Bronze Tablet Award for FETF Intern
FETF intern Reed McBride will be traveling to the University of Illinois in Champaign on Monday, April 30 to be honored as a Bronze Tablet Graduate. This is the highest academic recognition given to undergraduates, granted to those graduating in the top 3% of each college at the University. Each year, the recipients have their names cast into a bronze tablet with other honorees for that year, and the tablet is placed on permanent display in the University Library. Reed's tablet will hang alongside those of his grandfather, Frank M. Shappert (1953) and FETF partners Timothy Maloney (1988) and Rudy Kratz (1990). Reed completed his degree in seven semesters and graduated from Illinois in December 2006 with a B.S. in Mechanical Engineering summa cum laude.

Duke R. Highfield obtains defense verdict in wrongful death case.
Duke Highfield, chair of YCR's Trucking & Transportation Practice Group, recently obtained a jury verdict in favor of his clients in a wrongful death case pending in United States District Court, Orangeburg Division. The case involved a group of motorcyclists (11 in all) who had traveled from PA to attend a motorcycle rally in SC. One of the lead bikers was involved in a collision with a commercial wrecker that had two vehicles in tow. The facts of the initial collision were very much in dispute. Our driver indicated that the lead biker improperly switched lanes (from right to left) into his path. The bikers, most of whom were members of a Christian biker club, all testified that the lead biker was already established in the left lane and that our driver attempted to pass him on the left (by driving through the median). After the initial collision, the lead biker was knocked from his motorcycle and thrown into the median (he survived). His motorcycle then traveled back toward the other bikers, eventually entering the right lane. The second biker, a 43-year old contractor from PA, lost control while attempting to avoid this motorcycle, went over the handlebars, and landed on his head (he was not wearing a helmet). He never demonstrated any signs of consciousness, and later died that same day. His estate, which consisted of his 45-year old widow, 19-year old son and 22-year old daughter (all of whom testified at trial), pursued claims for wrongful death and survival. The damages included funeral expenses of approximately $11,000.00 and pecuniary losses in the range of $870,000.00 - $1.1 million. The trial judge granted judgment as a matter of law on the survival claim, but the wrongful death claim, as well as a claim for punitive damages, were submitted to the jury. After a 4-day trial, the jury returned a verdict in favor of the defendants.

Nancy Furney and Lori Oliphant Join Winstead's Dallas Office
Texas law firm Winstead PC added two new attorneys last week when Nancy Furney and Lori Oliphant joined the team as shareholders in the taxation, employee benefits and private business practice group. Furney and Oliphant advise clients in all aspects of ERISA and employee benefit matters. According to their Practice Group Chair Tom Helfand, "I am very pleased that Nancy and Lori have joined our firm. They bring excellent skills and experience to our Dallas Office and enhance our strengths in tax and employee benefits matters. We are pleased to have them on the Winstead team."

Furney and Oliphant represent a diverse group of clients, including Fortune 500 companies, in all areas of ERISA and employee benefit matters, including the design and implementation of tax qualified retirement plans (including 401(k) plans), deferred compensation plans, welfare plans, and equity plans. They represent clients in connection with financing transactions, mergers and acquisitions, and in proceedings with the Internal Revenue Service, the Department of Labor and the Pension Benefits Guaranty Corporation.

D Magazine Honors 11 Winstead Attorneys as 'Best Lawyers in Dallas'
Congratulations to eleven Winstead PC attorneys listed among D Magazine's 'Best Lawyers in Dallas' for their outstanding performance and professional reputation within the legal industry. The listing appears in D Magazine's May 2007 issue.

More than 2,500 licensed attorneys cast their ballots to recommend the most excellent lawyers in the Dallas area. Voters were asked to nominate two colleagues from outside of their firm as well as one colleague from within his or her own firm, though same-firm votes carried less weight than outside-firm votes. Nominations could include co-counsel, lawyers observed in court, or opposing counsel.

Schottenstein Zox & Dunn Lends Pro Bono Efforts to Successful Merger
In a community full of thriving nonprofit groups, two local charitable organizations have joined forces to combine specialized programming and save on operating costs. On My Own, a 20-year-old human-service nonprofit dedicated to helping mildly disabled adults live independently, and Goodwill Columbus, the area’s sixth largest social-service group, have merged to particularly help the smaller On My Own group compete in an ever-challenging nonprofit realm.

Assisted through legal counsel, substantially pro-bono, provided by Kevin Hilvert, associate at Schottenstein Zox & Dunn Co., LPA (SZD), the two groups have successfully blended forces to continue to aid those who have come to depend on their services, programs and facilities. The merger will allow the larger Goodwill Columbus, that SZD represented, broaden its base of clients served while simultaneously giving On My Own the opportunity to grow and better serve those it currently supports.

"It is always a great opportunity to work with such earnest charitable organizations and contribute in the form of pro bono counsel, so they may focus on providing worthwhile services in the community," says Bryan Prosek, partner and leader of SZD’s pro bono committee.

SZD recognizes the need to serve the community through such pro bono efforts as the Goodwill Columbus merger, and continually participates in unique programs such as the Columbus Bar Association’s Lawyers for Justice program and the joint program operated by the Cleveland and Cuyahoga County bar associations.

RatnerPrestia Shareholder Published In "The Computer & Internet Lawyer"
Kenneth N. Nigon, a Shareholder with RatnerPrestia, has authored an article in the April 2007 edition of The Computer & Internet Lawyer, entitled, "Advanced Specification Drafting Issues: Computer and Electronic Inventions." In this article, Mr. Nigon provides guidance to patent practitioners when preparing written descriptions of inventions in view of recent caselaw from the Court of Appeals for the Federal Circuit. He also analyzes the interim guidelines on patent eligible subject matter published by the U.S. Patent and Trademark Office and describes how the patent specification and claims may be drafted to avoid rejections under 35 U.S.C. § 101.

Mr. Nigon has over 20 years of experience preparing and prosecuting patent applications in the computer and electronic arts. He is on the faculty of Practicing Law Institute's Advanced Patent Prosecution Seminar. He has spoken at numerous American Intellectual Property Law Association seminars and meetings, including the 2006 Annual meeting and the February 9, 2007 AIPLA on-line program, both programs concerning patent eligible subject matter. Mr. Nigon is also the author of Chapter 5, Drafting the Specification, of Electronic and Software Patents, Law and Practice, published by BNA Books.
