Partners Steve Moore and James Nealon Quoted in The Connecticut Law Tribune Regarding USPTO's New Continuation Rules
Partners Steve Moore and James Nealon are quoted in The Connecticut Law Tribune regarding Kelley Drye's representation of an independent inventor in a lawsuit against the USPTO. In the article titled "Inventor Calls Rules Patently Absurd," Mr. Moore explains that the USPTO's new continuation rules would make it cost prohibitive for many small individual inventors and small companies to pursue patents. On behalf of client Triantafyllos Tafas, Mr. Moore states that the new continuation rules will keep the power in the hands of large corporations forcing small companies and individual inventors to spend increased amounts of money to apply for patent applications. Mr. Nealon explains that the new rules will force inventors to apply for a large number of patents at the outset in order to cover all the likely permutations of an invention. This cost of applying for numerous patents will be harmful to businesses and individuals.

Norton, Lewis of Fox Rothschild to Present at Patent Seminar in Taiwan
Gerard P. Norton and M. Michael Lewis of Fox Rothschild LLP, will present at an intellectual property seminar to be held at the National Tsing Hua University in Hsinchu, Taiwan, on September 11, 2007. The symposium will bring together approximately 100 attendees, including several patent department heads, from a variety of companies.

Norton and Lewis will present, “Barriers to Entry: The U.S. Patent Landscape for Foreign Businesses.” The program will give an overview of patents, court expectations, licensing, ITC rules, and also will discuss the new prosecution rules, including those aspects relating to patentably indistinct claims, continuing applications, and provisional applications.

Dr. Norton is chair of Fox’s Intellectual Property Practice and co-chair of the Pharmaceutical & Biotechnology Practice. Norton is a Registered Patent Attorney with extensive experience litigating complex matters pertaining to patents, trademarks, copyright, trade secrets, and breach of contract. Dr. Norton also provides skilled knowledge to manufacturers and developers in the fields of pharmaceutical, biotechnology, chemical, and medical device arts. Norton has a Ph.D. in Biomedical Sciences from Mount Sinai School of Medicine and was a post doctoral fellow at Merck, Inc.

Lewis, an associate in Fox’s Intellectual Property Practice, has extensive experience in the preparation of patent applications, especially in the field of telecommunications, computers, software, and medical devices. In addition to providing clients with skilled patent prosecution, he has also participated in several complex patent litigation matters. Lewis is also a Registered Patent Attorney with the United States Patent & Trademark Office.

Dickinson Wright Adds Two IP Attorneys in Washington, D.C
Dickinson Wright PLLC has added intellectual property attorneys William E. Beaumont and Suzanne E. Ziska, Ph.D. in Washington, D.C. Both join Dickinson Wright from the Washington, D.C. office of Minneapolis-based intellectual property law firm Merchant & Gould.

Beaumont has extensive experience in patent application drafting and prosecution in all areas of chemistry, pharmaceutics and biotechnology, such as the synthesis of drugs and complex natural products, preparation and uses of carbon nanoparticles as catalysts and transistors, preparation of medicinal formulations having improved bioavailabilities, and genetic modifications of both animals and plants. He has a sub-specialty in plant genetic engineering with expertise in cross-protection techniques and phytoremediation of contaminated soils. He also has significant experience in PCT (patent cooperation treaty) practice and portfolio management, as well as patent infringement and validity analyses involving numerous technologies.

Beaumont was a partner at the Washington law firms of Oblon, Spivak and Lowe Hauptman & Berner before joining Merchant & Gould. He holds a B.S. degree in chemistry from Muskingum College and a M.S. degree in physical organic chemistry from the University of South Florida, as well as a J.D. degree from Franklin Pierce Law Center and an LL.M. degree in patent law and trade regulation from George Washington University. He is a member of the American Bar Association and the American Intellectual Property Law Association.

Ziska specializes in patent portfolio management for biotech companies, life sciences companies, universities and research organizations. Her experience includes drafting and prosecuting patent applications related to the areas of biotechnology, genetic engineering of eukaryotic and prokaryotic organisms, immunology, genetically modified plants, vaccines, diagnostics, gene therapy, and cancer detection and treatments, as well as experience in due diligence matters and freedom to operate analyses.

Previously, Ziska served as a primary patent examiner at the U.S. Patent and Trademark Office in its biotechnology group, and as a senior staff fellow at the National Cancer Institute at the National Institutes of Health, where she conducted cancer research. She holds a B.A. degree in biology from Bucknell University, a Ph.D. degree in biology from Georgetown University and a J.D. degree from the Catholic University of America Columbus School of Law. She is a member of the American Bar Association, intellectual property and litigation sections; the American Association for the Advancement of Science; and the American Intellectual Property Law Association.

Dickinson Wright's IP practice is the largest among full-service law firms in Michigan. The firm is also one of the only law firms nationally with its own "IP Academy," where practicing attorneys train law students with technical and engineering school undergraduate degrees to become intellectual property lawyers.

Thomas Brady is a member of Clark Hill PLC and co-leader of the firm’s Labor and Employment Practice Group. For more than 25 years, Brady has advised employers in avoiding liability under various federal and state civil rights and employment laws. He has drafted policies and procedures for employers, including policies on handling violent individuals in the workplace.

Stephanie Clifford is a senior attorney with Clark Hill’s Labor and Employment Practice Group. She focuses her practice on employment litigation involving state and federal claims of harassment, retaliation, sex, race, national origin, religious and disability discrimination. Clifford helps employers create and revise employment handbooks and policies. In addition, she advises employers on employee security and privacy issues, drug testing, EEO compliance and other employment laws.

Paul, Weiss Advises SL Green Realty Corp. in Joint Venture Acquisition of Meadows Office Complex
An affiliate of our client SL Green Realty Corp., in a joint venture with Onyx Equities, LLC, closed the acquisition of a controlling 50 percent equity interest in Meadows Office, L.L.C., owner of the Meadows Office Complex in Rutherford, NJ, from an affiliate of Invesco Real Estate. The transaction valued the property at approximately $115 million. Financing for the transaction was provided by Anglo Irish Bank Corporation plc in the form of a first-lien mortgage loan. The Paul, Weiss effort was spearheaded by real estate partner Peter Fisch and associate Josh Babbitt, with assistance from partner Steve Simkin, counsel William O'Brien, associate Erica Loye; paralegals Sophia Luu and Brooke Spiegel; and former summer associate Lindsey Copeland.
