Product Liability Law 360 Features Jenner & Block’s Products Liability and Mass Tort Defense Practice
Jenner & Block’s Products Liability and Mass Torts Defense Practice was recently featured in a Product Liability Law 360 profile that highlights the group’s experience at developing factual and legal defenses for complex scientific and technical cases. The feature article emphasizes the diverse makeup of the practice group and showcases the Firm’s success in advancing Daubert motions to challenge the legitimacy of expert scientific testimony offered by plaintiffs.

Practice Chair Lise T. Spacapan told Law 360 that Jenner & Block’s Products Liability and Mass Torts Defense Practice sets itself apart from other firms due to its diversity and scientific knowledge. The article notes that “about a third of the attorneys in the group are women or minorities,” and those attorneys form the majority of the core group within the practice who devote most of their time to products liability and mass tort cases.

Because the outcome of many matters hinge on an understanding of the scientific issues at the heart of the case, Ms. Spacapan said that attorneys in the practice are immersed in areas such as engineering, epidemiology, toxicology and immunology. This knowledge enables the attorneys to assess the appropriate defense strategy early on and “aggressively challenge the other side’s expert.”

The article notes the Firm’s recent successful representation of a major automobile manufacturer, and also describes a complex toxic torts case in which the Firm brought a successful Daubert motion barring causation testimony from a neuroimmunologist expert who had testified in over 100 cases and had never previously been barred from testifying under Daubert. The ruling ultimately led to summary judgment for the Firm's client.

In addition, the article notes a case in “notoriously plaintiff-friendly Brownsville, Texas,” where Jenner & Block represented a company facing allegations of purported mold invasion after it supplied HVAC systems to sixteen public schools. “Over three days of videotaped testimony,” Ms. Spacapan told Law 360, “Jenner & Block dismantled the expert’s report, leading to a half-day Daubert/Robinson hearing on the eve of trial. The plaintiff school district agreed to settle the case the next day.”

The article describes several trends the Practice sees emerging in the field. Among other things, the article mentions a potential increase in claims stemming from the developing science on climate change, nanotechnology and biomonitoring for chemicals. “The medical profession is increasingly adept at measuring small amounts of chemicals that may have been introduced into the body through natural processes or the food stream, which could provide the basis for significant legal claims by plaintiffs,” said Ms. Spacapan

Holland & Knight Partner William Hamilton Teaches Groundbreaking E-Discovery Course at University of Florida's Levin College of Law
William F. "Bill" Hamilton, a litigation partner in the Tampa office of Holland & Knight, will be an adjunct professor at University of Florida’s Levin College of Law during the Fall semester teaching a ground breaking course on Electronic Data Discovery & Evidence.

This unique advanced full credit law school course covering issues and practice will include location and preservation of data, disclosure, discovery methods, ethical issues, sanctions, records management and admissibility of evidence.

Hamilton focuses his practice on complex litigation in the areas of intellectual property (copyright, trademark, patent and trade secrets law), technology law, class action defense, telecommunications, antitrust and trade regulation, and unfair trade practices. Hamilton is Board Certified in Business Litigation by The Florida Bar.

Sports-Related M&A Lawyer Joins the Denver Office of Hogan & Hartson as a Partner
Hogan & Hartson LLP announced today that Tyler Y. Harvey has joined the firm as a partner in the Denver office. Harvey will help expand the firm’s growing M&A practice with a particular focus on work in sports and entertainment related matters.

A board member of the Metro Denver Sports Commission, Harvey has extensive experience in corporate and financing deals, including working on deals related to the Home Depot Center in Carson, Calif. and the Staples Center and LA Live in Los Angeles. During his career, he has represented buyers, sellers, and borrowers in over $1 billion in corporate and financing transactions.

Prior to joining Hogan & Hartson, Harvey was a partner at Holme Roberts & Owen in Denver, Colo., where he focused much of his practice on private M&A work, frequently in the sports and entertainment industry. He has also handled debt finance transactions and has experience in securities law matters.

“We are very fortunate to have Tyler join us,” said Cole Finegan, Managing Partner of the firm’s Denver office. “Tyler’s wide-ranging capabilities in this field, as well as his longstanding roots in the community, will strengthen our sports-related project development work both here in the Denver office and across the firm.”

