T&K Attorneys Secure Jury Verdict for Landlord in Breach of Lease Dispute
Thompson & Knight attorneys recently secured a jury verdict in favor of 9555 West Belt L.P./Bayview USA Holdings LLC, the owner of an office building located at 9555 W. Sam Houston Parkway, in a dispute involving a tenant's breach of a long-term lease. The defendants in the suit were Quality Infusion Care, Inc., a company which provides services for home health care, and its owners Jim and Linda Rutherford. Moody Rambin Interests managed the property for 9555 West Belt L.P.

Quality Infusion was accused of entering into a seven-year lease of office space in 2002, abandoning the premises in 2005, and failing to pay the remainder of the rent and building operating expenses that were due through 2009. The defendants claimed they abandoned the space because the property was unsuitable for their business and because the owner breached the implied warranties of suitability and quiet enjoyment. Specifically, the defendants claimed the building's power supply failed repeatedly. The jury, after a three-day trial, found in favor of the Firm's client, and the court entered final judgment on August 6, 2007.

Partner Hunter M. Barrow was the lead attorney representing the plaintiffs and was assisted by Associate Charles A. Lestage. Both are residents in Thompson & Knight's Houston office.

T&K Attorney Elected to Bar Association Chair Positions
Thompson & Knight LLP is pleased to announce William M. Katz Jr. has been elected Chair of the American Bar Association ("ABA") Section of Antitrust Law's Insurance Industry Committee and Chair-Elect of the State Bar of Texas Antitrust and Business Litigation Section for 2007-2008.

The ABA Section of Antitrust Law's Insurance Industry Committee focuses on antitrust issues of interest to members in the insurance, reinsurance, and insurance brokerage communities and their counsel. Members of the Committee include private practitioners, in-house counsel, government attorneys, academics, and economists. Katz previously served as the Insurance Industry Committee's Vice-Chair from 2003-2007. He also currently serves as Co-Chair of the Antitrust Subcommittee of the Class Actions and Derivative Suits Committee of the ABA's Litigation Section.

The State Bar of Texas Antitrust and Business Litigation Section focuses on antitrust and complex business litigation. The Section sponsors seminars on topics of interest to antitrust and business litigators. The Section also produces two publications: Texas Business Litigation Quarterly and Monograph: Antitrust and Related Statutes. Katz has previously served as the Antitrust and Business Litigation Section's Secretary-Treasurer. He also currently serves as a Council Member and Contributing Editor for Texas Business Litigation Quarterly.

Katz is a Partner in the Trial Practice Group of Thompson & Knight's Dallas office and focuses his practice on antitrust, securities, corporate governance, class action, and complex business litigation. He represents clients before federal and state trial and appellate courts, arbitration panels, and administrative agencies, including the Antitrust Division of the U.S. Department of Justice and the Federal Trade Commission. Katz also has expertise in internal investigations and the representation of audit committees. He is a member of the District of Columbia Bar's Antitrust Section, New York State Bar Association's Antitrust Law Section, and Dallas Bar Association's Business Litigation Section and Antitrust and Trade Regulation Section. He is also a Fellow of the Dallas Bar Foundation and Texas Bar Foundation.

Miller Canfield Represents Fair Housing Center of Metropolitan Detroit
The law firm of Miller Canfield announces that it represented the Fair Housing Center of Metropolitan Detroit (FHC) against General Properties Company et al (GPC), owners and managers of the Whispering Woods Apartments (a.k.a. Apple Ridge Apartments) in Livonia, Michigan, successfully obtaining a Consent Decree bringing an end to a two and one-half year racial discrimination lawsuit filed by the FHC.

The Fair Housing Center of Metropolitan Detroit’s legal team was led by Miller Canfield attorney Saul A. Green. Attorneys P. Rivka Schochet, Freeman L. Farrow, Michelle P. Crockett, and Nicole S. Kaseta also worked on the case.

