McLane Attorney Delyani Named to Rotary Board
The law firm of McLane, Graf, Raulerson & Middleton, Professional Association, with offices in Manchester, Portsmouth, and Concord, is pleased to announce that Attorney Anthony Delyani, a member of the firm?s Corporate Group, has been elected to serve on the board of directors of the Portsmouth Rotary Club.

Keating Muething & Klekamp Lawyers and Staff Give Summer Associates an "Inside Look"
The Legal Research and Information Resources (LRIR) committee of the Cincinnati Bar Association held its Twelfth Annual “Inside Look Program” for summer associates on Wednesday, June 13. Inside Look is a day-long program providing law students an opportunity to listen to and interact with prominent local lawyers as well as to meet other summer associates. Lawyers in various practice areas are invited to speak about the day to day realities of being a lawyer and to share insights and stories they’ve gleaned from their careers.

Keating Muething & Klekamp (KMK) lawyers and staff were actively involved in making this another successful year for Inside Look. KMK librarians Mary Lynn Wagner, Connie Song, and Shannon Kemen are members of LRIR and spent several months planning Inside Look.

Patrick F. Fischer, Immediate Past President of the CBA and KMK Partner, was the keynote speaker. Adrienne J. Roach, Partner at KMK, spoke on the topic of Family Law. Patricia B. Hogan, Partner at KMK, spoke on Intellectual Property. Kathleen A. Grant, Director of Legal Recruiting at KMK, spoke on the panel entitled “Survivor: Your First Years at the Firm”.

Katten Among First Law Firms to Launch Web Site Designed for Handheld Devices
Katten Muchin Rosenman LLP today announced the launch of a version of its Web site, www.kattenlaw.com, specifically optimized for viewing on all of today’s handheld devices, including BlackBerrys and Treos. Katten is one of the only law firms in the nation to have created such a site, allowing users quick access to key Firm information such as office locations, attorney bios and contact information, in a format that is easily readable on a small screen.

As more and more business is conducted outside the office, busy professionals rely increasingly on handheld devices to stay up-to-date and remain in touch with colleagues and clients. While any Web site is technically viewable from any Internet-enabled handheld device, nearly all are optimized for access from desktop and laptop computers, loaded with graphics and other special features not supported by handhelds. This makes them extremely difficult to view and very slow to load on a handheld device, often requiring both vertical and horizontal scrolling in order to read an entire page.

Katten’s handheld-optimized Web site, developed in conjunction with Hubbard One, a Thomson Elite business, strips away much of the standard site’s information and graphics, creating an easily readable, fast-loading Web site, which includes only the information most likely to be needed by mobile users. The site is designed so that users logging on to www.kattenlaw.com from a handheld device will receive the handheld version of the Web site, while those accessing the same Web address from a conventional computer, will see Katten’s full site.

“We are constantly evaluating ways to make it easier for our attorneys, clients, prospects and other interested professionals to access critical Firm information,” said Nicole Auerbach, Katten’s National Marketing Partner. “Users can now easily look up an office address on their Blackberry from the backseat of a taxi, or find a Firm attorney’s bio and contact information while waiting to board a plane.”

Mike Nasi to speak on energy and environmental topics this summer
JW Partner Mike Nasi, a leading attorney in energy, environmental, and regulatory law, will speak at several events this summer, including a Clean Cities/Clean Vehicles conference, the State and Provincial Trends in Energy and the Environment conference, and a Coal Combustion Products conference.

The "Flip this Fleet: Advancing the Choice" conference is designed to educate transportation professionals about the latest technologies, fuels, policies, and programs related to heavy and light duty fleets, including clean fuels such as Biodiesel, CNG, Ethanol, Propane, and more. The conference takes place on June 27 in Stafford, Texas. Mr. Nasi, who serves as counsel to the Biodiesel Coalition of Texas (BCOT), will provide the attendees with updates on recent legislative developments.

The Energy Council presents the 2007 State and Provincial Trends in Energy and the Environment Conference, which takes place June 28-July 1 in New Orleans, Louisiana. Mr. Nasi, who serves as counsel to the Clean Coal Technology Foundation of Texas (CCTFT), will provide an update on financial and regulatory incentives for advanced clean energy projects recently passed by the Texas Legislature, which the CCTFT actively supported during the 80th Texas Legislative Session.

