Skilled Real Estate Attorney Joseph S. Stuart Builds Up Luce Forward's Orange County Office - California Law Firm Hires New Partner for its Orange County Office
Joseph S. Stuart has joined Luce, Forward, Hamilton & Scripps LLP, one of California’s leading full-service law firms, as a partner in the firm’s real estate practice group. Stuart will work from Luce Forward’s newly opened Orange County office.

“Joe is a highly respected attorney with strong ties to the Orange County community,” said Robert J. Bell, Luce Forward’s managing partner. “His commercial/transactional experience will add further depth to our real estate practice group, and he will play a key role as we open up the new office, providing enhanced services to our clients as we expand throughout the state.”

Stuart is a seasoned real estate attorney, specializing in transactions for industrial, retail, office, residential and shopping center properties. Having spent the majority of his career in Orange County, Stuart has expert knowledge regarding the needs of his clients and the intricacies involved with practicing real estate law locally. Throughout his career, Stuart has handled approximately $2 billion in transactions in both Northern and Southern California, as well as Colorado, Georgia, Hawaii, Illinois, Nevada, New Jersey, Oregon, Pennsylvania, Texas and Washington.

King & Spalding Secures FERC Approval for Client Calhoun LNG For New Facility on Texas Gulf Coast
King & Spalding, a leading international law firm, successfully assisted Calhoun LNG in obtaining permission from the Federal Energy Regulatory Commission (FERC) to site, construct and operate a liquefied natural gas (LNG) import and gasification facility on the Gulf Coast of Texas. Calhoun LNG is a wholly owned affiliate of Gulf Coast LNG Partners, L.P.

FERC Commissioner Suedeen Kelly, in voting in favor of the project, stated she was pleased to support approval of the project. “We will have to increase the importation of natural gas from outside North America,” Kelly said. “It is increasingly clear that LNG will play a growing role in filling the gap between domestic demand and supply.”

King & Spalding partner Erik Swenson, who spearheaded the regulatory efforts of the project, said, “King & Spalding is delighted to have had a role in promoting another source of clean natural gas to help meet U.S. demand for energy." Swenson noted that Gulf Coast’s innovative decision to integrate a gas treatment plant with the project provides a competitive advantage with respect to the sources of LNG it can accept. “We also agree with the FERC that still more projects of this type are needed,” Swenson said.

FERC ordered the Calhoun LNG project to be completed and ready for service within five years after its authorization order. King & Spalding will continue to represent Gulf Coast before FERC and with regard to other regulatory, commercial and financial matters related to the project, as the project progresses.

Calhoun's proposed terminal and associated facilities will be located in the Port of Port Lavaca-Point Comfort in Calhoun County, Texas. The LNG import terminal would be comprised of a marine berth facility, two 160,000 m3 LNG storage tanks and a vaporization and LNG separation facility capable of a 1 bcf sendout, as well as associated utilities, infrastructure and support systems. Separately, the Calhoun County Navigational District is engaged in a contemporaneous port improvement project that will enhance the range of LNG carriers the terminal will be able to receive.

Gulf Coast LNG Partners, L.P. is a Houston-based partnership formed between Gulf Coast LNG, LLC and Haddington Energy Partners II, LP, a private equity fund managed by Haddington Ventures, LLC. Haddington Ventures provides capital to the energy industry, including mid-stream oil and natural gas companies and electric generation, transmission, and distribution companies, with a focus on natural gas storage, gathering and processing, and other midstream activities. David Laufman Contributes Guest Observer Article in Roll Call
Partner David H. Laufman authored an article titled “Outside Panel Won’t Resolve Core Ethics Panel,” which ran in the “Guest Observer Column” of Roll Call. In the article Mr. Laufman discusses the potential enforcement regime Members of Congress can expect from the Senate Ethics Committee and the House Committee on Standards of Official Conduct under S. 1, the Honest Leadership and Open Government Act of 2007. Mr. Laufman contends that while the Senate Committee will continue to bring balanced enforcement to the new rules, as it has done in the past, the same can not be expected in the House. Instead, Mr. Laufman suggests that the establishment of an outside ethics panel will not solve the core problems that afflict the House, even though it may enhance public confidence in the integrity of the House ethics process.