Harvey received his law degree from the University of Denver and his bachelor's degree from DePauw University. In addition to being a district chairman for the Summit District of the Denver Area Council of the Boy Scouts of America, Harvey has been involved with the Colorado Symphony’s young patrons organization.

Corporate, Securities, and Finance Counsel Joins Moscow Office of Hogan & Hartson
Hogan & Hartson is pleased to announce that Alexander Kudelin has joined the firm's Moscow office as counsel. Kudelin will help strengthen the firm’s corporate, securities, and finance capabilities in Russia.

Prior to joining Hogan & Hartson, Kudelin has established a recognized corporate and transactional practice in the corporate practice of one of Russia’s leading law firms, focusing on mergers and acquisitions, secured finance, capital markets, corporate finance, securities, real estate, and general corporate counseling.

Kudelin has extensive experience handling complex negotiated acquisitions, hostile takeovers, and minority and majority investments in a wide variety of industries, including oil and gas, metals and mining, automotive, telecommunications, food, and banking. He has worked on private placements, debt offerings, shareholder agreements, joint ventures, partnerships, strategic mergers, and a broad range of financing transactions. He also regularly counsels clients on corporate governance issues and has in-depth knowledge of building complex corporate structures.

“We are delighted to welcome Alexander to Hogan & Hartson,” said Peter Pettibone, Managing Partner of the firm’s Moscow office. “Alexander’s experience in M&A, securities, and real estate transactions will be an asset to our Moscow office, which has a strong market reputation for highly complex corporate and commercial work.”

Kudelin received his law degree, with honors, from the Moscow State Institute of International Relations (MGIMO) in 1995; a doctor of legal science (LL.M. equivalent) from MGIMO in 1998; a master’s from Boston University School of Law in 2000; and a master’s from the University of Chicago Law School in 2003.

Kudelin joined other recent high-profile additions to the Moscow office, including tax partner Ilya Rybalkin and intellectual property counsel Julianna Tabastajewa.

Three Dykema Attorneys To Speak At Conference On New Michigan Tax
Dykema attorneys Steven E. Grob, Sherrill D. Wolford and Wayne D. Roberts are among the presenters at the Michigan Tax Conference co-sponsored by the Michigan Association of Certified Public Accountants (MACPA), the Michigan Department of Treasury and the Taxation Section of the State Bar of Michigan to be held on November 7-8, 2007.

This event is likely to be the largest tax conference ever held in Michigan and includes such topics as the new Michigan Business Tax, Tax and Audit Appeals, Michigan Unemployment Tax Matters, Michigan Tax Collection Procedures, Midwest Regional Update, Current Nexus Controversies and Constitutional Aspects of the New Tax. Nationally recognized tax Professor Richard Pomp from the University of Connecticut also will be featured.

Steven E. Grob is the Director of Dykema’s Taxation and Estates Department, and his practice includes federal and state tax planning and tax controversies for corporations, partnerships and limited liability companies. He is a contributing editor to the Journal of Multistate Taxation, a national tax publication. He will be speaking on the mechanics of the new Michigan Business Tax.

Sherrill D. Wolford represents clients in federal and state tax controversies, tax planning and transactional strategies. Her practice emphasizes state business income, franchise, sales, use, and property taxes, and state and local tax incentives. She will present a Michigan Unemployment Insurance Update – SUTA Dumping, mergers & acquisitions, Rule 190, UIA audits and employee leasing.

Wayne D. Roberts’ practice includes all aspects of federal and state tax planning and litigation. He has represented both closely held and Fortune 1000 companies in tax disputes with the Internal Revenue Service, the Michigan Department of Treasury, and numerous state and local taxing jurisdictions. He will speak on Current Collection Efforts by the Treasury, Changes in Philosophy, and case resolution strategies, including Officer Liability cases.

Latin America Partners Discuss M&A, IPO Markets and Nuclear Energy
Bracewell & Giuliani LLP’s International practice has partnered with Latin Trade Magazine for a series of roundtable events. The series is an invitation-only discussion on key topics of the moment in Latin American business for the benefit of corporate executives and general counsel.
