Gibbons Fellowship Prevails in Habeas Corpus Case, Appellate Court Reverses Decision
the United States Court of Appeals for the Fourth Circuit published its opinion in Ali Saleh Kahlah Al-Marri vs. Commander S.L. Wright, in which the Gibbons Fellowship prevailed in upholding the constitutional law of the country.

The Fellowship has long represented Al-Marri, one of only three alleged “enemy combatants” arrested in the United States, who was, on the eve of his criminal trial, taken into custody by the military. For more than 3 years, Al-Marri was held by the government and neither charged nor provided with any process. This case presented cutting-edge issues regarding the treatment of enemy combatants, and has been ongoing in various venues and courts over the past few years.

"We have been involved with this case for many years, and are glad to see that Mr. Al-Marri is finally receiving the due process to which he is entitled," stated Lawrence S. Lustberg, Director of the Gibbons Fellowship and lead attorney for this case. "This is just one example of the many people who are being held in similar situations without hopes for a fair and just trial."

Kermit Nash Joins Fredrikson & Byron
Kermit Nash has joined the law firm of Fredrikson & Byron as an officer in Fredrikson & Byron’s Corporate Group. Bryan Cave Earns Top Spots from ‘Corporate Board Member’ Magazine in St. Louis, Phoenix
For the sixth consecutive year, Bryan Cave LLP has been named the best corporate law firm in St. Louis by Corporate Board Member magazine. Corporate directors in Phoenix ranked the firm fourth in the survey. The results, part of the magazine’s annual legal research study, are published in the July/August cover story, “America’s Best Corporate Law Firms.”

“It is truly an honor to be recognized as the No. 1 law firm in St. Louis for the sixth year in a row,” said Peter Van Cleve, managing partner in Bryan Cave’s St. Louis office. “This reflects the high level of talent and hard work of our lawyers and staff and their continued commitment to client service.”

In 25 major metropolitan areas, the magazine also asked respondents to select the five local law firms they most admire and would want to represent them in general legal matters.

Lewis and Roca Names Five New Partners
Lewis and Roca has named five attorneys into the partnership: Scott K. Brown, Jason C. Furedy, David D. Garner, Thomas A. Gilson and David D. Weinzweig.

Mr. Brown is a member of the firm’s Commercial Litigation group. He practices primarily in the area of bankruptcy law. He represents clients in business bankruptcy cases, commercial lawsuits and business transactions. Mr. Brown also represents both secured and unsecured creditors, as well as trustees, committees and debtors, in all aspects of Chapter 11 business bankruptcy cases, including workouts and litigation. Mr. Brown was a law clerk for the Honorable Leif M. Clark of the U.S. Bankruptcy Court for the Western District of Texas from 2000-01. Mr. Brown received his J.D. from Brigham Young University, J. Reuben Clark Law School and his B.A. from Brigham Young University.

Mr. Furedy is a member of the firm’s Business Group. He concentrates his practice on business, tax and corporate law, including tax-exempt charitable organizations. His practice emphasizes representing clients, including a national insurance company and other institutional investors, in equity joint venture transactions in connection with the acquisition, development, operation and financing of multi-family residential complexes, mixed use centers, office buildings and industrial facilities. Prior to joining Lewis and Roca, Mr. Furedy was a law clerk to Vice Chief Justice Charles E. Jones of the Arizona Supreme Court. Mr. Furedy received his J.D. from Georgetown University Law Center and his B.S. in Aerospace Engineering from the University of Arizona.

