Cozen O’Connor Electronic Discovery Disputes Practice Presents E-Discovery Seminar in New York
Cozen O’Connor’s electronic discovery disputes practice recently presented the “E-Discovery Amendments to the Federal Rules of Civil Procedure – Are You Prepared?” seminar at the Marriott Financial Center Hotel in New York. The half-day, educational law seminar was comprised of presentations by nationally recognized e-discovery and electronic records retention consultants along with members of Cozen O’Connor’s e-discovery practice.

In addition to an in-depth review of the new rules, speakers discussed topics, including: preserving evidence and avoiding spoliation sanctions, properly preparing for the new Rule 26(f) conference, understanding issues of accessibility, effective cost-shifting strategies, the new safe harbor provision, upgrading your retention policy, cost-effective approaches for locating responsive and relevant data, and state court rules and the NCSC’s proposed guidelines. The seminar was approved for four NYCLE credits.

Cozen O’Connor Attorney Justin Wineburgh Lectures on Intellectual Property Issues in Entertainment Law at Widener University School of Law
Cozen O’Connor member Justin B. Wineburgh recently served as a guest lecturer on “Intellectual Property Issues in the Entertainment Industry,” at Widener University School of Law’s Wilmington, Del., campus. The program was sponsored by the Intellectual Property Society of Widener University School of Law. Wineburgh practices from Cozen O’Connor’s Philadelphia office and is co-head of the film/video unit of the firm’s entertainment law practice area. He has a broad-based practice, representing clients in the film, television, music and sports industries in complex tort, commercial, defamation, privacy, corporate, employment and intellectual property matters. He also represents writers, distributors, retailers, managers, agents, engineers, production companies and talent in a variety of capacities, including corporate and pre-litigation counseling. He has also successfully resolved numerous matters throughout the country through the use of alternate dispute resolution, including arbitration and mediation.

Wineburgh is admitted to practice in Pennsylvania, New Jersey State and Florida, and before the Pennsylvania Supreme Court, Supreme Court of Florida, Supreme Court of New Jersey and the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania and the District of New Jersey. He has also been specially admitted to handle cases in New York, California, Illinois, Virginia, Delaware, Massachusetts, Connecticut, Michigan and the District of Columbia, as well as before the California Labor Commission.

Wineburgh is a member of the American, Pennsylvania and Florida Bar Associations, young lawyers' division of the Philadelphia Bar Association, sports and entertainment law section of The Florida Bar, American Intellectual Property Law Association, American Judicature Society, Philadelphia VIP, Young America PAC and the Jewish Federation of Greater Philadelphia. He is active in numerous civic organizations, serves as a mentor to law students and newly admitted attorneys, and regularly handles pro bono matters for a variety of organizations.

Justin was selected as a 2006 Pennsylvania "Lawyer on the Fast Track" by American Lawyer Media, which recognized 45 of the top lawyers and leaders of the legal community under the age of 40 in the Commonwealth of Pennsylvania.

Wineburgh earned his undergraduate degree in electrical engineering from Lafayette College (B.A., 1994) and his law degree from Widener University School of Law (J.D., 1997), where he was editor/administrative board member of the Delaware Journal of Corporate Law, a member of the Moot Court Honor Society and a member of Phi Delta Phi, Harrington Inn, Honor Chapter. He served as a judicial intern to the Supreme Court of Pennsylvania and as a law clerk for the Commonwealth Court of Pennsylvania.

Jonathan M. Stemerman Joins Cozen O'Connor Philadelphia Office as Associate
Jonathan M. Stemerman recently joined Cozen O’Connor’s Philadelphia office as an associate in the firm’s business law department. Prior to joining the firm, he was an associate with a Wilmington, Del., law firm. Stemerman practices in the area of bankruptcy, insolvency and restructuring law, primarily focusing on matters of bankruptcy law, representing debtors, creditor committees and plan administrators in chapter 11 cases, and trustees in chapter 7 cases.

Stemerman is a member of the American Bar Association, as well as the Delaware State and Pennsylvania bar associations and the Delaware Bankruptcy Inn of Court. He is admitted to practice in Delaware and Pennsylvania.