The law firm of Miller Canfield was established in Detroit in 1852 and employs more than 800 in offices in Michigan, Massachusetts, Florida, New York, Canada and Poland.

Manatt Expansion Under Way As Eric Newsom Joins Firm
Manatt, Phelps & Phillips, LLP, the national law and consulting firm, announced today that Eric A. Newsom has joined the firm as partner in the Business, Finance & Tax Division. Mr. Newsom, who moves to Manatt from Foley & Lardner, is the first lateral hire in the firm’s new San Francisco office, which opened earlier this month.

“Eric has a proven track record of successfully representing clients in a multitude of M&A, venture capital, private equity and intellectual property transactions,” said T. Hale Boggs, a partner in the firm’s Corporate and Venture Capital practice, who is leading the firm’s efforts in partner-level recruiting and client development in San Francisco. “The combination of his experience and our group’s work will significantly expand and enhance our transactional capabilities nationwide.”

“Manatt provides me the opportunity to work with a great national team of skilled business lawyers,” said Mr. Newsom. “Manatt’s excellent reputation precedes its entry into the San Francisco market. Now that it is here, I am eager to transition my clients and practice to a firm I have long admired.”

Mr. Newsom regularly counsels his clients on business acquisitions and financings, as well as on corporate compliance and governance matters, strategic transition issues, development, transfer and commercialization of intellectual property and various product manufacture, distribution, supply and other commercial agreements. Mr. Newsom received his B.A. in International Relations and French Literature from University of California, Davis, and J.D. from University of San Francisco School of Law.

Harold P. Reichwald, a partner in Manatt's Business & Finance practice group, added: "This has been an extremely satisfying professional experience, and I am pleased to have worked with Vahe and Andrew, as well as with the remarkable leaders of Armenia. Kaye Scholer's Deskbook on Internal Investigations, Corporate Compliance and White Collar Issues Recognized as Essential Reading
Kaye Scholer's Deskbook on Internal Investigations, Corporate Compliance and White Collar Issues was favorably reviewed in the "Essential Reading" section of the June 2007 edition of Securities & Investment Review. The UK-based monthly trade magazine stated the Deskbook is "a serious volume and should be treated as such by in-house lawyers, compliance departments and chief executives" and "has all the latest information on internal investigations, litigation, money laundering and perjury."

The Deskbook was written by attorneys from Kaye Scholer's White Collar Litigation and Internal Investigations Practice Group and published with the Practising Law Institute.

Jones Day Advises Harsco on its Strategic Acquisition of Alexander Mill Services International
Jones Day advised Harsco Corporation (NYSE: HSC) ("Harsco"), a worldwide industrial services company, on its latest strategic acquisition. The deal, which was announced and completed on 27 August 2007, involved the acquisition of Alexander Mill Services International ("AMSI"), a privately held company that provides mill services to some of the leading steel producers in Poland, Romania, Greece, and Portugal.

AMSI will join Harsco's MultiServ mill services division, headquartered in the U.K., which operates at more than 160 mills worldwide as the world’s largest on-site service partner to the steel and metals industries. The acquisition increases MultiServ's global operations from 32 countries to 35 countries.

AMSI's established footprint in Poland and Romania gives Harsco an immediate platform to expand into the region's growing steel industry revitalization, as new multinational owners, many of them existing Harsco customers, continue to implement significant steel plant modernization and operational expansion programs to support the region's burgeoning infrastructure growth.

The Jones Day team involved teams from the Firm's Paris and Frankfurt Offices and included My Linh Vu-Grégoire, Alexandre de Verdun, and Amélie Skierka (Mergers & Acquisitions, Paris) and Benjamin Wille (Mergers & Acquisitions, Frankfurt).

Harsco Corporation was also advised by the law firms Loyens & Loeff (The Netherlands), Soltysinski, Kawecki & Szlezak (Poland), Abreu Advogados (Portugal), Popovici & Associatii (Romania), and Vgenopoulos & Partners (Greece).

