Judge Deploys New Type Of Expert
In an unprecedented move, Judge Claudia Wilken of the U.S. District Court for the Northern District of California has begun appointing independent technical experts to testify in complicated patent trials. Last week O2Micro International lost a dispute with Monolithic Power Systems when a jury, helped by the testimony of an independent technical expert, ruled that MPS did not infringe one of O2Micro’s inverter controller patents. Lionel Lavenue of Finnegan Henderson, who is representing a company that was also sued by O2Micro over the same patent, added that the independent expert helped streamline the trial. “In almost every patent case you hear the plaintiffs’ expert, you hear the defendants’ expert, and then you’re not really sure which one you like,” Lavenue said. “With respect to this case, we thought the independent expert did a fine job. I might feel differently if I was the plaintiff.”

Proposed shield law makes progress on the hill
Legislation that would make Massachusetts the 33rd state with statutory protection for reporters’ confidential sources is pending in the state Legislature, with a hearing expected in June. Prince Lobel partner Jeffrey Newman, an originator of the bill, is working closely with media organizations throughout the Commonwealth to support passage. If passed, law would prevent the release the names of confidential sources of Massachusetts reporters, except in certain limited circumstances. Weil Gotshal to Advise MGM MIRAGE'S Transactions Committee
Weil, Gotshal & Manges LLP has been retained to represent the Transactions Committee of the MGM MIRAGE Board of Directors in connection with the Transaction Committee's consideration of an amended Schedule 13D filed by Tracinda Corporation and strategic alternatives available to MGM MIRAGE. In the amended Schedule 13D, Tracinda stated that it intends to enter into discussions with MGM MIRAGE with respect to the purchase of two MGM MIRAGE-owned properties -- the Bellagio Hotel and Casino and the CityCenter development project in Las Vegas -- and to consider strategic alternatives with respect to its investment in MGM MIRAGE. MGM MIRAGE is one of the world’s largest hotel and gaming companies, owning and operating 19 properties. Tracinda owns more than a majority of the outstanding shares of MGM MIRAGE.

Government Contracts Attorney Ralph Thomas Honored in 'America's Top Diversity Advocates'
Ralph C. Thomas, III, counsel in the Government Contracts Practice of Buchanan Ingersoll & Rooney PC, was listed among the 50 honorees of "America's Top Diversity Advocates" in the recent inaugural issue of DiversityBusiness.com magazine. The individuals were recognized for their outstanding achievements in various diversity initiatives, and represent those who have demonstrated a commitment to solutions in diversity issues on a global and national level. Notable honorees include former U.S. Presidents Bill Clinton and Jimmy Carter as well as Oprah Winfrey. DiversityBusiness.com has more than 35,000 members and is the largest organization of diversity-owned businesses throughout the United States.

Thomas focuses his practice on small- and minority-owned business matters and has been honored for this work by a number of organizations, including being named Man of the Year by Minority Enterprise Advocate Magazine in 2005.

"I am very fortunate that the firm and Government Contracts Practice Group Chair Ron Perlman have encouraged my small business advocate activities," explains Thomas. Ralph C. Thomas, III focuses his practice on small- and minority-owned business matters. Prior to joining Buchanan, Ralph was the assistant administrator for small and disadvantaged business utilization at the National Aeronautics and Space Administration (NASA) in Washington, D.C., where he was a member of NASA's senior management team and as the senior advocate for small business utilization. In 2005, his program was awarded the Frances Perkins Vanguard Award from the U.S. Small Business Administration. In 2004 he was named Minority Business Entrepreneur Advocate of the Year by Asian Enterprise Magazine. In addition, he received the Diversity Innovator Award from the National Women's Business Center, as well as a certificate of special congressional recognition from a member of the United States Senate.

In 2002, Ralph was named as Advocate of the Year by the National Association of Small Disadvantaged Businesses. In 2000 and 2001, he received the presidential rank of distinguished executive and the presidential rank of meritorious executive from Republican President George W. Bush and Democratic President William Clinton, respectively. Also in 2000, he was named one of the "Best of the Decade" by Minority Business News, U.S.A., and received a “Special Honor Award” at the International Conference of Small and Medium Enterprises in Bombay, India, in 1999.

Jones Receives Emerging Leader Award
Columbus attorney Janine Hancock Jones was honored as an "Emerging Leader" by the John Mercer Langston Bar Association (JMLBA), the Columbus affiliate of the National Bar Association, at its Fourth Annual "Barristers' Salute" on May 17.

The event provided the Columbus legal community the privilege of honoring individuals who are committed to improving the legal community as well as serving the African American community through civic stewardship. "Emerging Leaders" are honored for the promise they show as young attorneys and community leaders.

Jones, who practices in the area of employment and labor law, currently serves as the Vice President of the JLMBA. She also serves on the Columbus Bar Association's Law 2010 and Minorities in the Law committees; was recently selected as a member of the Leadership of Columbus Class of 2007; serves as the Chair of the Personnel Committee of the Board of Trustees for the North Side Child Development Center (which operates a child development program providing care for children 24 hours a day) and Turning Point, a 24-hour crisis respite center that provides short-term care for children of parents who are dealing with an emergency crisis and cannot handle the care of their children.

Firm Management Elects Two New Leaders
Adams and Reese is pleased to announce that A. Kirk Gasperecz has been named Partner in Charge of the firm’s New Orleans office. Along with Senior Partner in Charge Mark C. Surprenant, Gasperecz is responsible for the overall administration of office and its 220 attorneys and staff. Gasperecz replaces Charles A. Cerise, Jr., who will now serve as a Litigation Practice Group Leader.

Gasperecz is a member of the Casualty and Coverage Practice Team in the Litigation Practice Group. He represents product manufacturers, testing laboratories, oil and chemical producers, elevator service companies, restaurants, insurance companies and governmental bodies. He earned his Bachelor of Science degree in 1983 from Louisiana State University, where he was Student Body President, and earned his Juris Doctorate from Loyola University School of Law in 1986. Gasperecz is an active member of several professional and community organizations, and in 2007, was named a Louisiana Super Lawyer® (Environmental Litigation).

Cerise is a member of the Maritime/ Offshore Practice Team in the Litigation Practice Group. He has been practicing in the areas of maritime, toxic tort, casualty, insurance and products liability litigation since 1983, and has experience in personal injury and property damage litigation from single to multi-party cases, including Jones Act, longshore, third-party asset damage, collision, and complex limitation of liability matters. He has also been involved in significant offshore death, injury and property damage litigation. Cerise received his Bachelor of Science from the University of New Orleans in 1981, and earned his Juris Doctorate summa cum laude from Loyola University Law School in 1983. He was a member of Loyola Law Review and the recipient of the "Judge Anna Vetters Levy Scholarship." Cerise is active in firm management. Aside from his role as a Practice Team Leader and former Partner in Charge, he has also served as the liaison partner to the firm associates. New Orleans CityBusiness honored Cerise as one of its "Leaders in Law" for 2006, and in 2007, he was named a Louisiana Super Lawyer® (Transportation/Maritime).
