Three Weltman, Weinberg & Reis Co., L.P.A. Partners Recognized as Ohio Super Lawyers
January 3, 2006– Weltman, Weinberg & Reis Co., L.P.A., the nation’s largest creditors’ rights law firm based on revenue and placements according to Collections & Credit Risk magazine, is pleased to announce that three partners were selected as Ohio Super Lawyers for 2006.

Robert B. Weltman, Alan H. Weinberg, and Rosemary Taft-Milby each were chosen among the top five percent of Ohio’s licensed attorneys for the third consecutive year. The list, a joint project of Law and Politics Magazine and Cincinnati Magazine, surveyed more than 35,000 attorneys across Ohio asking them to nominate the best lawyers in the state.

Robert Weltman is the senior partner of the firm and concentrates in complex collections. Mr. Weltman’s experience in the area of creditors’ rights has earned him local, state and national prominence. In 2003 he was named the Ernst & Young Entrepreneur Of The Year for the Service Industry Category in Northeast Ohio. Mr. Weltman is a member of the American, Ohio State, Cuyahoga County and Cleveland Bar Associations. He is licensed in Ohio and is admitted to practice before the U.S. District Court (Northern District of OH) and the U.S. Supreme Court. Mr. Weltman is a member of the Cleveland Bar Association (Municipal Court Committee), National Association of Retail Collection Attorneys and Northern Ohio Credit Association.


Alan Weinberg is the managing partner of the firm and previously managed the Litigation & Defense department in WWR’s Cleveland office. Mr. Weinberg is a member of the Ohio State Bar Association and Cleveland Bar Association (Bankruptcy and Commercial Law sections). He is licensed in Ohio and is admitted to practice before the U.S. District Court (Northern District of OH) and the U.S. Supreme Court. Mr. Weinberg is certified as a Creditors’ Rights Specialist by the American Board of Certification. Mr. Weinberg is a member of the Commercial Law League of America and Northern Ohio Credit Association (past President). He is also the Educational Chairperson of the Ohio Creditors Attorney Association and a Board Member of Care Alliance.

Rosemary Taft-Milby is the partner managing the Litigation & Defense department in the Cleveland office. She is licensed in Ohio and Kentucky, and is admitted to practice before the U.S. District Court (Northern District of OH, Eastern District of KY, Western District of KY), the U.S. Supreme Court, the Sixth Circuit Court of Appeals and the U.S. Court of Claims. Ms. Taft-Milby is certified as a Creditors’ Rights Specialist by the American Board of Certification. She is one of only six women in America to be so certified. Ms. Taft-Milby is a member of the American Bar Association, Kentucky Bar Association, Ohio State Bar Association (Women in the Profession and Litigation sections), Cleveland Bar Association (commission of Women in the Law) and the Ohio Women’s Bar Association.

Bankruptcy 2006: Church Cases Challenge First Amendment
The Chapter 11 cases of two Roman Catholic dioceses are sparking a bitter debate that may have lasting First Amendment implications and a major impact on church–state separation jurisprudence.

In resolving sex-abuse lawsuits in 2004, the Archdiocese of Portland, Oregon and the Diocese of Spokane, Washington filed for Chapter 11 protection. But in August 2005, a bankruptcy court ruled that the Spokane parish property can be sold to repay abuse victims in the bankruptcy. Then on Friday, a bankruptcy court deemed that the Portland archdiocese, not its parishes, owns the US$500 million parish property.

The dioceses both argue that the Catholic Church's internal law, canon law, bars them from using assets of the parishes, which are held in trust, to settle the sex abuse claims, and that the courts are required to respect the churches' religious freedom to organize internally.

Past court rulings have indeed given churches the right, under the First Amendment, to use canon law to organize their civil property relationships. Many Catholic dioceses in the United States are in fact organized as corporations sole, meaning that as the sole owner of the corporation, the bishop or archbishop holds the assets of the individual parishes in his name.

Lawyers for the sex-abuse victims, however, say there's no clear legal—or practical—separation between the parishes and the diocese: they are not are not independent legal entities. Abuse victims iterate that a religious organization's external relationships to the rest of society can only be governed by civil law.

Some bankruptcy experts agree, arguing that the very act of filing for protection under federal bankruptcy law puts a religious organization's autonomy in jeopardy. "When a regulating group seeks the protection of a civil authority, it, in a sense, loses some of its self regulating rights," says Bill Gray. "In order to take advantage of that shield, you also have to be prepared for the sword of bankruptcy."

Meanwhile, a Tucson, Arizona diocese avoided the issue earlier this year in exiting Chapter 11 protection last year after reaching a US$22.3 million settlement with abuse victims.

A resolution that sidesteps the ownership issue is not likely in either Portland or Spokane, says Bill. "I certainly think this is something that is very likely to wind itself up the appellate chain. "I think on the issue of separation of church and state, it could have a major impact."

Monica S. Bloom and Robert F. Simpson II Join Stuart & Branigin
Lafayette, Indiana – January 3, 2006 – Monica S. Bloom and Robert F. Simpson II, have joined the Lafayette office of Stuart & Branigin LLP. Both are admitted to the Indiana State Bar and the U.S. District Courts for Northern and Southern Districts of Indiana.

Bloom, an associate in the firm’s litigation group, earned her J.D. degree, summa cum laude, from the University of Illinois College of Law in 2005 and her B.A., cum laude, from Duke University in 2001. While in law school, Bloom served as articles editor for the University of Illinois Law Review and was a 2005 recipient of the Rickert Awards for Excellence in Academic Achievement and Excellence in Legal Publications.

Simpson, an associate practicing in the area of business transactions, received his J.D. degree from the Indiana University School of Law in 2005 after earning a B.A., cum laude, from Albion College. He also studied at the University of Cape Town (South Africa) and the University of Cape Town School of Law. As a law student, Simpson was a semi-finalist in the European Union Law International Moot Court competition on European Union business law and participated in the George Washington University National Security Law Moot Court competition. Before joining Stuart & Branigin, Simpson completed legal internships with the Hendricks County Prosecutor’s Office in Danville, Indiana, and with Finish Line Inc. in Indianapolis.

Sheppard Mullin Welcomes San Diego Litigator, Dana Dunwoody
Dana J. Dunwoody has joined the San Diego office of Sheppard, Mullin, Richter & Hampton LLP as a partner in the Business Trial Practice Group. Dunwoody, most recently at Mazzarella, Dunwoody & Caldarelli in San Diego, focuses on trials, arbitration, and litigation of disputes concerning real property, partnerships, intra-corporate matters, contracts, hotel management agreements and franchise agreements, employment and intellectual property.
