Eric and Rachael Browndorf to run the New York City Marathon - for a cause
Cooper Levenson partner Eric Browndorf and daughter Rachael, 16, will run the New York City marathon - the largest marathon race in the world - to support care as opposed to a cure. The pair will run as members of Team Continuum, a charity devoted to raising funds for the care of cancer patients.

The New York City marathon, scheduled for Nov. 4, is a 26.2-mile race course that winds over five bridges and through all five boroughs of the city. A reported 37,866 finishers ran the race in 2006, with more than two million spectators lining the route. “It was amazing. So many people…everyone cheering…and all the music – just everywhere,” said Rachael of her experience as her dad’s cheering section in past New York City marathons. “And it’s in New York, my favorite place in the whole world. So when my dad asked me to run with him, I wanted to do it.”

Rachael is gearing up for the race by following the program her dad recommended. She runs what she calls “easy, three to four miles on the weekdays.” Her Sunday route, though, is more challenging – now at 12 miles and scheduled to increase by two miles every other week until race day.

The New York City marathon received more than 98,000 applications for this year’s race. When Eric Browndorf was not chosen as a participant through the marathon’s lottery process, he encouraged Rachael to join him and run as a Team Continuum member. “I will only support charities that allocate 100 percent of the funds raised to their cause. It’s just my personal philosophy,” said Eric Browndorf. “This charity does that. Every penny goes to the care. Not the cure. The care. The cure is, of course, important too. But someone else does that. This is about the care. It is about caring for the immediate, daily needs of those who have cancer – mostly kids who have cancer,” he added.

The Browndorfs have set a goal of raising $50,000 for Team Continuum. They will kick off their fundraising campaign with a teen party at Stumpo’s in Somers Point on Oct. 7. Admission is open to 14 to 18 year olds with school ID. Online pre-registration is $7. Onsite admission is $10. Teens will be encouraged to sell raffle tickets for various vacation, sports memorabilia, and other prizes that have been donated, mostly through Cooper Levenson attorneys and the firm’s clients. The teen who raises the most money for Team Continuum will win a Superbowl weekend, complete with tickets, airfare, and accommodations for two.

OMM Assists District of Columbia in Seeking High Court Review of Gun Control Decision
O'Melveny was co-counsel in filing a certiorari petition in the U.S. Supreme Court seeking review of a D.C. Circuit decision striking down the District's handgun ban under the Second Amendment. Read the petition.

The decision marks the first time in U.S. history that a federal appellate court has invoked the Second Amendment to strike down a gun control law. The petition urges the Supreme Court to grant review and decide that the Second Amendment does not prohibit D.C. from banning the possession of handguns. The O'Melveny-D.C. team included partners Walter Dellinger and Matt Shors, counsel Mark Davies, and associate Geoff Wyatt.

The filing is a continuation of our pro bono efforts on behalf of the government of the District of Columbia. Earlier this year, a team including Davies, Shors, associates Meaghan McLaine, Rich Rose, and Wyatt, as well as former associate (now law clerk) Eli Kay-Oliphant, successfully opposed issuance of a temporary restraining order against the District in its effort to transfer control of the city's schools to the office of Mayor Adrian Fenty. The team also eventually obtained the dismissal of the complaint, which challenged the Mayor's authority to transfer control of the schools. The case is now on appeal.