Mr. Garner is a member of the firm’s Commercial Litigation Group and focuses his practice on business litigation, public law and school law. His business litigation practice includes representing multi-national companies, as well as smaller businesses, in a broad variety of contract-related disputes. Mr. Garner has served as both plaintiff’s and defense counsel in such matters and has experience in, among other things, commercial landlord/tenant, floor plan financing, vendor services and insurance disputes, with a particular focus on class action defense work. In his public law practice, Mr. Garner represents government entities in litigation involving constitutional and statutory requirements for, and limitations on, governmental action. Mr. Garner’s school law practice includes advising and training school districts, charter schools, private schools and post-secondary institutions on a wide range of issues, such as student discipline, employee relations, open meeting and public records laws. Mr. Garner also has experience representing school clients in administrative hearings and litigation in state and federal trial and appellate courts. Prior to joining Lewis and Roca, Mr. Garner served as a law clerk to the Honorable Michael D. Ryan of the Arizona Court of Appeals. Mr. Garner received his J.D., B.A., and TESL Graduate Certificate from Brigham Young University.

Mr. Gilson is a member of the firm’s Commercial Litigation Section and its Criminal Defense and Corporate Compliance Group. He has represented clients in large-scale bankruptcy, securities and class action litigation. He also has represented corporate clients in grand jury and government agency investigations. Mr. Gilson is the co-leader of the firm’s E-Discovery practice group, and has substantial experience with e-discovery issues, including the collection, preservation and production of electronic data. Mr. Gilson is extensively involved with the Section of Litigation of the American Bar Association, serving as co-chair of its Criminal Litigation Committee and as editor-in-chief of its Criminal Litigation Newsletter. Before joining Lewis and Roca, Mr. Gilson was an associate at Skadden, Arps, Slate, Meagher & Flom LLP in Washington, D.C. He also served as a law clerk to the Honorable David B. Sentelle of the United States Court of Appeals for the District of Columbia Circuit and the Honorable Thomas A. Flannery of the United States District Court for the District of Columbia. He received his J.D. from Northwestern University School of Law, his M.M. in Piano Performance from The Juilliard School, and his A.B., cum laude, from Harvard College.

Mr. Weinzweig is a member of the firm’s Commercial Litigation and Antitrust Practice Groups. He has represented and advised multi-national corporations and local businesses in a wide assortment of business disputes, including antitrust matters. Mr. Weinzweig serves on the Arizona Chapter Board of Directors of the American Jewish Committee and the American Israel Public Affairs Committee. He is Program Chairman for the 2008 Judge Learned Hand Awards Program. Mr. Weinzweig is active in the State Bar of Arizona. He has served as chairman of the Antitrust Section and now sits on the editorial board of the Arizona Attorney magazine. Mr. Weinzweig has authored several book chapters and articles on antitrust law. He received his J.D. from Arizona State University College of Law and his B.A. in Political Science from the University of Arizona.

Kramer Levin Scores Another Victory for ATMI in Patent Dispute
The Kramer Levin team has obtained another favorable ruling for client ATMI in its ongoing series of patent disputes with Praxair. The Delaware District Court ruled two of Praxair's patents are unenforceable due to inequitable conduct. In a bench trial limited to that issue, the Kramer Levin team showed that key prior art had been withheld from the Patent Office with an intent to deceive. Coupled with an earlier summary judgment decision invalidating a third Praxair patent, this new ruling has helped clear the way for ATMI's continued marketing of its VAC(R) (Vacuum Actuated Cylinder) gas storage and delivery system to the semiconductor manufacturing industry. Weil Gotshal Honored as 2007 Pro Bono Champion; Several Member of the Weil Gotshal Community Recognized for Pro Bono Work
Legal Services for New York City (LSNY) hosted its inaugural pro bono appreciation event to recognize and thank attorneys and volunteers who have provided pro bono representation to low-income New Yorkers. Several members of the Weil Gotshal community were honored for their pro bono work, including: Alan Feigenbaum, Alexander Ng, Andrew Woodworth, Edwin Delaney, Melissa Carvalho, Miriam Buhl, Patricia Young, Rod Miller, Ryan Farrell, Salvatore Romanello, Sheryl Calabro, Shira Weiner, Stacy Nettleton and Virginia Johnson. In addition, Weil Gotshal was named the LSNY 2007 Pro Bono Champion.

LSNY has been the largest provider of free civil legal services to low-income individuals in the US for over 40 years. The organization has also worked to improve the lives and welfare of New York’s neediest residents.