Stemerman earned his undergraduate degree from Colgate University (B.A., 2000) and his law degree from Villanova University School of Law (J.D., cum laude, 2003), where he was managing editor of the Villanova Law Review and received the James J. Manderino Award for Trial Advocacy. Following law school, Stemerman served as a law clerk to the Hon. Randy J. Holland of the Delaware Supreme Court.

Covington Advises Oregon Steel in $2.3 Billion Acquisition by Evraz Group
Evraz Group S.A. and Oregon Steel Mills (NYSE:OS) announced that they have signed a definitive agreement under which Evraz will acquire Oregon Steel for $63.25 per share, for a price of approximately $2.3 billion. Covington advised Oregon Steel Mills in the transaction.

Oregon Steel Mills is one of the most diversified steel manufacturers in North America, producing over 1.8 million tons of specialty and commodity steel products annually. Evraz Group S.A. is one of the largest vertically-integrated steel and mining businesses with operations mainly in Russia.

The Covington team was led by corporate partner J. D. Weinberg in New York. The New York and Washington based team included partner Scott Smith and associates Andrew Ment, Marcus Weiss, Ingrid Loreen and Michelle Garcia (corporate), as well as partner Michael Francese (employee benefits), Robert Heller (tax), partner Corinne Goldstein (environmental), partner George Chester and associate Chris Oatway (antitrust), and David Marchick, Peter Flanagan, Linda Morgan, Kimberly Strosnider and Damara Griffith (regulatory).

Litigation Attorney Sullivan Publishes Antitrust Article in ABA Newsletter
Litigation attorney Sean R. Sullivan published an article titled "Antitrust Rules and Reverse Payment Patent Infringement Settlements" in the Fall 2006 edition of Intellectual Property Litigation.

Sullivan is an associate in Buchanan Ingersoll & Rooney's Philadelphia office.

The article discusses the circuit split over the antitrust treatment of reverse payment settlements of Hatch-Waxman patent infringement litigation.

Intellectual Property Litigation is published by the Intellectual Property Litigation Committee of the American Bar Association's Section of Litigation.

Buchanan Ingersoll & Rooney's Growth Noted by National Law Journal; Firm Ranks 68th in Nation
Buchanan Ingersoll & Rooney's strong growth was noted by the National Law Journal in its annual survey of the largest 250 law firms in the country. The article, titled "'NLJ 250' Shows Strong Law Firm Growth Continuing," ranked the firm 68th in the nation.

The journal listed the July 2006 Buchanan Ingersoll-Klett Rooney merger among the year's largest law firm mergers, and noted that the firm had the second-largest growth over the year with 41.8 percent.

Litigation Attorneys Weiner and Brown present 'Navigating the New Electronic Discovery Amendments' to Philadelphia Federal Courts Committee
Litigation attorneys Paul D. Weiner and Mary Kay Brown, and the Honorable Timothy J. Savage, United States District Court judge for the Eastern District of Pennsylvania, presented "Navigating the New Electronic Discovery Amendments to the Federal Rules of Civil Procedure and Judicial Approaches to E-Discovery" to the Philadelphia Federal Courts Committee on November 15, 2006. Weiner and Brown are shareholders in Buchanan Ingersoll & Rooney's Philadelphia office.

Weiner and Brown's portion of the presentation addressed the background and history of the Amendments to the Federal Rules of Civil Procedure dealing with electronic discovery (which become effective on December 1, 2006), an overview of the New Rules and practical pointers for practitioners and the judiciary. Judge Savage focused on judicial approaches to e-discovery, including his standing "Order for Discovery of Electronic Documents" that has been cited by litigants and other courts as a model e-discovery order.

Weiner and Brown speak and publish frequently on electronic discovery issues. Their work on this topic was cited by the landmark opinion in Zubulake v. UBS Warburg LLC, 220 F.R.D. 212, 220 n.39 (S.D.N.Y. 2003) (Scheindlin, J.), which addressed both the scope of a litigant's duty to preserve electronic evidence and the consequences for failing to preserve evidence that falls within the scope of that duty, as well as the Federal Judicial Center's database on significant cases and articles in the area of electronic discovery. Their next article on this subject, "Navigating the New E-Discovery Rules," is scheduled to be published in the Winter 2007 edition of The ABA Journal of the Section of Litigation.