A third event, "New Business Opportunities in Coal Combustion Products (CCP)," is presented by EUCI and takes place July 16-17 in Charlotte, North Carolina. The conference focuses on CCP management strategies and new CCP markets, as well as environmental compliance and landfill and mine-mouth regulations. Mr. Nasi, who serves as counsel to the Texas Coal Combustion Products Coalition (TCCPC), the Gulf Coast Lignite Coalition (GCLC), and the Texas Mining and Reclamation Association (TMRA), will co-chair the conference and present on "CCP Beneficial Use: Terminology and Case Studies."

Mr. Nasi's practice involves advising various industry associations and their members on permitting, compliance, rulemaking, and legislative matters. He routinely secures and maintains regulatory authorizations for entities in the electric power, mining, steel, biofuels, waste management, recycling, and construction industries, as well as for several major municipalities and local governments. Superb" Attorney Leads Charge Against Lawyer-Rating Web site Avvo.com
An attorney rated by lawyer-rating Web site Avvo.com as one of the best in the profession today filed a proposed nationwide class-action lawsuit on behalf of other attorneys claiming that the site is unfair and highly deceptive.

Steve W. Berman, the managing partner of Hagens Berman Sobol Shapiro, filed the suit in U.S. District Court in Seattle, alleging that the site launched by the creator of the successful travel Web site Expedia (NASDAQ:EXPE) violates unfair methods of competition and deceptive acts in the conduct of commerce as stated in the Washington Consumer Protection Act.

"When the site launched, they had a very slick media campaign that led consumers to believe the site would give them accurate and insightful information about attorneys," Berman said. "In reality, we believe the site's rating methodology is prone to error and wide open to manipulation."

Avvo, which launched on June 5, 2007, touts itself as a resource for consumers looking to hire an attorney by grading attorneys from one to 10 using a mathematical model based on multiple - but undisclosed -- sources of information. A low score indicates that an attorney should be approached with "extreme caution" while higher ratings denote "good" to "superb" performance.

According to Berman, the site's rating methodology is flawed, citing examples ranging from profound to comical.

According to the complaint, Bellevue attorney Enrico Salvatore Leo listed an award he earned in 2006 for his athletic prowess in playing recreational softball. His score immediately jumped despite the fact that the achievement had nothing to do with his practice. Before removing the listing, he added a second softball award which caused his score to again increase.

"The bottom line is the Avvo rating isn't a true representation of one's ability to practice law and deliver positive results to their client - it dupes consumers into thinking the site is an accurate reflection of an attorney's ability," said Berman.

The complaint also cites rating trends involving Avvo insiders. While the site claims to be an unbiased system Deborah Rhodes, an Avvo board member and Stanford ethics professor scored a perfect 10, while the dean of the Stanford law school scored significantly lower, the suit states.

I think it is highly dangerous to have a consumer making important choices based on a jack-legged system that puts as much emphasis on a softball award or the attorney's relationship with Avvo's CEO as it does legal prowess," Berman added. "Consumers deserve more than to be manipulated and misguided by a site claiming to be working in their interests."

In perhaps the most stunning contrast, the complaint notes that U.S. Supreme Court Justice Ruth Bader Ginsburg and Samuel Alito each received three out of five stars for trustworthiness when the site launched, awarding them a 6.5 or "Good" rating, while giving Lynne Stewart the exact same rating. Stewart is currently serving a prison term for conspiracy to defraud the government, the suit contends.

"This sort of casual rating system might work for finding a restaurant or tire store, but when a person needs to find an attorney to handle a life-defining crisis, we think this system is wholly inadequate," Berman noted.

Berman received a 9.2 rating, characterized as "superb" on the site's rating system, one of the highest ratings for his practice area of securities fraud, class action and anti-trust law.

"We are all interested to see if my rating 9.2 will drop once they are served with this lawsuit," Berman noted.

Currently the Avvo site rates attorneys in Washington, California, New York, Illinois, Georgia, Pennsylvania, Ohio, Arizona, Texas and the District of Columbia.

"We have heard from attorneys across the country also concerned that consumers are being misled," Berman said.

The suit claims that Avvo violates Washington's Consumer Protection Act, stating the site is deceptive in its ratings and that it provides consumers with biased, subjective and unreliable information.
