of the Hong Kong office, the New York City office and, since 1999, the São Paulo office. Additionally, he was head of Clifford Chance's International Capital Markets group in London from 1986 to 1992.