Hamill and Scott Among Law Bulletin’s “40 Illinois Attorneys Under Forty to Watch”
Jenner & Block Partners John J. Hamill and Kenyanna M. Scott were recently named to the Law Bulletin Publishing Company’s 2007 list of “40 Illinois Attorneys Under Forty to Watch,” an annual publication that honors 40 Illinois attorneys who display “intelligence, passion and a track record of success, a desire to help the community and willingness to work hard.” The 40 honorees are carefully selected out of hundreds of nominations sent in by attorneys, Managing Partners, politicians, judges, and opposing counsel from across the country.

Mr. Hamill was recognized for his success in “big-ticket” litigation for high-profile cases for corporate clients such as BlueCross BlueShield of America (BCBSA) and ComEd. Mr. Hamill is “responsive, intelligent, courteous, and insightful,” Daniel Engle, Senior Associate General Counsel of BCBSA, told the magazine.

The article highlighted his success in representing the Illinois Academic Decathlon Association and the U.S. Academic Decathlon Association following an investigation into anomalies in scores posted by a Chicago high school, his work in securing the release of an indigent man who was being held in Cook County Jail on a civil contempt charge for nearly a decade, and his work on a series of highly complex lawsuits for MCI.

Brian Leske, former in-house counsel at MCI and current legal advisor on the Romney presidential campaign, told the editors, “The litigation skills needed to handle these cases were immense. They required the highest advocacy capabilities that an in-house counsel could ask of its lawyers. From the careful choice of written words during briefing, to the presentation of oral arguments that methodically walked courts through difficult legal principles and highly technical factual scenarios, John and his team of lawyers showed legal talent of the highest caliber.”

Ms. Scott was recognized for her courtroom successes, her devotion to the community and promoting diversity in the legal profession.

The article discusses how as an Assistant U.S. Attorney, Ms. Scott tried twelve cases to verdict and argued numerous criminal appeals before the U.S. Court of Appeals for the Seventh Circuit.

In her role as vice-president of the Black Women Lawyers’ Association (BWLA) of Greater Chicago, the article points out, Ms. Scott has tackled “a host of philanthropic projects” such as the organization of a fundraiser to donate food, water and clothing to the war-torn region of western Sudan and volunteering at an orphanage in South Africa.

In addition, the article highlights how Ms. Scott co-authored an amicus brief in the U.S. Supreme Court cases of Parents Involved in Community Schools v. Seattle School Districts, No. 1 and Meredith v. Jefferson County Board of Education in which the Court determined what efforts local school systems may voluntarily take to promote diversity.

Ann Claire Williams, Circuit Judge with the U.S. Court of Appeals for the Seventh Circuit told the Law Bulletin, “Kenyanna has embraced the opportunity to serve as a role model and mentor, especially to young people, people of color and women, and she has taken on leadership roles to ensure that others see that success in the legal profession is possible for them.”

Partner Craig C. Martin was also featured in the magazine as the author of an article entitled, “Perspective On Being ‘40 Under Forty.’” Mr. Martin was named to Law Bulletin's 2001 list of "40 Illinois Attorneys Under Forty To Watch" as well as to The National Law Journal's 2002 "40 Under 40 Young Advocates Making Their Mark" and Crain's Chicago Business' 2002 "Forty Under 40" list. For the article, the Law Bulletin Publishing Company asked Mr. Martin to provide his thoughts about succeeding in today’s legal marketplace.

In the article, Mr. Martin addresses how practicing law is about earning trust and putting the clients’ interests ahead of personal interests. He also discusses the importance of being a mentor and encourages young lawyers to pursue an area of law that they are passionate about.

Mr. Martin also congratulates all of the “40 Under Forty” honorees and he says of Mr. Hamill and Ms. Scott, both are “highly deserving” of the recognition. “Kenyanna is dynamic and charismatic. John is persevering and direct,” he said. “Both are at an important stage of their careers, the same one that I was at not long ago. They have achieved an incredible amount and they are poised to achieve more. They understand the importance of client service.”