David Laufman Quoted in Washington Post Article
David Laufman was quoted in a Washington Post article discussing the reorganization of the FBI in which its two international terrorism units have merged into a new structure that resembles Britain’s MI5 domestic intelligence agency and the bureau’s own efforts against organized-crime. Laufman, who prosecuted several of the government’s major terrorism cases following the 9/11 terrorist attacks as a former Assistant U.S. Attorney, noted that within the new structure it is imperative for intelligence analysts to drive the case agents and create an “environment where analysts and agents continuously and seamlessly work together to identify relationships, sources of funding, and operational planning.”

Freshfields makes new appointments to US antitrust practice
International law firm Freshfields Bruckhaus Deringer promoted Thomas Ensign and Bruce McCulloch to Counsel in its US antitrust, competition and trade (ACT) practice.

Commenting on the appointments, David Aitman, co-head of the firm’s ACT group, said: ‘They are both first rate antitrust lawyers, with a wealth of experience advising clients on a broad range of antitrust issues and representing clients before the US antitrust agencies’.

Fellow co-head Helmut Bergmann added: ‘Each is already well-regarded in the US antitrust bar, and we see them both as the next generation of leadership in the Freshfields US antitrust practice. We are very excited about this step in the continuing growth of our US ACT group.’

The Washington office, which was founded in 1998, includes our US ACT practice, which is now the largest of any firm with European origins. Partners Paul Yde, Bob Schlossberg, MJ Moltenbrey and Counsel Terry Calvani provide clients with the multi-jurisdictional antitrust expertise that has become increasingly critical in international deals. Thomas Ensign

Tom is based in Freshfields’ Washington, DC office. His experience includes defending mergers, acquisitions and joint ventures before the US Department of Justice (DOJ), and the US Federal Trade Commission (FTC). Tom appears regularly before the DOJ/FTC in substantive merger and conduct investigations, and handles many ‘second requests’. He counsels a wide range of clients on the full ambit of antitrust issues, including joint ventures and intellectual property agreements. Prior to joining the firm Tom served as antitrust counsel at Intel Corporation.

Tom received his JD from the University of Michigan Law School and his BA from Vanderbilt University. He is admitted in Washington, DC and Illinois.

Bruce McCulloch

Bruce is also based in Freshfields’ Washington, DC office and specialises in antitrust counselling, litigation and representation before the US DOJ and the FTC. His recent experience includes representing clients in multi-jurisdictional merger investigations and civil and criminal non-merger investigations. He also advises clients on antitrust compliance and antitrust litigation, including federal and state actions, class action lawsuits and grand jury investigations.

Bruce received his JD from George Mason University School of Law with high honours and his BA from the University of Virginia. He is admitted in Washington, DC and Virginia.

Julia Swain of Fox Rothschild to Speak at PBA's Bench-Bar Conference
Julia Swain, an associate at Fox Rothschild LLP, will speak at the Philadelphia Bar Association's 2007 Bench-Bar Conference. The conference will be held at Bally's Atlantic City Park Place and The Boardwalk in Atlantic City, NJ, on September 28 & 29, 2007.

Swain will present "Right Down the Middle: Equally Shared Physical-Custody in Philadelphia County." Additional topics at the conference will include appellate advocacy, the Internet and defamation, and earning capacity litigation.

Swain concentrates her practice in the areas of family law, including divorce, custody, support, equitable distribution, and abuse. She also negotiates settlements and prenuptial agreements and litigates family law cases in the five-county Philadelphia area, including appellate courts. Swain is an active member of the Family Law Section of the Philadelphia Bar Association, is a member of the Executive Committee, and co-chair of the Programs Committee. She is a frequent writer and speaker on family law issues.

The conference is expected to bring together more than 500 attorneys and judges from the Philadelphia area. A total of seven CLE credits are available to conference attendees.
